At present, the lawsuit of 70-year-old Weng and the Provincial Department of Education has been appealed to the Guangzhou Intermediate People's Court. Surprisingly, the students of the elderly are a group of junior high school graduates who failed in the senior high school entrance examination. They plan to complete the three-year liberal arts course in high school in one year, and then go directly to college. Through investigation, the reporter found that many students in this private school did have this experience-they were admitted to the university one year after graduating from junior high school.

On March 5 this year, Guangzhou Intermediate People's Court held a hearing to hear a special appeal case. Liu Zhi, the 73-year-old headmaster of a private school, fought for his students' right to enter the college entrance examination, and filed an administrative lawsuit with the court on the grounds that the provincial education department had no right to recognize the equivalent academic qualifications. After losing the case in the first instance, he appealed to Guangzhou Intermediate People's Court.

At present, there is no final judgment on this administrative lawsuit. Then, can junior high school graduates be admitted to the university after one year of tutoring? Are students who have not attended high school eligible to take the college entrance examination? How did this dispute over the right to the college entrance examination last for several years come about? Recently, our reporter conducted an investigation.

Private education reform completes high school curriculum in one year.

On the afternoon of March 7, the reporter met Liu Zhiren and his "special school" at the Workers' Cultural Palace in Renhua County, Shaoguan City.

Liu Zhiren is the principal and the only teacher of this "special school". According to his own introduction, he taught in his early years, participated in the liberation uprising, made propaganda in the army, worked as a technician on the farm and conducted employee education. 1983 applied to establish a private Japanese new school in Renhua county after leaving the army. On March 12, the reporter contacted several of his former students according to the list provided by Liu Zhiren. A girl named Cao Xiaohua said, "1994 After graduating from junior high school, I went to Teacher Liu's Nisshin School for one year. I am a liberal arts student in high school. I 1995 participated in the adult college entrance examination and was admitted to the computer accounting class of Shaoguan University. I graduated from 1997. Fight for the right of college entrance examination for students in court

Liu Zhiren insisted that his students have the same academic ability as senior high school, and repeatedly reported to the higher education administrative departments and examination departments, demanding that his students be allowed to take the general college entrance examination. Without approval, in March, 20001,Liu Zhiren applied to the Guangdong provincial education department for administrative reconsideration, demanding that the provisions of the provincial examination center that he should not take the college entrance examination without a high school diploma and examination results should be revoked, and that six students of his school with no high school diploma and age 16 should be allowed.

To this end, the Provincial Department of Education issued the "Administrative Reconsideration Decision" on April 27 of that year, and decided to cancel the age limit for candidates taking the general college entrance examination in provincial examination centers. Abolish the decision of Guangdong Provincial Higher Education Department's Interim Provisions on Enrollment of Adult Higher and Secondary Specialized Schools in Guangdong Province (Guangdong Zhao Gao {1996} No.6) that "those who have reached the age of 20 and submitted junior high school graduation certificates can be regarded as high school graduates with the same academic ability and accepted to apply for adult colleges"; Liu Zhiren reflected the qualifications of six students for the general college entrance examination in that year, which were determined in accordance with the relevant provisions of the Ministry of Education and the Provincial College Admissions Committee. In other words, to take the college entrance examination, you must either have a high school diploma or pass the high school examination. Liu's six students obviously don't meet this requirement.

Liu Zhiren refused to accept the administrative reconsideration decision made by the Provincial Department of Education, and filed an administrative lawsuit with the Dongshan District People's Court in May, 20001,arguing that the qualification determination of the Provincial Department of Education for the college entrance examination was illegal, and requested the court to revoke its reconsideration decision and allow its students to take the general college entrance examination.

He said: "The determination of college entrance examination qualifications should be decided by law. The power of judicial interpretation of' having the same education' belongs to the National People's Congress and the Supreme People's Court, and the Provincial Department of Education has no right to interpret it; The Provincial Department of Education believes that in order to achieve the same educational level in high schools, it is necessary to take the local high school graduation examination and graduation examination, but it does not organize these students to take such examinations, which actually deprives them of the right to take the examinations and enjoy higher education. Forcing these students to take the so-called high school graduation exam or graduation exam is an abuse of power. "

In its reply, the Provincial Department of Education believes that the Provincial Department of Education, as the cognizance and competent authority of our province's senior secondary education qualifications and equivalent academic qualifications, stipulates that our province's senior secondary education graduates refer to those who hold senior secondary education diplomas. Our province's senior secondary education equivalent personnel refers to those who have passed the graduation examination organized by ordinary high school examinations or participated in the graduation examination in accordance with the relevant provisions of the state without the graduation certificate of senior secondary education, and have achieved qualified results.

Dongshan District People's Court, after hearing the case, held that Liu Zhiren's failure to admit six students to apply for reconsideration in the college entrance examination did not involve his own rights, and Liu Zhiren should not be regarded as the right holder of the application for reconsideration. The Provincial Department of Education accepted this application and handled it, which violated the provisions of Article 6 of the Administrative Reconsideration Law and belonged to ultra vires administration. On February 24th last year, 12, Dongshan District People's Court decided to cancel the administrative reconsideration decision made by the Provincial Department of Education.

After the judgment of the first instance, Liu Zhiren thought that although the first instance of reconsideration by the Provincial Department of Education was cancelled, his six students were still not allowed to take the college entrance examination, and the most important issue of college entrance examination rights remained unresolved. So he appealed to the Guangzhou Intermediate People's Court.

He said: "The state recognizes that the self-taught examination of academic qualifications can be applied regardless of age, gender or academic ability. Even junior college courses can be taught by themselves, while senior high school courses are one level lower than self-taught exams. Why can't you teach yourself? Since the university decided to take the exam, why are my students not qualified to take the exam? "

The provincial education department exam must have no diploma.
