Article 1 In order to strengthen the management of water conservancy projects, give full play to the comprehensive benefits of the projects, ensure the safety of people's lives and property, and promote comprehensive, coordinated and sustainable economic and social development, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the management of water conservancy projects and ancillary facilities such as rivers, irrigation areas, reservoirs, flood storage and detention areas, channels, dams, water supply stations, water transmission and drainage pipelines, culverts, sluice bridges, pumping stations, hydropower stations, wells, ponds, water tanks and water cellars under the jurisdiction of this Municipality. Article 3 The water administrative department of the Municipal People's Government shall be responsible for the unified management of water conservancy projects in the whole city.

The water administrative department of the county (city) and District People's governments shall be responsible for the management of water conservancy projects under their jurisdiction.

City and county (city), the water administrative department of the District People's government is responsible for the specific management and maintenance of water conservancy projects.

Township (town), village and other water conservancy project management units and individuals are responsible for the specific management and maintenance of their water conservancy projects.

Cross-administrative water conservancy projects are managed by the water administrative department of the people's government at the next higher level, and can be designated or entrusted to the relevant units for specific management when necessary.

The relevant departments of the municipal, county (city) and district people's governments shall be responsible for the specific management and maintenance of their water supply, drainage and flood control projects in accordance with the division of responsibilities. Fourth bridges with the function of water conservancy infrastructure shall be managed and maintained by the water administrative department.

Highway bridges across channels at or above the county level shall be managed and maintained by the traffic administrative department.

Bridges across rivers and canals on rural roads shall be managed and maintained by local township (town) people's governments and villagers' committees. Article 5 All acts endangering the safety of water conservancy projects, damaging the facilities of water conservancy projects, and disturbing and disturbing the management order of water conservancy projects are prohibited.

All units and individuals have the obligation to protect the safety of water conservancy facilities, and have the right to stop, report and accuse acts of destroying water conservancy facilities.

Units and individuals that have made outstanding contributions in the management of water conservancy projects shall be commended and rewarded by the people's government and relevant departments. Sixth people's governments at all levels should increase investment in water conservancy projects year by year. The daily maintenance funds of public welfare water conservancy projects are paid by governments at all levels respectively, and the renovation costs of the projects are included in the capital construction investment plan.

Encourage domestic and foreign organizations and individuals to build water conservancy projects in the form of sole proprietorship, joint venture and joint-stock cooperation. Seventh people's governments at or above the county level shall, according to the needs of management and safety, combined with natural and geographical conditions, in accordance with the following standards, organize relevant departments to delimit the management scope and safety protection scope of various water conservancy projects managed by the state:

(1) The management scope of dikes in river courses and flood storage and detention areas starts from the toe of the dike, ranging from 5m to 20m inside the dike and from10m to 30m outside the dike; The safety protection range is from 50m to100m beyond the management scope.

The management scope of dike river course includes waters, sandbanks, beaches (including cultivated land), flood discharge areas, dikes on both sides of the strait and the management scope of dikes; The management scope of the river without dike is determined according to the historical highest flood level or design flood level.

(two) the management scope of the reservoir area is the normal water level or the area below the resettlement line or land acquisition line around the reservoir; The safety protection scope is that the check flood level line extends upward along the hillside for 20m to 100m.

The dam management scope is 30 meters to 300 meters outside the toe of the downstream dam, and the left and right banks are 30 meters to 300 meters outside the excavation line; The safety protection range is100m to 300m outside the management scope.

The management scope of both sides of the discharge building and other buildings is 20 meters to 50 meters outside the outer line of the building; The safety protection range is100m to 200m beyond the management scope.

(3) The scope of river management with dikes includes waters, ditches, dikes and channel protection areas between dikes on both sides of the strait; The management scope of non-dike rivers includes waters, canal edges and canal protection land.

The scope of channel protection means that the channel has been defined and determined according to the original management scope and protection scope; If the river course is not delineated, it shall be counted from the foot of the outer dike if there is a dike, and from the upper edge of the river course if there is no dike, the main canal is 2m to 5m, and the branch canal 1 m to 2m.

The scope of channel management with traffic demand can be appropriately relaxed.

The scope of safety protection is 20 meters to 50 meters outside the management scope.

(four) the management scope of the water tunnel is 10 meters to 30 meters outside the outer line of the import and export buildings and shafts; The safety protection scope is 50m to100m outside the management scope, on both sides of the roof.

(5) The management scope of culverts, irrigation and drainage stations and hydropower stations is10m to 30m outside the building edge; The safety protection range is from 50m to100m beyond the management scope. Article 8 For water conservancy projects managed by the state, the land within the management scope and the attachments on the land belong to the state, and the right to use belongs to the project management unit; Collectively owned land is subject to the unified management of water conservancy project management units; The ownership of the land within the scope of safety protection remains unchanged, and the use shall not endanger the safety of water conservancy projects. Article 9 Small water conservancy projects such as ponds, ponds, irrigation and drainage stations, channels and wells approved by the water administrative department of the people's government at or above the county level shall be demarcated by the township (town) people's government where the project is located according to actual needs and reported to the water administrative department of the county (city) or district people's government for the record. No unit or individual may arbitrarily occupy or destroy it.
