Provisions on the administration of the application for seaman's certificate by personnel temporarily accompanying the ship on business

Article 1 These Provisions are formulated in accordance with the Measures of the People's Republic of China for the Administration of Seafarers' Certificates in order to standardize the work of seafarers on duty temporarily on board ships and earnestly safeguard the credibility and seriousness of the seafarers' certificates of the People's Republic of China. Article 2 The following principles shall be observed when performing official duties with the ship temporarily:

(1) The place to perform the task must be on the ship;

(2) The task content is directly related to the production, safety, environmental protection, science and technology, education and training, life and health, maintenance and management on board;

(three) does not affect the normal production and safety of the ship. Article 3 According to the principle of Article 2 of these Provisions, the relevant personnel engaged in the following temporary tasks on board the ship may apply for a crew certificate and temporarily perform the designated tasks with the crew certificate:

(1) The shipping company is responsible for the management and technical personnel of ship production, safety, environmental protection, sea surveillance, maintenance, communication and navigation, and the party affairs and administrative personnel of the company perform tasks related to the above duties or conduct on-board inspection, training, internship (or guidance internship) and internship;

(2) Scientific research, testing and maintenance of marine equipment or instruments carried out by science and technology and its management personnel, or scientific investigation, monitoring and testing in navigation, aerospace and oceanography carried out with the ship;

(three) students and graduates of maritime colleges practice, and teachers and crew training institutions of maritime colleges guide internships or apprenticeships;

(4) Professional technicians in maritime institutions responsible for ship management, crew management, navigation management, ship inspection management and maritime investigation, professionals in maritime courts or maritime arbitration institutions responsible for maritime trial and arbitration, and professional technicians related to navigation receive training (or lectures), internships (or guidance) and apprenticeships on board;

(5) Shipyard engineers perform the onboard support tasks stipulated in the ship construction (or repair) contract;

(6) The relevant legislative organs, administrative organs and social organizations related to navigation shall send people on board for inspection in order to formulate relevant policies and regulations and understand the characteristics of ship production and crew work and life. Article 4 The Ministry of Communications shall issue approval documents for handling crew certificates to those who temporarily accompany the ship on business. Article 5 The Maritime Safety Administration of the Ministry of Communications shall be responsible for the examination and management of seafarers' certificates of those who temporarily accompany the ship on business. Article 6 Procedures for examination and approval of applications for seaman's certificates by personnel temporarily accompanying the ship on business:

(1) The organizer shall submit an application to the Ministry of Communications with official documents and attach materials as required.

(2) The Maritime Safety Administration of the Ministry of Communications shall, in accordance with these Provisions and the relevant provisions on the administration of crew certificates, examine the qualifications of the tasks and personnel accompanying the ship. Those who pass the examination shall be issued with the approval document for handling the crew certificate issued by the Ministry of Communications; If the audit is unqualified, the applicant will be notified by reply.

(3) The organizer shall apply to the maritime agency designated in the approval document of the Ministry of Communications for the crew certificate. Article 7 The contents of the application documents shall include: the specific tasks of the ship, the time and time limit for carrying out the tasks, the route, the company to be accompanying the ship, the number of people accompanying the ship and the name of the leader (if there are more than one ship, the corresponding leader shall be indicated).

The application documents shall be accompanied by the following materials:

(1) List of applicants for crew certificate (see Annex1);

(2) The official document that the shipping company agrees to accept the task with the ship (the students and graduates organized by the shipping company for on-board training, internship and school arrangement may not be attached);

(3) If the personnel accompanying the ship belong to different units respectively, the personnel of the non-group unit shall have the documents that the unit agrees to leave the country with the ship; If the person accompanying the ship is the chief or deputy of the party and government of the unit to which he belongs, there shall be a document that the superior unit agrees to leave the country with the ship; If there are personnel from the Ministry of Communications in the crew of the ship, they shall be reported to their subordinate departments (departments and bureaus) for approval, and shall be approved by the leaders of the Ministry. Article 8 Administrative and public institutions shall temporarily organize groups to work with the ship, and shall not excuse themselves, and shall not submit application documents to the Ministry of Communications at the invitation of or on behalf of the shipping company. Article 9 No person who does not meet the above principles and tasks may apply for a crew certificate with the ship. If it is really necessary to accompany the ship, you can apply for other entry and exit documents in accordance with relevant state regulations. Article 10 It is strictly forbidden to use the seaman's card to enter or leave the country to perform tasks that are inconsistent with these provisions.

Temporary crew members shall not engage in affairs inconsistent with seafarers' status during their work on the ship. Article 11 The validity period of the seaman's certificate of the personnel temporarily accompanying the ship on business shall be determined by the Maritime Safety Administration of the Ministry of Communications, which is generally 6 months to 1 year, and may be extended to 2 years when special needs arise.

The seaman's card of the person who is temporarily accompanying the ship on duty shall adopt a special number, and such seaman's card shall not be used for the export of seafarers' labor services and shall not be issued overseas. Article 12 The crew certificate of the personnel temporarily accompanying the ship on business is only valid when carrying out tasks with the ship. After the task is completed, the relevant personnel shall hand over the seaman's certificate to the team unit. The organizer is responsible for returning the crew certificates of all temporary crew members to the maritime agency that issued the crew certificates.

The crew certificates of the chief captain, chief engineer, pilot captain and pilot engineer of a shipping company shall be kept by the unit to which they belong, and can be used for many times within the validity period, but before carrying out the task with the ship, the unit to which they belong shall file with the China Maritime Safety Administration in writing. Article 13 Conduct "familiarization training" for the personnel temporarily accompanying the ship on business according to regulations, that is, train them with basic knowledge and skills such as maritime safety, lifesaving, survival and first aid before boarding the ship. If the mission time on board the ship reaches or exceeds one year at a time, the crew shall receive basic safety professional training at the crew education and training institution designated on the shore and obtain the corresponding training certificate.

The shipping company that accepts the task of temporarily accompanying the ship and the captain and political commissar of the relevant ship shall educate the personnel who are temporarily on board to carry out the task in terms of ship discipline, foreign discipline, national customs of the countries (regions) where the ships such as ports, immigration and customs visit, emergency deployment on board, maritime safety and so on.

Units and organizations that temporarily travel with the ship shall conduct foreign affairs discipline education for those who perform tasks with the ship and put forward requirements for performing tasks.
