"People build illegal buildings and it becomes legal when they are built. We demolish legal buildings and they become 'illegal buildings'!" Recently, villagers in Dongxing Village, Yinjiang Town, Haishu, reported their distress to reporters.

More than ten years ago, due to the road widening project, more than 20 houses in the village were demolished from state-owned land and relocated to a piece of agricultural land next to it. At the beginning, villages and towns promised to obtain property rights certificates. Now, more than ten years later, the property rights certificates for these houses have been blocked due to land issues. "Legal housing" has suddenly become "illegal construction".

Immigrant houses on the side of Siming Road were widened and demolished

Siming Road in Yinjiang Town is the main road of the town. It is also the only way from Ningbo to Yinjiang and Zhangcun. It has eight lanes in both directions and is clean and beautiful. On the south side of the Dongxing Village section of the road, there is a row of three-story private houses, which are the "problem houses" reported by the villagers to reporters.

Villager Mr. Li took reporters to inspect the scene. The houses near the road here are occupied by people living upstairs, and the downstairs are used as stores. One row of three floors has 28 rooms in the last four buildings, which is quite special. "Strictly speaking, this house is an 'illegal building.'"

There are many row houses here, which were resettlement houses built by Zhougongzhai Reservoir more than ten years ago. The residents are all from Zhougongzhai Reservoir. Jiangjia Village immigrated to Dongxing Village, Yinjiang Town.

There are no problems with the resettlement policy. Resettlement compensation and land property rights are in place. The land in Dongxing Village for resettlement is also state-owned and allocated land.

In 2003, the resettlement houses were built and the immigrants from Jiangjia Village moved to Dongxing Village. At that time, the first row facing the road was a three-story building, and the rows inside were two-story buildings. When dividing houses, all the villagers draw lots.

"The house in the first row has three floors, and it is close to the road and can be used as a storefront, which is very good." The villager said: "More than a year later, Siming Road needs to be widened, and we need to The houses in the first row will be demolished again. ”

The demolition involves four buildings with 28 rooms and 24 households. Villager Mr. Lu took out a copy of the demolition agreement at that time and showed it to reporters.

This is an "Agreement on House Demolition for Jiangjiashan Resettled Households of the Mingzhou Avenue Project." The agreement was signed in October 2005. Party A is the Dongxing Village Economic Cooperative of Yinjiang Town; Party B is the name of the demolition and construction household. It stipulates the compensation costs for demolition, and that if the villagers fail to demolish within the time limit, they will not be rewarded and will be forced to demolish. The signature is stamped with the official seal of the village economic cooperative.

Where will the demolition be relocated? For the villagers, of course, it is still required to place them as storefront houses on the roadside. So the village set aside a piece of land on the roadside next to the resettlement area to build the same three-story residential house.

Started building houses in 2005. After all the houses were built in 2006, 24 households of villagers moved in, the original houses were demolished, and the road widening project was carried out smoothly.

The house was built on agricultural land and the property certificate could not be obtained for more than ten years

“At that time, the village committee promised us that after the demolition and resettlement, the policies for the resettled households would not change. , including the property ownership certificate of the house,” the villager said excitedly to the reporter, “It turned out that it couldn’t be fulfilled!”

The original resettlement land was state-owned. , the relevant departments also promised to issue a real estate certificate. Therefore, in 2007, they all obtained the "House Ownership Certificate", and in 2009, they also obtained the "State-owned Land Use Certificate." However, the 24 villagers who were demolished due to road widening have never been able to obtain property certificates and land certificates.

After asking at the village committee, they found out that the land they owned was "agricultural land" and they could not get a property rights certificate at all.

"We were originally a 'legal building', but now we have been demolished for the road project and turned into an 'illegal building'. How can we accept this?" said Mr. Li, a villager. "After that, we have been After reflecting, it has been more than ten years since others obtained the property rights certificates, but we still have nothing.”

The villagers told reporters that the lack of property rights certificates for the houses has brought great losses and difficulties to them. Aunt Yuan said: “The difference in value between houses with property rights certificates and those without property rights certificates is half that. We have villagers who are short of money to buy commercial houses because their sons are eager to get married, so they have to sell a house worth at least one million yuan for only 600,000 yuan. "The villagers said that some businesses still need money, and it is not possible to use their houses as mortgage loans. "If we have to demolish it again, how will our 'illegal construction' be counted? The longer the delay, the more panic we will feel!" /p>

The procedures are being processed, and it is still unclear when they will be completed

The reporter then came to the Dongxing Village Committee. The village committee secretary was in the office. He told the reporter: " There are historical reasons for this, but we are currently going through the procedures.”

Secretary Ren said that the villagers were immigrants from the reservoir more than ten years ago and were resettled here. At the beginning, it was state-owned land. According to the policy at that time. Everything is done.

But later it involved building roads, which were also people's livelihood projects. So the resettlement was carried out on the adjacent land. The other properties of this land were good, and it was connected with other resettlement houses, but the nature of the land was "agricultural land".

Secretary Ren said that several secretaries in his village have been doing this work and coordinating with the town government. But later, land management became more and more strict, and the zoning adjustments of Yinzhou and Haishu were made in 2016. This matter has been delayed again.

Due to historical reasons, the land violations involved need to go through the penalty process and then adjust. Secretary Ren said that the punishment process is almost complete at present. The land approval procedures are also being further processed.

Relevant personnel from the Urban Construction Office of the Yinjiang Town Government said that they have been completing relevant procedures since last year. At present, some of the procedures have been completed, but not all have been completed. It is not yet clear when the property ownership certificate will be obtained.

Promises cannot always be delayed

The reporter learned that 24 households of villagers have been reporting this problem to relevant departments. In June 2018, the town government also responded online through the government affairs hotline. : "At present, the town government has passed planning adjustments, communicated and coordinated with higher-level departments, and has basically agreed to the certification of the land. It is expected that the land will be certified soon."

But nearly a year has passed, and the property rights have changed. There is still no news about the testimony. The houses of these villagers were originally legal buildings, but due to the road widening project, they were demolished and resettled into "illegal buildings". The relevant departments should be responsible for this.

In addition, promises that should be fulfilled should be fulfilled on time and cannot always be delayed.
