Chapter I General Provisions Article 1 These Rules are formulated in accordance with the Interim Provisions on the Recruitment of Workers by State-owned Enterprises issued by the State Council and in light of the actual situation in our province. Article 2 State-owned enterprises (hereinafter referred to as enterprises) must strictly implement the national labor wage plan when recruiting workers, and no department or unit may recruit workers outside the plan. Article 3 When recruiting workers, an enterprise shall face the society, openly recruit workers, conduct comprehensive assessment and select the best. The methods of "child replacement" and "internal recruitment" for retired employees will no longer be implemented. Article 4 When recruiting employees, an enterprise shall implement the principle of training before employment. Unemployed people who have not received training cannot be recruited in principle. Article 5 When an enterprise recruits employees, it must implement the labor contract system. Chapter II Recruitment Objects and Conditions Article 6 When an enterprise recruits workers, unemployed people in cities and towns who meet the registration requirements and those who are allowed to recruit from rural areas according to state regulations may register. Seventh enterprises located in rural areas can recruit qualified personnel to eat commodity grain nearby. Eighth strictly control the recruitment from rural areas. In addition to underground mines, forest logging, field geological exploration, transportation and railway loading and unloading, postal workers in posts and telecommunications towns and in-line operators, construction and installation, brick and sand production in building materials industries and other heavy jobs and posts, farmers can be recruited according to conditions, and other industries are not allowed to recruit from rural areas. Special needs to recruit farmers, should be submitted to the provincial people's government for approval. Article 9 An enterprise must have the following basic conditions: good performance in reality, good health, at least 16 years old, and junior high school education or above. The age of special technicians can be determined according to needs. Article 10 When an enterprise recruits employees, it shall recruit female employees of various types suitable for women to engage in labor. Except for some particularly heavy jobs in underground mines, logging, loading and unloading, building materials and other industries, the proportion of female employees shall not be less than 30%; The proportion of female employees in textile, commercial catering and other industries shall not be less than 70%. Chapter III Recruitment Assessment and Recruitment Article 11 When an enterprise recruits workers, the recruiting unit shall put forward a recruitment brochure, which clearly stipulates the employment form, probation period, job type, major, recruitment amount, recruitment conditions, male-female ratio, assessment methods, etc. After examination and approval by the local labor administrative department at or above the county level, it shall be organized and implemented by the enterprise or the competent department of the enterprise. The enterprise is responsible for the recruitment and admission, and selects the best candidates according to the examination results, and posts a list of employees. Article 12 The assessment contents and standards for enterprises to recruit workers shall be determined according to the needs of production and work. Recruit apprentices and skilled workers and pay attention to cultural assessment; Direct recruitment of skilled workers, focusing on professional knowledge and practical skills assessment; Recruit manual workers, focusing on physical condition assessment. When employees waiting for employment and those who have received vocational and technical training participate in the recruitment, they may not take the cultural examination, but only take the professional knowledge and skills examination; Personnel with technical grade certificates and professional counterparts can be directly employed on the basis of merit. Thirteenth enterprises to recruit workers, physical examination. General types of work can refer to the physical examination standards of technical school enrollment; Special industries or types of work, according to the national and provincial departments to develop physical examination standards. Physical examination must be carried out in hospitals above designated counties (cities, districts). Chapter IV Organization and Management Article 14 The recruitment of enterprises shall be managed by the competent labor administrative department under the leadership of the local people's government. Its main responsibilities are: approving and issuing recruitment plans, implementing recruitment policies, reviewing recruitment brochures, arranging recruitment sources, handling recruitment approval procedures, and supervising and inspecting recruitment. Article 15 When handling the recruitment examination and approval procedures, an enterprise shall go to the labor administrative department at or above the county level with the household registration book, the labor certificate, the vocational and technical training certificate and the Approval Form for the Employment of Workers with Joint Labor System in State-owned Enterprises, and receive the Labor Manual and the Notice for the Employment of Workers with Labor Contract System in State-owned Enterprises. The Approval Form for Employment of Workers with Labor Contract System in State-owned Enterprises is kept in my file, and the Labor Manual is kept by the enterprise. When a labor contract worker is dismissed, terminated or dissolved, the enterprise shall return the labor manual to him.
The forms of "Approval Form for Employment of Workers with Labor Contract System in State-owned Enterprises" and "Notice of Employment of Workers with Labor Contract System in State-owned Enterprises" shall be uniformly issued by the Provincial Labor and Personnel Department and the Labor and Personnel Department of each city, prefecture and state. Article 16 When the rural labor force needs to be arranged due to land acquisition, the land-expropriated unit shall go to the local labor administrative department to verify the number of recruits, and then go to the provincial labor and personnel department for examination and approval with the land use approval certificate. Article 17 Where workers are recruited in different places and across provinces, the competent labor administrative department of the city, prefecture or state where the enterprise is located shall put forward opinions and report them to the provincial labor and personnel department for examination and approval; Cross-city, prefecture and county recruitment must be approved by the labor administrative department of the city, prefecture and state where the recruitment enterprise is located. Article 18 When recruiting employees, enterprises must strictly abide by the relevant state policies and regulations and resolutely oppose unhealthy practices. Workers who are recruited in violation of regulations will be dismissed immediately upon discovery, and the administrative responsibilities of relevant personnel will be investigated. Chapter V Supplementary Provisions Article 19 State organs, institutions and social organizations shall employ laborers in accordance with these Detailed Rules.
