How to measure "special talents" when immigrating to the United States

1. Has the applicant won one or more internationally recognized major awards?

Using the first criterion to measure "special talents", the applicant only needs to prove that he/she has won more than one major internationally renowned award, and only this internationally renowned award can he/she meet the standards of special talents and can easily immigrate to the United States without providing other evidence. Generally speaking, Nobel Prize, Oscar Prize, Olympic medal or trophy, or major international inventions and creations can all be accepted as major internationally renowned awards.

However, not only those who have won major internationally renowned awards such as the Nobel Prize or the Olympic Prize are regarded as special talents. The immigration law provides another relatively loose measure, that is, applicants can apply for immigration with special talents as long as they meet any three of the ten standards stipulated in the immigration law. A large number of successful cases of special talents I have declared for my clients are based on this standard and have been successful.

2. Does the applicant meet any three of the ten criteria stipulated in the Immigration Law (at least the following three):

1) "National or international awards". He has won a few national awards (not necessarily from the United States) or internationally recognized awards in his own field, proving that he has made outstanding achievements in this field;

2) Members of professional associations. Only those who have made outstanding achievements can join this professional association by national or international experts in this field;

3) Reports about the applicant and his related work have been published in professional journals and major commercial publications, or in major media, or the applicant and his achievements in professional fields have been reported in important media (published articles must include title, date, author and translation if necessary);

4) In his professional field, he has evaluated the works of others in his professional field or other related fields as an individual or a member of a committee;

5) He has made original and original contributions to academic research or art in his field;

6) Professional works, such as academic papers, books and academic articles. , published in domestic and foreign journals or other important media in their professional fields;

7) Holding exhibitions of works or other exhibition activities at art exhibitions or other places with high reputation or great influence;

(eight) as the main leader or other important positions in the working institutions, important professional organizations and groups;

9) In related fields, the salary, remuneration or treatment of the candidate is much higher than that of other peers;

10) has achieved commercial success in performance and art, which is manifested in box office revenue, film, tape, video and DVD sales.

If the above 10 standard is not applicable to the client's occupation, the applicant can submit "similar evidence" to prove the client's achievements. In addition, foreigners also need to prove two other conditions stipulated in the immigration law, that is, the applicant will continue to work in his field in the United States after obtaining the green card for special talents; In addition, its work will bring practical benefits to the United States.

All immigrants with special talents do not need to apply for a work permit, nor do they need employer support and permanent work. Therefore, as long as they meet the standards of special talents, applicants can submit their own immigration applications without the support of their employers. Even if the applicant is in the United States, China or other countries, he only needs to prove that he will continue to work in related fields after entering the United States, so he can submit an application for immigration of special talents. At the same time, while waiting for the approval of special talents, applicants can submit other types of immigration applications; For example: NIW national interest exemption.
