Measures for the Election of Villagers' Committees in Ningxia Hui Autonomous Region (revised on 20 19)

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Organic Law of Villagers' Committees of the People's Republic of China and in light of the actual situation of the autonomous region in order to standardize the election of villagers' committees and ensure the villagers to exercise their democratic rights according to law. Article 2 A villagers' committee consists of a chairman, vice-chairmen and three to seven members (odd number). The specific number is proposed by the people's governments of townships and towns according to the actual situation of each village, and determined after discussion at the villagers' meeting or the villagers' representative meeting.

There should be female members in the members of villagers' committees, and there should be fewer ethnic members in villages where multi-ethnic villagers live.

There shall be no husband and wife, parents, children, brothers and sisters among the members of the villagers committee. Article 3 The chairman, vice-chairmen and members of a villagers' committee shall be directly elected by the villagers by secret ballot. No organization or individual may designate, appoint or replace members of a villagers' committee or stop their work without authorization. Article 4 The term of office of a villagers' committee is five years. Upon the expiration of the term of office, a general election shall be held in time, and its members may be re-elected.

Due to special circumstances, it is necessary to advance or postpone the general election of villagers' committees, which shall be approved by the people's governments of townships and towns where they are located and submitted to the people's governments of counties (cities, districts) for approval. However, the time to advance or postpone the general election shall not exceed six months. Fifth people's governments at all levels to organize the implementation and guidance of the election of villagers' committees shall be guaranteed by the finance at the corresponding level.

The election funds of the villagers' committee shall be paid by the village collective economic benefits. Villages without collective economic interests shall be subsidized by the people's governments of counties (cities, districts), townships and towns, and the expenses shall not be apportioned to the villagers. Article 6 Grass-roots organizations of China * * * Production Party shall play a leading role in the election of villagers' committees, and support and guarantee the villagers to directly exercise their democratic rights in accordance with laws and regulations.

Local people's congresses at various levels and the standing committees of local people's congresses at or above the county level shall supervise the election of villagers' committees according to law. Seventh village committee election by the people's government of the autonomous region unified deployment, organized by the people's governments of cities, counties (cities, districts), townships and towns.

The civil affairs departments of the people's governments at or above the county level shall specifically guide the election of villagers' committees.

Sub-district offices under the jurisdiction of villagers' committees shall perform the duties of the general election of villagers' committees of the people's governments of townships and towns. Chapter II Organization of Election Article 8 During the general election of villagers' committees, the people's governments of counties (cities, districts), townships and towns shall set up an election steering group for villagers' committees, and the election steering group may invite party representatives, deputies to the National People's Congress and CPPCC members as members.

The election work steering group shall perform the following duties:

(a) to publicize and implement the relevant laws and regulations;

(two) the specific deployment, guidance and supervision of the election work, and guide the villagers to conduct elections according to law;

(three) to formulate the election work plan, standardize the election documents and ballot styles, and report them to the civil affairs department of the people's government at the next higher level for the record;

(4) training election staff;

(five) to accept complaints, reports and accusations related to the election;

(six) to do a good job in the petition work related to the election;

(seven) to guide and assist the villagers' committee to complete the work transfer;

(eight) to guide the establishment and improvement of electoral work files. Article 9 The election of villagers' committees shall be presided over by election of villagers committee. Election of villagers committee is composed of a chairman, vice-chairmen and members, with an odd number of five to seven.

Election of villagers committee members are elected by villagers' meetings, villagers' representative meetings or villagers' group meetings convened by village party organizations or election steering groups of villagers' committees. Election of villagers committee members are elected according to the number of votes, and the director and deputy director are elected by election of villagers committee.

After the establishment of election of villagers committee, it should be announced to the villagers in a timely manner, and reported to the township and town villagers' committee election work steering group for the record.

The election of village committees follows the principle that the minority is subordinate to the majority. Election of villagers committee's term of office is from the date of election to the end of the handover of the villagers' committee. Article 10 election of villagers committee shall perform the following duties:

(a) to publicize and implement the laws, regulations and policies concerning the election of villagers' committees;

(two) to formulate the election work plan, which was discussed and passed by the villagers' meeting or the villagers' representative meeting, and was announced and implemented after being reported to the township and town villagers' committee election work steering group for the record;

(3) Organizing the nomination, selection and training of election staff;

(four) organize the registration of villagers, review the qualifications of villagers, and publish the list of villagers, clients and clients;

(five) organize the nomination of candidates, publish the official list of candidates, introduce candidates, and organize candidates to meet and communicate with villagers;

(six) to accept the election registration, publish the list of candidates, and organize election speeches;

(7) Organizing voting and announcing election results;

(eight) the establishment of electoral work files;

(nine) to preside over the transfer of the villagers' committee;

(ten) to undertake other matters in the election work. Eleventh election of villagers committee members in any of the following circumstances, their duties will automatically terminate:

(a) was nominated as a candidate for members of the villagers' committee, I accept the nomination, or recommend myself for election;

(two) during the election, he did not attend the election of villagers committee meeting twice without justifiable reasons.

If the post of election of villagers committee member terminates by itself, it shall be announced by election of villagers committee, and it shall be replenished in the order of the number of votes obtained in the original election, or it may be re-elected.
