Applicants from China must get married within 90 days after entering the United States with a K/KLOC-0 visa, otherwise they must leave the United States before the 90th day, or they will live illegally. K 1 visas cannot be transferred to other types of visas, such as student visas and work visas. If you don't marry an American citizen who applied for a K/KLOC-0 visa within 90 days, you can't change your identity even if you marry another American citizen. You must go back to China and start applying for CR 1 again.
K 1 After marriage, American citizens can transfer their identity for China applicants and their children, and they can get a conditional green card for two years in about one year. Within 90 days before the two-year conditional green card expires, American citizens must apply to cancel the conditional green card and apply for a ten-year green card. After approval, they can get a green card for ten years.
American citizens must apply for a green card for China applicants within one year after entering China. If it exceeds one year, their marriage will be invalid and they must return to China.
If China applicants have children, they can fill in the information of their children in the application form of K 1, that is to say, they have applied for a K2 visa for their children, that is, K 1 has its own K2. If children are not filled in, it means that children will not be applied.
K2 must be unmarried under 2 1 year old, and must be under 2 1 year old before entering the country. After entering the country, children can change their identity and get a green card (confirmed) even if they are over 2 1 year old.
If the child is an American citizen and your own child, the child can automatically become an American citizen if the American fiance has lived in the United States for five years. The American fiance can directly apply for an American passport for the child and go to the United States directly with you. Otherwise, if the child is not an American citizen, you need to fill in the child in the application form of K 1, indicating that you are applying for K2.
K 1 Interview with K2. K2 can also apply for an interview within one year after K 1 entered the United States, and K 1 entered the United States within one year.
K 1/K2 visa application conditions:
1. Conditions for the fiance (wife) of an American citizen to apply for a K 1 visa:
1) The fiancé (wife) of China applicants must be American citizens, and green card residents cannot apply for a K 1 visa for China fiancé (wife);
2) Both parties must have met in the last two years, and this restriction can be waived unless it can be proved that their religion comes from a culture that prohibits couples from meeting before marriage, or that meeting will cause extreme hardship to either party.
3) Both parties must be legally able to get married. If you are in the process of divorce or annulment of marriage, or if you have not reached the legal age of marriage in the state where American citizens live, you will not be eligible to apply. China applicants may not reach the legal age for marriage in China, but they can get married at the age of 0/8 in the United States. /kloc-U.S. citizens and China citizens aged 0/8 can apply for a K 1 visa.
4) American citizens are willing to provide financial guarantee for China applicants, and assure the American government that they will bear the living burden of China applicants in the United States, and will not increase the burden on the American government. (There are already American citizens who are unwilling to make financial guarantees during the application process, and the application for K 1 is suspended. )
5) Visa K 1 must be applied to the processing centers of immigration offices all over the United States where American citizens live.
2. Conditions for minor children of China applicants to apply for K2 visa:
1) China applicant 2 1 biological unmarried children under one year old.
2) For the adopted children of China applicants, the adoption relationship must be established before the adopted children are 16 years old, China applicants have lived with the adopted children for more than two years and have legal custody, and the adopted children must be unmarried under 2 1 year old.
