Chapter I General Provisions Article 1 In order to strengthen the management of the Yellow River Project, improve the flood control capacity, give full play to the comprehensive benefits of the project, and ensure the safety of economic construction, social development and people's lives and property, according to the provisions of the People's Republic of China (PRC) Water Law, the Regulations on the Management of People's Republic of China (PRC) River and other relevant laws and regulations, and in combination with the actual situation of the Yellow River (including Qinhe River, the same below) project within the administrative region of this province, Article 2 These Regulations are applicable to the management and protection of the Yellow River Project within the administrative region of this province.

The Yellow River Project as mentioned in these Regulations refers to the Yellow River dike (including Qinhe dike, Taihang dike, Beijin dike, Guanmeng dike, beach resettlement protection dike, old dike and old dam, etc.). ), dangerous work, culvert, flood diversion, flood detention, river control and dredging, beach protection and other projects, as well as various engineering signs, transportation, electric power, communication, management and protection, observation, etc. Article 3 The management of the Yellow River Project shall adhere to the principles of unified planning, hierarchical management, simplicity and high efficiency, and implement equal emphasis on construction and management, separation of management and maintenance, rational development and paid use. Article 4 The berms, dams, dams, siltation areas, siltation areas, old dikes and dams demarcated according to law along the Yellow River are all owned by the state and are managed and used by the Yellow River Affairs Department in a unified way, and no unit or individual may occupy them without authorization. Article 5 The people's governments at all levels along the Yellow River shall strengthen their leadership over the construction of the Yellow River Project, organize relevant departments, units and the masses to support the construction of the Yellow River Project, coordinate and do a good job in land use and resettlement compensation for the project construction, and ensure the smooth progress of the project construction. Article 6 The Yellow River affairs departments of provinces, cities and counties (cities, districts) are the competent authorities of the Yellow River project within their respective administrative areas, exercise the duties of the Yellow River water administrative department, and manage the Yellow River course and the Yellow River project in a unified way according to the principle of hierarchical management.

The local public security organs are responsible for the safety and security of the Yellow River Project. Seventh Yellow River affairs departments at all levels should establish and improve the management responsibility system, and gradually establish a market-oriented, professional and socialized Yellow River engineering maintenance system.

The maintenance unit shall complete the maintenance work in strict accordance with the contract. Article 8 All units and individuals have the obligation to protect the facilities of the Yellow River Project, and have the right to stop, report and accuse the acts of destroying the Yellow River Project. Chapter II Dike Management Article 9 The management scope of the Yellow River dike project includes: dike (dam) body, dike protection area and dike project safety protection area.

Criteria for delimiting the scope of berm:

(a) the Yellow River levee, lankao county Dongbatou above, the left and right bank of the embankment, back embankment foot not less than 30 meters; At the foot of Dongbatou, Guanmeng, Taihang, Beijin and Yellow River levees in Mengjin County, mengzhou city and wen county, the river course is not less than 30m, and the back river is not less than10m;

(two) Qinhe dike, the river outside the dike foot is not less than ten meters, and the back river is not less than five meters.

If the original berm can't meet the above requirements, the people's governments of cities and counties (cities, districts) under the jurisdiction of the province shall draw it out in accordance with the prescribed standards, and the Yellow River Affairs Department shall go through the formalities for land use in accordance with the provisions of the state and the province.

The scope of the Yellow River dike project safety protection zone:

(a) fifty meters away from the Yellow River embankment and one hundred meters away from the river;

(two) Qinshui River bottom is 30 meters away from the river, 50 meters away from the river. Article 10 It is forbidden to borrow soil, drill wells, blast, ditch, dig pits, dig fish ponds, build kilns, bury graves, build houses, discharge wastes, waste residues, graze, shovel turf, illegally plant, thresh, dry grain, pile up materials, conduct fair trade, exploit underground resources, conduct archaeological excavations and other acts that endanger the integrity of dikes.

It is forbidden to quarry, drill wells, borrow soil, drill wells, dig pits, build kilns, dig ditches, blast, bury graves, dig fish ponds and discharge wastes (slag) in the safety protection zone of dike engineering. Eleventh in the Yellow River embankment project safety protection zone within 200 meters, prohibit unauthorized blasting operations; If it is really necessary to carry out blasting operation or carry out large-dose blasting outside the range of 200 meters, which endangers the safety of dike engineering, the construction unit shall apply to the local Yellow River Affairs Department, and it can only be implemented after the examination and approval of the Yellow River Affairs Department in conjunction with the public security department. Twelfth strictly control the construction of the Yellow River embankment project. If it is really necessary to build, the opinions of the local Yellow River Affairs Department should be obtained in advance, and the design documents should be compiled and reported step by step on the premise of ensuring flood control safety. Construction can only be started after the approval of the Provincial Yellow River Affairs Department or the Yellow River Water Conservancy Commission.

It is forbidden to break the dike (dam) to divert water, drain water, bury pipelines or build other projects without authorization. Thirteenth in the dike project management within the scope of non flood control project construction activities, resulting in damage to the project, the construction unit in accordance with the original design standards to be reinforced, repaired and rebuilt; If the construction unit cannot or cannot reinforce, repair or rebuild on schedule, the Yellow River Affairs Department shall organize the reinforcement, repair and reconstruction, and the expenses required shall be borne by the construction unit.

Due to the operation and use of non-flood control engineering facilities, the workload of dike project management and related project protection responsibilities will be increased, and the construction unit or management and use unit will bear the corresponding expenses. Fourteenth projects approved for construction within the scope of dike project management must comply with the provisions on flood control safety, and the Yellow River Affairs Department has the right to supervise and inspect the construction. When the project is completed and accepted, it will be valid only after the Yellow River Affairs Department participates and signs it. During the operation of the project, accept the supervision of the Yellow River Affairs Department.

The management unit must reinforce, rebuild or dismantle the existing projects that do not meet the requirements of flood control safety within the scope of dike project management, and the expenses shall be borne by the management unit.
