Is it easy to get a work visa in America?

Work visas in the United States are not easy to handle.

You don't need to provide TOEFL and IELTS scores to apply for an American HIB visa, but there are places every year. According to the current law, the annual quota of foreigners before the fiscal year 2003 was 65,438+095,000. After "9 1 1", the annual visa quota was reduced to 65,000 in order to prevent terrorists from entering the country. Among the 65,000 quotas in fiscal year 2007, except for 7,000 quotas in Chile and Singapore, other countries can only apply for 58,000 quotas. Therefore, the annual quota application for H 1B is very tight. Only in April and May, Indians occupy most of the quotas because of their language and technical advantages.

Applying for an H 1B visa requires a guarantee from an American employer. Employers must file an application form for labor status (LCA) with the US Department of Labor, and guarantee to pay salaries and provide working conditions according to prevailing salary standards. At the same time, the employer should also submit the I- 129 form to the US Immigration Service (BCIS) and pay the corresponding attorney fees and application fees.

According to the current law, foreigners can hold an H 1B visa for up to six years. In most cases, the first application is usually three years, and then extended for another three years.

American employers need to apply to the Immigration Bureau for "hiring foreign employees". The materials needed in this process are divided into two parts:

One: American employers

1. non-immigrant employee application form I-129/I-129 w;

2. Class H supplementary form;

3. Company profile: the industries employed by American employers, the date of establishment of the company, the number of employees, the number of federal tax returns, the total business volume in the past year, etc.

4. Employment contract: the employment contract signed by the employing unit and the applicant, including the nature of work, job responsibilities, working hours, salary and treatment, and the validity period of the contract;

5. Professional work certificate: it proves that the work provided by the employer belongs to professional work, and the work must be held by people with professional level;

6. Proof of labor payment ability: prove that the employer has the ability to pay wages, such as tax returns, bank statements, financial accounting statements, etc.

Two: the applicant

1. bareheaded photo;

2. Resume;

3. Personal profile;

4. Work experience certificate: it should include the company name, address, date, position, work nature and previous work experience;

5. Education certificate: it should include the names, graduation dates, degree certificates and graduation certificates of different schools from primary school to university;

6 articles, reports, certificates of honor and reward, professional licenses and professional level certificates about personal professional achievements.

If the application is successful, the applicant will get the approval notice I-797 from the Immigration Bureau, and then he can apply for a visa to the United States.

Note: If the applicant is educated outside the United States, the Immigration Bureau usually requires his academic credentials and working documents, which need to be evaluated by American evaluation agencies or American universities.
