Operating rules for returning the remains (ashes) of single deceased veterans to mainland families

1. 1. In order to meet the actual needs, make the deceased and the glorious return to their original places and achieve the purpose of peace and comfort, these operating procedures are specially formulated.

2. Second, the families of single deceased veterans in Chinese mainland come to Taiwan or invite relatives and friends and fellow villagers in Taiwan to apply for the change of the remains (ashes) to their native places. From now on, they will be authorized to belong to various rehabilitation institutions to accept applications and issue them.

3. To apply for remains (ashes), the following documents shall be submitted to the rehabilitation unit:

(1) application (report).

(2) Power of Attorney (verified by SEF).

(3) After checking other auxiliary materials, cutting and collating are allowed.

Documents (data) should be filed for future reference. And guide or assist in the exit formalities.

4. Letter of guarantee (in the following format) required for applying for remains (ashes); If the relatives of the mainland collect it in person, they will receive it with a receipt (format is as shown in a separate sheet 2).

5. Where the remains (ashes) are buried in the military cemetery, the rehabilitation unit may issue a certificate and apply for it with the certificate.

6. To go through the formalities of leaving the country for ashes, the applicant should prepare the death certificate, cremation certificate, storage certificate and a copy of the household registration book (one of which has been selected) issued by the temple, and consult the international port customs unit or the international shipping company before leaving the country.

7. All application and exit fees shall be borne by the applicant.

Conditions: Active servicemen or veterans who died in Taiwan Province have no relatives. You must find a guarantor in Taiwan Province to claim it from the retreat.

Procedures for applying for inheritance:

(1) The trustee (that is, the agent) in Taiwan applies to the relevant unit for the "death certificate" of the deceased Rongmin, and sends it to the heir in Chinese mainland together with a copy of his personal ID card. On this basis, he applied to the provincial, municipal (county, city) notary office for "proof of kinship" and "certificate of entrustment".

(2) Then, the trustee takes the originals of the Notary Certificate of Kinship and the Notary Certificate of Entrustment sent by the mainland to SEF (Address: 3rd section of Minsheng East Road, Taipei156th floor; Address of Southern District Service Office: 4th Floor, No.436 Chenggong 1st Road, Qianjin District, Kaohsiung City; Address of the center service office: No.95, Gancheng Street, Nantun District, Taichung City 1 Building), and obtained certificates respectively.

(3) Check and apply for a copy of the Household Registration Certificate at the domicile (township, city, district) of the deceased with the Proof of Kinship, Certificate of Entrustment and SEF.

(4) Re-submit the above notarial certificate, SEF certificate, a copy of the cancellation account and a completed Family Inheritance System Form, and submit a request for inheritance to the local court where the deceased Rongmin lived (all heirs are claimants and trustees are agents, and the request is filed within three years from the date of death, and if it is overdue, it will be deemed as abandonment of inheritance), and the court ruled that inheritance is allowed for future reference.

(5) After all the above steps are completed, submit all the documents and apply for inheritance to the "legal estate manager" of the deceased (Veterans Service Bureau or Honorary National Home of the deceased's domicile).

(6) After the estate management agency has substantially examined and confirmed all the inheritance documents according to the relevant laws and regulations, the estate management agency will notify the agent (and find a guarantor) to cut and collect after the expiration of the "publicity period" (more than one year ruled by the court) and the "repayment of creditor's rights" (three years).

Article 73- 1 of the Land Law stipulates that the owner of the real estate has died for more than 1 year, and has not registered the transfer of ownership. After being checked by the land management authority, it will be announced in the township (district) office where the decedent's household registration is located and the office where the real estate is located for three months on April 1 day every year, and at the same time, the successor will be notified to handle the ownership transfer registration as soon as possible. If the registration of ownership transfer has not been handled at the expiration of the announcement period, the land management authority shall make a list and manage it for 15 years. If it is not handled within the time limit, it will be handed over to the state-owned real estate bureau for public auction, and the proceeds from the auction will be kept in a special account 10 year. If it is not recovered within the time limit, it will be nationalized.

Measures for the administration of death of servicemen without inheritance

Article 8 Chinese mainland people shall, within three years from the date of succession, express their succession in writing to the court of the decedent's domicile. However, if the inheritance has been handled by the estate manager before the implementation of these regulations, the inheritance period is four years.
