Chongqing Urban Landscaping Compensation Regulations

Article 1: These regulations are formulated in accordance with the provisions of Article 34 of the "Chongqing Urban Landscaping Regulations". Article 2 Greening compensation standards for approved temporary occupation of urban garden green spaces (unit: yuan/day·square meter):

(1) Public green spaces, scenic woodlands, production green spaces, and residential areas Green space is calculated at 1 to 3 yuan;

(2) Protective green space and unit-affiliated green space are calculated at 0.5 to 1 yuan. If the temporary occupation of urban garden green space causes damage to plants and ancillary facilities, compensation shall be made in accordance with this provision. Article 3 Greening compensation standards for approved transplanted and felled trees (unit: yuan/tree):

(1) The trunk diameter at breast height is 10 cm, 50 yuan for transplantation and 200 yuan for felling; trunk diameter at breast height If the tree trunk diameter is less than 30 centimeters, the calculation base is based on the compensation standard of 10 centimeters in diameter at breast height. For every 1 centimeter reduction, transplantation will be reduced by 5 yuan, and felling will be reduced by 20 yuan; for every 1 centimeter increase, transplantation will be increased by 10 yuan, and felling will be increased by 40 yuan. .

(2) If the trunk diameter at breast height is 30 centimeters, the cost is 250 yuan for transplanting and 1,000 yuan for felling; if the trunk diameter at breast height exceeds 30 centimeters, the compensation standard for trunk diameter 30 centimeters at breast height will be used as the calculation base. For every additional 1 centimeter, transplantation will be charged. The increase is 40 yuan, and the increase is 100 yuan for felling.

(3) If the trunk diameter at breast height is 50 cm, the cost is 1,050 yuan for transplanting and 3,000 yuan for felling; if the trunk diameter at breast height exceeds 50 cm, the compensation standard for trunk diameter at breast height of 50 cm will be used as the calculation base. For every 1 cm increase, transplantation The increase is 80 yuan, and the increase is 300 yuan for felling.

(4) If it is an evergreen tree or deciduous tree on the street, it shall be calculated according to twice the standard specified in items (1), (2) and (3) of this article; if it is an evergreen tree on the street, it shall be calculated according to (1) of this article. (2) Three times the standard specified in item (3). The trunk diameter at breast height is measured 1.2 meters above the ground. Article 4 Greening compensation standards for approved transplanting and felling of shrubs (unit: yuan/nest):

(1) If the crown diameter is less than 50 cm, 20 yuan for transplantation and 50 yuan for felling; If the crown diameter exceeds 50 centimeters, the compensation standard for crown diameter of 50 centimeters will be used as the calculation base. For every additional 10 centimeters, an additional 20 yuan will be added for transplantation and an additional 50 yuan for felling.

(2) Flowers and shrubs shall be calculated at three to five times the standard specified in item (1) of this article, and precious flowers and shrubs shall be calculated at ten to fifteen times. Article 5 The greening compensation standard for approved bamboo transplantation and felling (unit: yuan/nest):

(1) For general bamboo, 10 yuan for transplantation and 30 yuan for felling; the nest diameter is larger than 20 centimeters, for every 10 centimeters added, an additional 20 yuan will be added for transplanting and an additional 50 yuan will be added for felling.

(2) For precious bamboos, the calculation shall be three to five times the standard specified in item (1) of this article. Each bamboo cut down costs 20 to 50 yuan. Article 6 The greening compensation standard for approved transplantation and eradication of artificial turf (unit: yuan/square meter): 10 to 15 yuan for transplantation and 30 to 40 yuan for eradication. Article 7 Due to national key construction, if it is really necessary to transplant famous trees, rare trees, large trees with a diameter at breast height of more than 100 centimeters, ancient trees over 100 years old, trees with historical value and commemorative significance, they must be reviewed by the municipal urban landscaping department. , report to the Municipal People's Government for approval, and pay greening compensation fees five to ten times the standard specified in Article 3 (1) (2) (3) of these regulations. Article 8 If damage is caused to trees, shrubs, bamboos, or lawns, compensation will be based on 20 to 50% of the greening compensation standard for transplanted plants; if death is caused, compensation will be based on the greening compensation standard for felled plants. Article 9: If damage is caused to ancillary facilities of urban landscaping, the amount of compensation shall be calculated based on the current cost. Article 10 The greening compensation fees for transplanting and felling plants listed in these regulations do not include the actual costs of labor, transportation, tool consumption, etc. Article 11: If it is difficult to ensure greening land for an old urban renewal project due to conditional restrictions, the construction unit must pay a centralized greening construction fee. Standards for centralized greening construction fees (unit: yuan/square meter):

(1) Yuzhong District is 3,000 to 5,000 yuan;

(2) Jiulongpo District, Shapingba District, Nan'an District, Jiangbei District, Dadukou District, Beibei District, Yubei District and Banan District are 2,000 to 4,000 yuan;

(3) Shuangqiao District, Wansheng District, Hechuan City, Jiangjin City, Yongchuan City, Wanxian Immigration Development Zone, Qianjiang Development Zone and Fuling District are 1,500 to 3,000 yuan; (4) Other cities and counties are 800 to 1,500 yuan.

Article 12 If the urban garden green space is occupied with approval due to special needs and the green space cannot be repaid at two to five times the occupied area, the urban garden green space construction fee must be paid according to the occupied area. Standards for urban garden green space construction fees (unit: yuan/square meter):

(1) Public green space 4,000 to 5,000 yuan;

(2) Scenic woodland, protection Green space, production green space, residential area green space, and unit-affiliated green space are 2,000 to 3,000 yuan. Financial compensation for ancillary facilities shall be calculated based on the current cost. Article 13: Each district, city and county government may make specific provisions within the range of the charging standards in Articles 11 and 12 of these regulations based on the actual conditions of the region. Article 14: 70% of the greening compensation fees and centralized greening construction fees collected within the urban area shall be retained by the district, and 30% shall be handed over to the municipal urban landscaping authority. The greening compensation fee collected from the green space affiliated to the unit shall be used for the environmental greening construction of the unit.
