In this regard, a 73-year-old headmaster of a private school in Shaoguan questioned: My students don't have a high school diploma and can't take the local senior high school entrance examination, so are my students deprived of the right to take the college entrance examination and receive higher education?

At present, the lawsuit of 70-year-old Weng and the Provincial Department of Education has been appealed to the Guangzhou Intermediate People's Court. Surprisingly, the students of the elderly are a group of junior high school graduates who failed in the senior high school entrance examination. They plan to complete the three-year liberal arts course in high school in one year, and then go directly to college. Through investigation, the reporter found that many students in this private school did have this experience-they were admitted to the university one year after graduating from junior high school.

On March 5 this year, Guangzhou Intermediate People's Court held a hearing to hear a special appeal case. Liu Zhi, the 73-year-old headmaster of a private school, fought for his students' right to enter the college entrance examination, and filed an administrative lawsuit with the court on the grounds that the provincial education department had no right to recognize the equivalent academic qualifications. After losing the case in the first instance, he appealed to Guangzhou Intermediate People's Court.

At present, there is no final judgment on this administrative lawsuit. Then, can junior high school graduates be admitted to the university after one year of tutoring? Are students who have not attended high school eligible to take the college entrance examination? How did this dispute over the right to the college entrance examination last for several years come about? Recently, our reporter conducted an investigation.

Private education reform completes high school curriculum in one year.

On the afternoon of March 7, the reporter met Liu Zhiren and his "special school" at the Workers' Cultural Palace in Renhua County, Shaoguan City.

Liu Zhiren is the principal and the only teacher of this "special school". According to his own introduction, he taught in his early years, participated in the liberation uprising, made propaganda in the army, worked as a technician on the farm and conducted employee education. 1983 applied to establish a private Japanese new school in Renhua county after leaving the army. After being approved, the class was started on February 1984, and the teaching reform experiment was carried out. At first, it was a cram school for junior high school and a tutorial class for self-study exams for higher education. Starting from 1988, the "experimental class of liberal arts in senior high school" was set up to recruit students who failed in the senior high school entrance examination and dropped out of secondary school, so that they could complete six courses of liberal arts in senior high school within one year, and then take the adult college entrance examination and the general college entrance examination that year.

Pointing to a list on the table, he said that since 1984, when several boards were set up as tables to start short-term remedial classes, he * * * enrolled more than 1700 students, most of whom were junior high school graduates and a few high school graduates. Up to now, * * * has 162 people passed the self-study exam, adult college entrance examination and general college entrance examination, and most students, including Zhong Da University, South China University of Technology, South China Normal University and Jinan University, passed the adult college entrance examination, and some students passed the general college entrance examination. 1more than 20 failed students who failed in high school were admitted to the university from him.

Liu Zhiren said that many of his students are now working, some are teachers, some are policemen, some are businessmen and some are part-time. After follow-up investigation, no matter who was admitted to the university or who was not admitted to the university, there was no illegal crime. This proves that his teaching reform experiment is successful.

It is true that junior high school graduates are admitted to universities.

On the afternoon of March 7, when the reporter interviewed Nisshin School, a student named Pan told the reporter that he graduated from junior high school last year and didn't go to high school. He came here in August of that year to study liberal arts courses in senior three, and now he has reached the level of the second semester of senior two, and he can complete all the courses in two or three months. He said that he wanted to take part in this year's college entrance examination, and that it should be no problem to work hard for four months. Another student surnamed Wen said that he wanted to enter Sun Yat-sen University and believed that he had this ability.

