Regulations on the administration of water conservancy and hydropower projects
(1) flood control and moisture-proof works;

Article 4 Water conservancy and hydropower projects invested by the state are owned by the whole people and managed by the state, and some of them can also be entrusted to collective custody.
Water conservancy and hydropower projects built by private organizations, cooperatives and teams with self-raised funds are owned by cooperatives and teams collectively, managed by collectives, and some can also be managed by the state according to needs. Article 5 The basic tasks of water conservancy and hydropower project management units are to ensure project safety, give full play to project benefits, actively carry out comprehensive management, constantly improve the level of scientific management, serve industrial and agricultural production and urban and rural people's lives, and promote socialist economic development. Article 6 Water conservancy and electric power departments at all levels and water conservancy and hydropower project management units shall, in accordance with the project management rules and regulations issued by the Ministry of Water Resources and Electric Power, earnestly strengthen project management, establish technical files, formulate relevant technical management measures or implementation rules, and strive to improve the scientific management level. Business management involving other departments should also refer to the technical regulations of relevant departments.
Water conservancy and electric power departments at all levels and water conservancy and hydropower project management units should train project management talents in a planned way and strengthen the technical training of employees. Chapter II Protection of Water Conservancy and Hydropower Projects Article 7 The scope of protection of various water conservancy and hydropower projects shall be defined according to the needs of management, combined with natural geographical conditions, historical conditions and specific social and economic conditions.
The scope of protection is divided into four categories: building management scope, reservoir management scope, dike protection land and channel protection land:
(a) around water retaining, drainage, water diversion buildings, power plants and irrigation and drainage projects, delimit the scope of building management;
(two) below the resettlement line or land acquisition line around the reservoir, delimit the scope of reservoir management;
(3) Delineation of berms on both sides of the river bank;
(four) irrigation and drainage channels and protection canals delineated by dikes on both sides of the canal.
The scope of protection shall be determined by the water conservancy and hydropower project management unit after consultation with the relevant departments of the project, and reported to the local people's government of the project, and the boundaries shall be delineated, signs shall be set up and certificates shall be issued. Major projects shall be approved by the higher authorities and the relevant people's governments. Eighth within the scope of management of land and land attachments, belonging to the state management of the project, its ownership belongs to the whole people, the right to use belongs to the water conservancy and hydropower project management unit; Collective management of the project, its ownership belongs to the collective, used by the water conservancy and hydropower project management unit. No other unit or individual may occupy it, and if it has been occupied, it shall be returned.
For the project that has been taken over by the water conservancy and hydropower project management unit, when the land ownership within the management scope needs to be changed, the project management unit shall apply and handle the land transfer procedures according to the relevant provisions.
The ownership and use right of the land and attachments on the berm and channel protection land are generally unchanged according to the status quo. If it needs to be owned by the whole people, it shall be handled according to the preceding paragraph. Article 9 In order to protect water conservancy and hydropower projects and their ancillary facilities and equipment, the following activities are prohibited:
(a) damage to dams, power stations, channels, sluices and other water conservancy and hydropower engineering buildings and their observation, hydrology, communications, power transmission and transformation, transportation and other ancillary facilities;
(2) Reclaiming, shoveling and cutting down shelterbelts on dams and canals;
(three) setting up buildings that endanger the safety of the dam;
(four) embezzlement, misappropriation of water conservancy and hydropower materials, equipment, equipment;
(five) in the waters of fish, fish poisoning and abuse of electricity fishing;
(6) Crawler tractors, hard-wheeled vehicles and overweight vehicles run on the dam crest, dike crest and sluice traffic bridge, and run on the dam crest and dike crest without road surface after rain;
(seven) in the project management unit of communication, water report line hanging broadcast line;
(eight) within the scope of protection, blasting, drilling wells, burying graves, quarrying, borrowing soil, dredging, building houses, deforestation and other activities that endanger the safety of the project. Tenth in order to maintain the efficiency of water conservancy and hydropower projects, the following activities are prohibited:
(a) the construction of buildings and facilities that affect the flow of water in flood, drainage and water conveyance rivers and channels;
(2) Reclaiming land at will in floodplain areas, lakes, flood storage areas, flood discharge areas, reservoir areas and beaches near estuaries;
(three) the construction of navigation obstruction and harmful diversion, water flow and other projects in the river;
(four) mining sand and gravel and soil materials that endanger the safety of the project in the river beach and river bank;
(5) Planting tall plants in floodplains, channels, flood discharge areas and flood diversion rivers;
(6) Dumping garbage, waste residue, tailings and slag and piling up sundries in reservoirs, rivers, canals, lakes and other waters and beaches. Eleventh it is really necessary to carry out construction activities within the scope of protection of water conservancy and hydropower projects, and shall obtain the consent of the competent department of water conservancy and electric power. Where navigable rivers are involved, the consent of the competent departments of shipping and forestry shall be obtained and approved according to the prescribed procedures.
Buildings, plants, garbage, waste residue, tailings, slag, sundries and other facilities within the protection scope of water conservancy and hydropower projects shall be demolished and rebuilt by the obstacle-setting unit, and the original efficiency of the project shall be restored within a time limit. In accordance with the provisions of the approved construction of buildings and facilities have water blocking phenomenon, by the parties concerned through consultation.
