Measures of Chongqing Municipality on Implementing the Law of People's Republic of China (PRC) on Soil and Water Conservation (revised on 20 16)

Chapter I General Provisions Article 1 In order to prevent and control soil erosion, protect and rationally utilize soil and water resources, mitigate floods and droughts, improve the ecological environment, promote the harmony between man and nature, and ensure the sustainable development of economy and society, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on Soil and Water Conservation and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to soil and water conservation activities within the administrative area of this Municipality.

The term "soil and water conservation" as mentioned in these Measures refers to the preventive and control measures for soil erosion caused by natural factors and human activities. Article 3 The work of soil and water conservation shall follow the principles of giving priority to prevention, protection, overall planning, comprehensive management, adjusting measures to local conditions, highlighting key points, scientific management and paying attention to benefits.

If the production and construction activities may cause soil erosion, the principle of whoever produces and builds shall be implemented, and whoever causes losses shall be treated. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen their leadership in soil and water conservation and set up soil and water conservation committees. The Water and Soil Conservation Committee is responsible for organizing and coordinating the work of water and soil conservation within its administrative area. Article 5 The people's governments of cities, districts and counties (autonomous counties) shall incorporate the work of soil and water conservation into the national economic and social development plan at the corresponding level, arrange special funds for the tasks determined in the soil and water conservation plan, and organize their implementation. Article 6 The people's governments of cities, districts and counties (autonomous counties) shall establish a target responsibility system for soil and water conservation and a system of assessment, rewards and punishments, and incorporate the work of soil and water conservation into the annual target assessment of relevant departments and people's governments at the next lower level. Seventh city, county (Autonomous County) water administrative department is responsible for the work of soil and water conservation within their respective administrative areas, and undertake the daily work of the soil and water conservation committee at the corresponding level.

City, county (Autonomous County) development and reform, finance, urban and rural construction, transportation, agriculture, land, environmental protection, planning, forestry, immigration and other relevant departments shall, according to their respective responsibilities, do a good job in soil and water conservation.

Township people's governments and sub-district offices shall specify the corresponding institutions to undertake the daily work of soil and water conservation within their respective jurisdictions. Article 8 The people's governments of cities, districts and counties (autonomous counties) shall organize publicity and education on water and soil conservation in a planned way, incorporate water and soil conservation education into the quality education of citizens and the training of civil servants, and popularize scientific knowledge and laws and regulations on water and soil conservation. Chapter II Planning Article 9 The municipal water administrative department shall organize a survey of soil erosion in the whole city every five years and publish the survey results. Tenth municipal water administrative departments shall, jointly with the relevant departments of the municipal government, divide the municipal key prevention areas and key control areas of soil erosion according to the survey results of soil erosion, and report them to the Municipal People's Government for approval and promulgation.

The water administrative departments of counties (autonomous counties) shall, jointly with the relevant departments at the same level, divide the key prevention areas and key control areas of soil erosion within their respective administrative areas according to the survey results of soil erosion and the delineation results of municipal key prevention areas and key control areas of soil erosion, and report them to the people's government at the same level for approval and publication. Eleventh the following areas should be designated as key prevention areas of soil erosion:

(1) Ecological barrier area of Three Gorges Reservoir, water and soil conservation planning area of important tributaries and other large and medium-sized reservoirs;

(2) Primary and secondary drinking water source protection areas, water source conservation areas and river source areas;

(three) the planning scope of nature reserves, scenic spots, geological parks and forest parks, and the protection scope of cultural relics protection units;

(four) the scope of management and protection of airports, ports and railways, and the construction control zone of highways above grade two;

(five) a steep slope of more than twenty-five degrees with a large contiguous area and good vegetation coverage;

(six) other ecologically fragile or sensitive areas with great potential risks of soil erosion, which have a significant impact on regional flood control safety, water resources safety, ecological safety or human production and life. Twelfth the following areas should be designated as key prevention and control areas of soil erosion:

(1) Danger areas of collapse and landslide and areas prone to debris flow;

(2) Drinking water sources with moderate soil erosion or areas with relatively concentrated population;

(3) Areas where sloping farmland is concentrated;

(four) barren hills, slopes, ditches, beaches and sparse young forest land with moderate soil erosion;

(5) The ecological barrier area of the Three Gorges Reservoir is moderately above soil erosion;

(six) the key areas of soil and water conservation of the important tributaries of the Three Gorges Reservoir;

(seven) other areas where soil erosion is serious and seriously restricts the local or downstream economic and social development.

The delineation of the dangerous areas of landslides and debris flows should be linked with the geological disaster-prone areas and key prevention and control areas determined by the geological disaster prevention and control plan. Thirteenth city, county (Autonomous County) water administrative departments shall, according to the delineation results of key prevention areas and key control areas of soil erosion at the same level, jointly with the relevant departments at the same level, formulate the overall planning of soil and water conservation in their respective administrative areas. After the approval of the people's government at the corresponding level, the overall plan for soil and water conservation shall be organized and implemented by the water administrative department. The overall planning of soil and water conservation approved by the people's governments of counties (autonomous counties) shall be reported to the municipal water administrative department for the record.

City, county (Autonomous County) people's government according to the needs of soil and water conservation work, decided to prepare a special plan for soil and water conservation. The special plan for soil and water conservation shall be compiled by the water administrative department in conjunction with the relevant departments at the same level and implemented after being submitted to the people's government at the same level or its authorized department for examination and approval.

The opinions of experts, the public and relevant units shall be widely solicited and fully demonstrated in the preparation of soil and water conservation planning.
