Legal basis: Extradition Law of People's Republic of China (PRC).

Article 1 This Law is formulated with a view to ensuring the normal extradition, strengthening international cooperation in punishing crimes, protecting the legitimate rights and interests of individuals and organizations, and safeguarding national interests and social order.

Article 2 Extradition between People's Republic of China (PRC) and foreign countries shall be conducted in accordance with this Law.

Article 3 People's Republic of China (PRC) and foreign countries shall cooperate in extradition on the basis of equality and reciprocity. Extradition cooperation shall not harm the sovereignty, security and social interests of People's Republic of China (PRC).

Article 4 Extradition between People's Republic of China (PRC) and foreign countries shall be conducted through diplomatic channels. The Ministry of Foreign Affairs of People's Republic of China (PRC) is the designated liaison organ for extradition. Where the extradition treaty has special provisions on the contact organs, such provisions shall prevail.

Article 5 In handling extradition cases, compulsory measures such as detention, arrest or residential surveillance may be taken against the person sought according to the circumstances.