The reporter asked them if it was hard to finish three years of high school courses in one year, and what was the teaching effect here? The two students said, "It's not hard to study. The teaching methods and methods here are different. It is an experiment and the effect is quite good. "

On March 12, the reporter contacted several of his former students according to the list provided by Liu Zhiren. A girl named Cao Xiaohua said, "1994 After graduating from junior high school, I went to Teacher Liu's Nisshin School for one year. I am a liberal arts student in high school. I 1995 participated in the adult college entrance examination and was admitted to the computer accounting class of Shaoguan University. I graduated from 1997. There are 43 students in that group, some take the adult college entrance examination, and some take the general college entrance examination. Only one person is not online. "

Zhuang Zhizhen, who graduated from the Chinese Secretary College of Guangdong Administration College and is currently studying for a bachelor's degree in law in distance education in Peking University, said that she studied liberal arts in senior high school in Rixin School for one year, 1998 took the adult college entrance examination and was admitted to the School of Administration. She said that none of the students in that class took part in the general college entrance examination, but some took part in previous sessions.

Yang Xiaohui, a graduate student of CUHK who will graduate this year, said that he studied in Liu Zhiren's junior high school, then went to an ordinary high school and was admitted to Zhejiang University with 1994. Although he was not directly admitted to Nisshin School, he said: "Teacher Liu's teaching method is not indoctrination, but induction. The biggest difference from ordinary middle schools is that the speed is fast and the teaching effect is quite good. "

Students whose future is blocked are not eligible to sign up for the college entrance examination.

Liu Zhiren said: "1996, the local education administrative departments and examination institutions began to restrict us from enrolling my students in the general college entrance examination on the grounds that they did not have a high school diploma and examination results. They are only allowed to take the adult college entrance examination verbally. In order to take part in the college entrance examination, we propose to set up an experimental middle school. However, the education authorities believe that they do not have the conditions and do not approve me to hold ordinary high schools. "

He took out a stack of "Approval Letters for the Record of Various Cultural and Technical Schools (Classes) Organized by Shaoguan Social Forces" and showed it to reporters, saying that he was running an experimental class of liberal arts in high school. After one year's experimental teaching, his students have finished their senior high school courses. Although they have not obtained the graduation certificate issued by the education department, they actually have the same academic ability as high school graduates and should enjoy the right to take the college entrance examination.

On the morning of March 8, the reporter interviewed the local education administrative department about Renhua Private Rixin School.

His students used to take the adult college entrance examination instead of the ordinary college entrance examination, and they took the adult colleges instead of ordinary colleges. "

They said: "According to the relevant policies and regulations of the state and the province, these students can take the self-study exam, but they have no student status file, no high school diploma, and no high school examination results to take the general college entrance examination, so they are not eligible to register."

Fight for the right of college entrance examination for students in court

Liu Zhiren insisted that his students have the same academic ability as senior high school, and repeatedly reported to the higher education administrative departments and examination departments, demanding that his students be allowed to take the general college entrance examination. Without approval, in March, 20001,Liu Zhiren applied to the Guangdong provincial education department for administrative reconsideration, demanding that the provisions of the provincial examination center that he should not take the college entrance examination without a high school diploma and examination results should be revoked, and that six students of his school with no high school diploma and age 16 should be allowed.

To this end, the Provincial Department of Education issued the "Administrative Reconsideration Decision" on April 27 of that year, and decided to cancel the age limit for candidates taking the general college entrance examination in provincial examination centers. Abolish the decision of Guangdong Provincial Higher Education Department's Interim Provisions on Enrollment of Adult Higher and Secondary Specialized Schools in Guangdong Province (Guangdong Zhao Gao {1996} No.6) that "those who have reached the age of 20 and submitted junior high school graduation certificates can be regarded as high school graduates with the same academic ability and accepted to apply for adult colleges"; Liu Zhiren reflected the qualifications of six students for the general college entrance examination in that year, which were determined in accordance with the relevant provisions of the Ministry of Education and the Provincial College Admissions Committee. In other words, to take the college entrance examination, you must either have a high school diploma or pass the high school examination. Liu's six students obviously don't meet this requirement.

Liu Zhiren refused to accept the administrative reconsideration decision made by the Provincial Department of Education, and filed an administrative lawsuit with the Dongshan District People's Court in May, 20001,arguing that the qualification determination of the Provincial Department of Education for the college entrance examination was illegal, and requested the court to revoke its reconsideration decision and allow its students to take the general college entrance examination.

