The telecom fraud case has never been solved. How will the police close it?

The telecom fraud case will not be closed until it is solved. First of all, we must file a case, and the police will investigate according to relevant clues. Because most telecom fraud cases use foreign servers, it is very difficult to solve the case, so it will not be closed until the case is solved.

There are only two ways to close a criminal case:

1, the court made a judgment.

2. The public security withdraws the lawsuit or the procuratorate does not prosecute.

If the suspect does not file a case, the court cannot make a judgment.

If the police think that the facts are clear and the evidence is sufficient, they will not drop the charges even if they can't catch the person, but pursue them online. If they can't catch it, they will keep chasing until they catch it.

It is determined that the amount of fraud is large;

Those who reach the above amount and have the following circumstances shall be given a heavier punishment as appropriate:

(1) Sending short messages, making phone calls or publishing false information through the Internet, radio and television, newspapers and magazines, etc., defrauding an unspecified majority;

(2) defrauding disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and medical funds and materials;

(three) fraud in the name of disaster relief fund-raising;

(four) defrauding the disabled, the elderly or the disabled;

(5) Causing the victim to commit suicide, mental disorder or other serious consequences.

Article 266

Whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also, or shall only, be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined. If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated. Where there are other provisions in this Law, such provisions shall prevail.

When a public security organ or a people's procuratorate discovers a criminal fact or a criminal suspect, it shall file a case for investigation within its jurisdiction. There is no time limit for investigation after fraud is filed.
