In international justice, the situation that a person has two or more nationalities at the same time is called active nationality conflict; A person who has no nationality is called a negative conflict of nationality. If it is necessary to apply the domestic law of the parties in a certain legal relationship, then in the case of active conflict, it is necessary to determine which nationality of the parties shall prevail; In the case of passive conflict, because the parties have no nationality, it is necessary to determine what law should be applied.
The conflict between positive and negative nationality occurs because different countries have different regulations on the acquisition, loss and restoration of nationality.
