Whoever misappropriates public funds for personal use to carry out illegal activities, with an amount of more than 30,000 yuan, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; If the amount is more than 3 million yuan, it is a huge amount, and if it is not returned, it will be sentenced to fixed-term imprisonment of more than 10 or life imprisonment.

Under any of the following circumstances, if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years: misappropriating public funds of not less than one million yuan; Misappropriation of disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and other specific funds and materials, the amount of which is more than 500,000 yuan but less than10 million yuan; Misappropriation of public funds will not be returned, and the amount is more than 500,000 yuan and less than10 million yuan.

2. Whoever misappropriates public funds for personal use and conducts profit-making activities for more than three months without paying them back, and the amount is more than 50,000 yuan, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; If the amount is more than 5 million yuan, it will be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment.

In any of the following circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years: misappropriating public funds of not less than two million yuan; Misappropriation of disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and other specific funds and materials, the amount of which is more than one million yuan but less than two million yuan; Misappropriation of public funds will not be returned, and the amount is more than one million yuan but less than two million yuan.
