Article 1. In order to strengthen the management of small reservoirs, give full play to the functions and benefits of small reservoirs, and ensure the safety of people's lives and property, in accordance with the "Water Law of the People's Republic of China" and "Reservoir and Dam Safety Management" "Regulations" and other laws and regulations, and based on the actual situation of the province, these measures are formulated. Article 2 Those engaged in activities such as small reservoir construction, operation and management, flood control safety, project maintenance, development and operation, and supervision and management within the administrative region of this province shall abide by these Measures.

Small reservoirs as mentioned in these Measures refer to reservoirs with a total storage capacity of more than 100,000 cubic meters and less than 10 million cubic meters, which are divided into small (1) type reservoirs and small (2) type reservoirs. Those with a total storage capacity of more than 1 million cubic meters and less than 10 million cubic meters are classified as small (1) type reservoirs; those with a total storage capacity of more than 100,000 cubic meters but less than 1 million cubic meters are classified as small (2) type reservoirs. Article 3 People's governments at all levels shall include small reservoirs in the scope of public welfare undertakings, coordinate and resolve major issues such as small reservoir management systems and funding guarantees, and establish and improve small reservoir safety management systems. Article 4 The water administrative departments of the people's governments at or above the county level are responsible for the supervision and management of small reservoirs within their respective administrative regions.

Departments of finance, development and reform, land and resources, oceans and fisheries, environmental protection, forestry and other departments should do a good job in the supervision and management of small reservoirs in accordance with the division of responsibilities. Article 5: The safety management of small reservoirs shall be subject to the administrative head responsibility system. The people's governments of cities, counties (cities, districts) and towns divided into districts shall, in accordance with the principles of territorial management and affiliation, identify a leading member of the government as the person responsible for safety for each small reservoir.

According to the principle of "whoever manages, who is responsible", the safety of small reservoirs is directly responsible for the reservoir management unit; if there is no reservoir management unit, its safety shall be the responsibility of the township people's government or the rural collective economy that exercises management power. Organizations, businesses (individuals) are directly responsible.

The township people's government where a small reservoir is located shall sign a safety management responsibility letter with the rural collective economic organization and enterprise (individual) that manages the reservoir. Article 6 The construction, reconstruction or expansion of small reservoirs shall be submitted for approval in accordance with the laws and regulations on water resources management and flood control:

(1) Newly built small (1) type reservoirs or small (2) type reservoirs If a large reservoir is expanded into a small (1) type reservoir, it must be reported to the water administrative department of the districted municipal people's government for approval; (2) If a small (2) type reservoir is newly built, it must be reported to the county (city, district) ) Approval from the water administrative department of the People's Government;

(3) If a small reservoir is rebuilt, it must be reported to the original approval authority for approval.

If a small reservoir meets the conditions for downgraded operation or scrapping, it must complete the approval procedures in accordance with relevant national regulations and handle the aftermath. Article 7 To build, reconstruct or expand small reservoirs, approval, verification or filing procedures must be carried out in accordance with the provisions of capital construction procedures; if construction land is involved, land approval procedures must also be handled in accordance with the law; if resettlement is required, it shall be based on the county, village and town system planning. Guide farmers to relocate to small towns or new rural communities. Article 8 If the survey, design, construction and supervision of small reservoir projects meet the bidding conditions, the unit with corresponding qualifications shall be determined through bidding in accordance with the law and shall accept the supervision of the water administrative department. Article 9 A small reservoir should have the necessary transportation conditions to reach the main buildings of its hub, and be equipped with necessary engineering and hydrological observation facilities, management rooms and communication and power facilities to ensure the normal development of management work. Article 10 After completion of a small reservoir project, completion acceptance shall be carried out in accordance with relevant national and provincial regulations. If it has not been inspected or failed to pass the acceptance inspection, it shall not be put into use.

Within 3 months after the small reservoir project passes the acceptance inspection, it shall apply for registration to the water administrative department of the local county (city, district) people's government in accordance with regulations. Article 11 The people's government at or above the county level where a small reservoir is located shall delineate the management and protection scope of small reservoirs in accordance with the following standards:

The management scope includes the dam and its ancillary buildings, management buildings and other Facilities; design the reservoir area below the Xingli water level; the area extending 30 meters to 50 meters outside the foot of the dam slope; the area extending 30 meters to 100 meters outside the end of the dam; the edges of various buildings such as water diversion and water discharge are outward Area extending from 10 meters to 50 meters.

The protection scope is the reservoir area between the reservoir's design water level and the calibrated flood level; the area where the dam management scope extends outwards from 70 to 100 meters; water diversion, water release, etc. The area 250 meters outside the building management area. Article 12 When constructing engineering projects within the management scope of small reservoirs, the construction plan shall be reviewed and approved by the water administrative department with jurisdiction, and shall be subject to the supervision of the water administrative department during the construction process; if expansion, reconstruction or demolition is required . If the original small reservoir engineering facilities are damaged, the construction unit shall bear the expansion and reconstruction costs or loss compensation costs.

Article 13 No unit or individual may engage in the following activities that endanger the safe operation of small reservoirs:

(1) Set up sewage outlets within the management scope of small reservoirs, dump, stack, or discharge toxic and harmful substances and garbage, Dregs and other wastes;

(2) Building dams in small reservoirs or filling in reservoirs;

(3) Occupying or destroying small reservoir engineering facilities and their ancillary facilities and equipment;

(4) Constructing buildings and structures on dams, spillways, and water conveyance facilities, or carrying out reclamation, stacking debris, etc.;

(5) Opening and closing without authorization Reservoir engineering facilities or forcibly lifting or diverting water from the reservoir;

(6) Poisoning fish, exploding fish, electric fish and other activities that endanger the safe operation of the reservoir;

(7) In Within the scope of management and protection of small reservoirs, engage in activities such as blasting, drilling, quarrying, well digging, sand mining, soil extraction, and grave repairing that affect the safe operation of the reservoir;

(8) Other activities that hinder the safety of small reservoirs running activities.
