Regulations on the management of reservoir engineering in Baoting Li and Miao Autonomous County

Article 1 In order to strengthen the management, protection and rational development and utilization of small and medium-sized reservoir projects in Baoting Li and Miao Autonomous County (hereinafter referred to as the Autonomous County), ensure the safety of people's lives and property, and promote the economic development of the Autonomous County, these Regulations are formulated in accordance with the provisions of relevant national and provincial laws and regulations and in combination with the actual situation of the Autonomous County. Article 2 The reservoir project mentioned in these Regulations refers to the main dam, auxiliary dam, reservoir area (backwater area), dam back or main channel power station, spillway, drainage culvert and other buildings in this Autonomous County, as well as the land within the designated management and protection scope, as well as ancillary roads, communication, monitoring and other facilities. Article 3 The Autonomous County People's Government shall strengthen its leadership in the management of reservoir projects, adhere to the principle of "overall planning, overall consideration, protection and management, and comprehensive utilization", and strengthen the construction of reservoir projects in accordance with the principle of unity of ecological benefits, social benefits and economic benefits.

Autonomous County People's Government may set up a special fund for water conservancy construction according to the relevant provisions of the state and the province, take effective measures to raise funds for reservoir construction according to law, and invest in the construction of reservoir projects and facilities. Fourth Autonomous County encourages and supports domestic and foreign investors to invest in the construction of reservoir projects in the form of joint venture, cooperation and sole proprietorship, and investors enjoy the preferential treatment of Hainan Special Economic Zone and this Autonomous County to encourage investment in infrastructure construction.

The principle of who invests, who manages and who benefits shall be implemented in the construction of reservoir projects. Fifth Autonomous County implements the system of farmland water conservancy labor accumulation.

Autonomous County and Township People's governments shall arrange a certain number of labor accumulation workers every year for the maintenance and protection of reservoir projects and facilities. The water management department of the Autonomous County shall, on the entrustment of the Autonomous County People's Government, implement unified management of the reservoir projects within the administrative area of this Autonomous County.

Other relevant departments shall, in accordance with the division of responsibilities stipulated by the Autonomous County People's Government, cooperate with the water management department to be responsible for the management of reservoir projects.

Township people's governments are responsible for the management of small reservoir projects within their respective jurisdictions. Eighth Autonomous County Water Management Department shall exercise the following management responsibilities for reservoir projects:

(a) to publicize and implement the laws and regulations on the management of reservoir projects;

(two) in conjunction with the relevant departments to develop reservoir engineering construction planning, submitted to the Autonomous County People's government for approval;

(three) to review and supervise the investment and construction of reservoir projects;

(four) to coordinate, guide and supervise the protection, management, development and utilization of reservoir projects in Autonomous County, and to handle water disputes;

(five) to assist in flood control and drought relief, and to dispatch water for reservoir projects;

(six) to exercise the right of administrative punishment for acts that endanger the safety and efficiency of reservoir projects. Ninth reservoir construction, according to the following authority for examination and approval:

(a) the construction of medium-sized and above reservoir projects shall be submitted for approval in accordance with the relevant provisions of Hainan Province;

(two) the construction of small reservoirs shall be audited by the water management department of the autonomous county and reported to the people's government of the autonomous county for approval. Twelfth autonomous county water management department according to the needs of reservoir engineering management and safety, combined with natural and geographical conditions, in accordance with the following standards to delineate the scope of management and protection of reservoir engineering, reported to the Autonomous County People's government for approval:

(a) the reservoir project management scope is within the design flood level line or land requisition line;

(two) the scope of protection of the reservoir project is to check that the water level line extends from 50 meters to 500 meters.

The management scope and protection scope of the approved reservoir project shall be delineated by the water management department in conjunction with relevant departments, and signs shall be set up. Thirteenth reservoir projects shall be managed in accordance with the following provisions:

(a) the national investment in the construction of medium-sized reservoir projects, the water management department of the autonomous county set up a reservoir project management unit;

(two) the national investment in the construction of small reservoir projects, the Township People's government set up a reservoir project management unit;

(three) the rural collective economic organizations to invest in the construction of reservoir projects, the collective economic organizations to set up a reservoir project management unit or designate a person to manage;

(four) other investors at home and abroad to invest in the construction of reservoir projects, investors should independently set up reservoir project management institutions or equipped with specialized personnel. Fourteenth reservoir project management unit is responsible for:

(a) in strict accordance with the requirements of reservoir engineering management norms and operating procedures, responsible for engineering inspection, observation and data collation;

(two) maintenance of reservoir engineering and ancillary facilities and equipment, to ensure the engineering equipment in good condition, to ensure the normal operation of engineering facilities;

(three) timely report to the water management department on the rain, water and engineering safety, and implement the dispatching plan and flood control orders;

(four) the implementation of planned water use, advocate water conservation, and collect water charges according to law;

(five) to carry out diversified operations to improve the comprehensive benefits of the project;

(six) to strengthen the professional skills training of employees and assist the local people's government to organize the masses to maintain and protect the reservoir project;

(seven) to stop the destruction of reservoir engineering facilities and endanger the safety of reservoir engineering.
