What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) application

Those who meet the requirements for applying for marriage registration shall apply for marriage registration in person with their own registration photos, relevant certificates and supporting materials, and both parties shall fill in the application documents for marriage registration on the spot.

The preparation materials for marriage registration application depend on the specific circumstances. For example, a citizen of China who applies for marriage in China needs to hold his/her ID card, household registration book, certificate of premarital examination, certificate of no spouse, and a signed statement that he/she has no direct blood relationship with the other party and collateral blood relationship within three generations. Divorce application for remarriage requires a divorce certificate.

Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who settle in China) must hold their valid passports or other identification certificates, nationality certificates, foreigners' residence permits or temporary entry and residence certificates, and certificates that can effectively prove their marital status.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the marriage application submitted is within the conditions. If there is any ambiguity, the marriage registration authority shall ask the parties concerned and ask them to provide relevant certification materials when necessary.

(3) Registration and licensing

The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For divorced people, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The divorce registration procedure is as follows:

(1) application

If the husband and wife divorce voluntarily, they shall sign a written divorce agreement and jointly apply to the relevant marriage registration authority, and provide the following documents and supporting materials:

2. Identity documents required for divorce registration, such as my ID card, household registration book, pass, passport or other valid international travel documents;

(2) Accept

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application and issues a receipt for accepting the divorce registration application to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the receipt for accepting the divorce registration application (it is not necessary to provide the lost one, but it is necessary to explain the situation in writing), and withdraw the divorce registration application from the marriage registration office that accepts the divorce registration application, and fill out the Application for Withdrawing the Divorce Registration and other relevant documents in person. After verifying the information, the marriage registration authority shall issue a confirmation form for cancellation of divorce registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date of the period), both parties shall apply to the marriage registration authority for a divorce certificate with the relevant documents and materials specified in the Marriage Registration Code, such as the divorce agreement signed by both parties, marriage certificate, photos and valid documents to prove their identity. The marriage registration authority shall conduct the examination in accordance with the relevant procedures and conditions. Those who do not meet the conditions for divorce registration shall not go through the divorce registration formalities. When necessary, the marriage registration authority may, at the request of the parties concerned, issue a notice not to register for divorce.

(5) Registration and issuance of divorce certificates

The marriage registration authority shall register in accordance with the provisions and issue a divorce certificate.