He said: "The determination of college entrance examination qualifications should be decided by law. The power of judicial interpretation of' having the same education' belongs to the National People's Congress and the Supreme People's Court, and the Provincial Department of Education has no right to interpret it; The Provincial Department of Education believes that in order to achieve the same educational level in high schools, it is necessary to take the local high school graduation examination and graduation examination, but it does not organize these students to take such examinations, which actually deprives them of the right to take the examinations and enjoy higher education. Forcing these students to take the so-called high school graduation exam or graduation exam is an abuse of power. "

In its reply, the Provincial Department of Education believes that the Provincial Department of Education, as the cognizance and competent authority of our province's senior secondary education qualifications and equivalent academic qualifications, stipulates that our province's senior secondary education graduates refer to those who hold senior secondary education diplomas. Our province's senior secondary education equivalent personnel refers to those who have passed the graduation examination organized by ordinary high school examinations or participated in the graduation examination in accordance with the relevant provisions of the state without the graduation certificate of senior secondary education, and have achieved qualified results.

Dongshan District People's Court, after hearing the case, held that Liu Zhiren's failure to admit six students to apply for reconsideration in the college entrance examination did not involve his own rights, and Liu Zhiren should not be regarded as the right holder of the application for reconsideration. The Provincial Department of Education accepted this application and handled it, which violated the provisions of Article 6 of the Administrative Reconsideration Law and belonged to ultra vires administration. On February 24th last year, 12, Dongshan District People's Court decided to cancel the administrative reconsideration decision made by the Provincial Department of Education.

After the judgment of the first instance, Liu Zhiren thought that although the first instance of reconsideration by the Provincial Department of Education was cancelled, his six students were still not allowed to take the college entrance examination, and the most important issue of college entrance examination rights remained unresolved. So he appealed to the Guangzhou Intermediate People's Court.

He said: "The state recognizes that the self-taught examination of academic qualifications can be applied regardless of age, gender or academic ability. Even junior college courses can be taught by themselves, while senior high school courses are one level lower than self-taught exams. Why can't you teach yourself? Since the university decided to take the exam, why are my students not qualified to take the exam? "

The provincial education department exam must have no diploma.

On March 12, the reporter interviewed Liu Shi, an agent and an associate professor of law at the Provincial Department of Education, on this lawsuit. He said: "High school equivalent refers to holding senior secondary education diplomas such as senior middle schools, secondary schools and secondary vocational schools. He said: "Although there is no clear legal provision on the determination of equivalent academic qualifications, the Ministry of Education has a document stipulating that the equivalent academic qualifications of high schools are determined by the provincial education administrative department."

After the adult college entrance examination is released, you can apply for junior high school or above. However, the enrollment of ordinary college entrance examination is a very serious matter, not because the provincial education department is not open and does not adapt, which involves the whole college entrance examination enrollment system and policy. Junior high school graduates think that they have the same academic ability as high school, and they can also sign up for the general college entrance examination, but they must prove it. "

He told reporters that the Provincial Department of Education attached great importance to the questions raised by Liu Zhiren, and held several meetings to persuade him to organize students to take part in the local senior high school entrance examination. He only has these six students, not a school, and he can get the same academic ability by taking the local senior high school entrance examination. The senior high school entrance examination is a world practice, and the Provincial Department of Education has always advocated the unified organization of examinations throughout the country.

Regarding this administrative lawsuit, Liu said that Liu Zhiren is not the subject of the lawsuit and does not represent the school without a power of attorney from the parents of the students. It is unreasonable for him to file a lawsuit in his own name.

After extensive contact with middle school textbooks, Liu Zhiren thinks that the structure and teaching methods of the current textbooks in China are obviously lagging behind, and the level of textbooks is far behind the students' intelligence level, and the content is cumbersome and repetitive, which cannot fully satisfy the growing thirst for knowledge of young students.
