Provisions of China on Safety Supervision and Management of Small Ships Navigation in Hong Kong and Macao (revised in 1996)

Article 1 These Provisions are formulated in accordance with the Maritime Traffic Safety Law of People's Republic of China (PRC) and the Regulation of People's Republic of China (PRC) on Inland River Traffic Safety in order to strengthen the supervision and management of China small ships sailing in Hongkong and Macao (hereinafter referred to as ships) and ensure the safety of ships, passengers, crew and cargo. Article 2 These Provisions shall apply to the following China ships sailing in Hongkong and Macao:

(1) Motor vessels with a gross tonnage of less than 500 tons;

(2) All kinds of non-motorized transport vessels. Article 3 Vessels engaged in transportation from the mainland to Hong Kong and Macao must be approved by the Ministry of Communications or the communications departments of provinces and autonomous regions authorized by the Ministry of Communications. Article 4 The navigation and berthing of ships must comply with the provisions of the state on water traffic safety and environmental protection. During your stay in Hong Kong and Macao, you should also abide by the relevant laws of Hong Kong and Macao. Article 5 The technical requirements for ships sailing in Hong Kong and Macao must meet the relevant specifications of People's Republic of China (PRC) and the State Bureau of Shipping Inspection, and they must hold valid ship certificates that meet the requirements of People's Republic of China (PRC) and the State Bureau of Shipping Inspection. Article 6 Seagoing ships sailing in Hong Kong and Macao and inland river ships with a gross tonnage of over 300 tons shall be equipped with radio stations. Article 7 Motorized boats with a gross tonnage of more than 50 tons sailing in Hongkong and Macao shall hold the People's Republic of China (PRC) Nationality Certificate in both Chinese and English, and non-motorized boats and motorized boats with a gross tonnage of less than 50 tons shall hold the People's Republic of China (PRC) Ship License.

The ship must hang National Flag of the People's Republic of China. Article 8 The owner and operator of a ship shall equip each ship with qualified crew sufficient to ensure the safety of the ship.

The captain, chief engineer, pilot (chief pilot and co-pilot), engineer (chief pilot and co-pilot), radio operator and electrical engineer must pass the examination organized by the harbour superintendency administration (including the harbour superintendency administration, the same below) authorized by the Ministry of Communications, and hold the certificates of competency issued by the authority that are suitable for the types, grades and positions of the ships they serve.

All crew members shall hold a crew service book issued by the harbour superintendency administration. Article 9 Crew members who hold certificates of competency for Class B seagoing vessels, those who hold certificates of competency for Class C seagoing vessels issued by Guangdong, Guangxi, Fujian and Hainan harbour superintendencies, and those who hold certificates of competency for inland river vessels in the Pearl River system must pass the supplementary examination of the Rules of Hong Kong and Macao Ports of the original issuing authority, and the issuing authority shall annotate the certificates with "Hong Kong and Macao routes" before they can take up their posts on board.

The crew members who hold the certificate of competency for the crew of inland river vessels mentioned in the preceding paragraph shall also take the necessary supplementary examination of maritime navigation knowledge.

Crew members of seagoing ships must complete professional trainings such as "Ship Fire Fighting", "Lifeboat and Raft Manipulation", "Survival at Sea" and "First Aid at Sea", and hold the "Professional Training Certificate for Seafarers in China" issued by the harbour superintendency administration. Article 10 Ships shall be equipped with the Record Book of Ship Safety Inspection or the Record Book of Inland River Ship Safety Inspection issued by the harbour superintendency administration, and shall be subject to the safety inspection by the harbour superintendency administration. Article 11 After the estimated import and export time of a ship is determined, it shall report to the harbour superintendency administration in advance, and the harbour superintendency administration shall notify all inspection units to carry out the inspection. Article 12 Mainland ships sailing in Hong Kong and Macao shall be inspected at the nearest Class I or Class II open ports where all ships can leave the country, and the harbour superintendency agencies established or authorized by the state shall issue the Exit Permit for China International Sailing Ships or the Regular Exit Permit for China International Sailing Ships. Thirteenth ships sailing from Hong Kong and Macao to the mainland shall be inspected at the nearest first-class open port or second-class open port where all ships can be inspected. The harbour superintendency agencies established or authorized by the state shall be responsible for the inspection. Fourteenth ships that have obtained the "Export License for People's Republic of China (PRC) International Sailing Ships" shall still be issued by the harbour superintendency administration in the ship navigation visa book; For ships imported from Hong Kong and Macao, the export licenses issued by Hong Kong and Macao shall be withdrawn and import visas shall be obtained when going through the import formalities. Article 15 After a ship has a maritime traffic accident or pollution accident in Hong Kong waters, it should take all possible measures locally to prevent the loss from expanding, accept the investigation of relevant Hong Kong institutions, and report to the harbour superintendency administration of the port of registry in time after import. Article 16 The harbour superintendency administration may, according to the seriousness of the case, impose the following penalties on vessels and individuals who violate these provisions:

(1) warning;

(two) to detain or revoke the certificate of competency;

(3) a fine.

If a fine is imposed, the amount of the fine for the unit shall not exceed 3,000 yuan, and the amount of the fine for the individual shall not exceed 500 yuan. Seventeenth in violation of these provisions, if the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law. Article 18 Fishing vessels sailing in Hong Kong and Macao shall go through import and export procedures in accordance with the requirements of these Provisions, in addition to complying with the relevant provisions of the fishery authorities. Nineteenth these Provisions shall be interpreted by the Ministry of Communications of People's Republic of China (PRC). Twentieth the provisions shall come into force as of June 1996+0. The Interim Provisions on Safety Supervision of Small Ships Sailing in People's Republic of China (PRC), Hong Kong and Macao issued by the Ministry of Communications 1982 shall be abolished at the same time.
