Article 1 For people with Vietnamese nationality, the Socialist Republic of Vietnam is a unified country where all ethnic groups live together on Vietnamese territory, and all members of all ethnic groups have Vietnamese nationality.
People with Vietnamese nationality include those who still have Vietnamese nationality on the effective date of this Law and those who have Vietnamese nationality according to the provisions of this Law.
Article 2 the relationship between the state and citizens. The Socialist Republic of Vietnam guarantees the rights of Vietnamese citizens, who must fulfill their obligations to the country and society according to law. The state protects the legitimate rights of Vietnamese citizens abroad.
Article 3 recognizes that Vietnamese citizens have only Vietnamese nationality. The Socialist Republic of Vietnam only recognizes that Vietnamese citizens have one nationality, that is, Vietnamese nationality.
Article 4 (Retention of Nationality) A person who marries, divorces, revokes an illegal marriage or changes his spouse's nationality shall retain his nationality. 1. The nationality of Vietnamese citizens who marry, divorce or declare illegal marriage null and void with foreign citizens or stateless persons remains unchanged. 2. The nationality of one spouse will not be changed by joining or losing Vietnamese nationality.
Chapter II Determination of Vietnamese Nationality
Article 5 Have Vietnamese nationality. One of the following circumstances has Vietnamese nationality; 1. Born; 2. Obtain Vietnamese nationality; 3. Approved to restore Vietnamese nationality; 4. Possess Vietnamese nationality according to international treaties to which Viet Nam has acceded or signed; 5. Having Vietnamese nationality under other circumstances stipulated in this Law.
Article 6 Nationality of children. 1. Both parents are Vietnamese citizens, and they have Vietnamese nationality regardless of whether they were born at home or abroad. 2. One of my parents is a Vietnamese citizen, and the other is stateless or of unknown nationality. No matter whether I was born at home or abroad, I have Vietnamese nationality. 3. One parent is a Vietnamese citizen and the other is a foreign citizen. If I was born in Vietnam, or my parents had permanent residence in Vietnam when I was born, I have Vietnamese nationality. Both parents unanimously choose other nationalities as their exceptions. If I was born outside Vietnam, or my parents didn't have a permanent residence in Vietnam when I was born, my nationality will be subject to my parents' choice. I was born in Vietnam, my parents are stateless, I have a permanent residence in Vietnam and have Vietnamese nationality. 5. In Vietnam, children of unknown parents have Vietnamese nationality.
Article 7 Vietnamese citizenship. 1. Foreign citizens and stateless persons live in Vietnam and voluntarily abide by the Constitution and laws of Vietnam. Meet the following conditions: (1) 18 years old or older; (2) Know Vietnamese; (3) Have lived in Vietnam for at least 5 years. 2. Foreign citizens and stateless persons with justifiable reasons can become Vietnamese citizens, and are not subject to the restrictions stipulated in items (1), (2) and (3) of the first paragraph of this article. 3. If a person who has joined Vietnamese nationality according to the provisions of this article commits fraud when applying for Vietnamese nationality, the decision to approve Vietnamese nationality shall be revoked.
Chapter III Loss and Restoration of Vietnamese Nationality
Article 8 Loss of Vietnamese nationality. Vietnamese citizens lose their Vietnamese nationality under the following circumstances: 1. They were allowed to renounce Vietnamese nationality. 2. Being deprived of Vietnamese nationality. 3. Loss of Vietnamese nationality in accordance with the provisions of international treaties to which Vietnam is a party or a signatory. 4. Other cases of loss of Vietnamese nationality as stipulated in this Law.
Article 9 Withdraw from Vietnamese nationality. 1. Vietnamese citizens can be allowed to give up Vietnamese nationality if there are justified reasons. 2. Under any of the following circumstances, an applicant for renouncing Vietnamese nationality may not renounce Vietnamese nationality: (1) He is in military service; (2) Taxes or other debts owed; (3) Being under criminal investigation; (4) The judgment is being executed. 3. Those who are withdrawing from Vietnamese nationality endanger national security and may not withdraw.
Article 10 Deprivation of Vietnamese nationality. 1. Vietnamese citizens living outside Vietnam will be deprived of Vietnamese nationality if they commit acts that seriously endanger national independence, the cause of building and defending Vietnam's socialist motherland or the interests and reputation of Vietnam's socialist countries. 2. A person who has obtained Vietnamese nationality according to Article 7 of this Law may be deprived of Vietnamese nationality if he commits the acts specified in Article 1 of this Article, no matter where he lives.
Article 1 1 Restores Vietnamese nationality. If there are justified reasons, people who have lost Vietnamese nationality can be allowed to restore Vietnamese nationality. Chapter iv nationality of minor children and adopted children when parents' nationality changes.
Article 12 Nationality of minor children when parents' nationality changes. 1. The nationality of both parents has changed: when their minor children join, quit or restore Vietnamese nationality, their nationality naturally changes with the nationality of their parents. 2. If the nationality of one parent changes, the nationality of minor children shall be decided by the parents. 3. 15 years of age but under 18 years of age, if you want to change your nationality according to the provisions of 1 and 2 of this article, you must obtain your consent.
Article 13 Nationality of minor children whose parents have been deprived of Vietnamese nationality or whose Vietnamese nationality has been revoked. If one or both parents are deprived of Vietnamese nationality according to Article 10 of this Law, or the decision to be allowed to become Vietnamese nationality is revoked according to Article 7, paragraph 3 of this Law, the nationality of their minor children will remain unchanged.
Article 14 Nationality of minor adopted children. 1. The minor adopted child is a foreign citizen or a stateless person. If both or one of the adoptive parents is a Vietnamese citizen, he/she can obtain Vietnamese nationality upon the application of the adoptive parents, and all the conditions stipulated in Article 7 1 of this Law can be exempted. 2. A minor adopted child is a Vietnamese citizen. If one or both of his adoptive parents are foreign citizens, with the consent of his biological parents or guardians, he can quit Vietnamese nationality and become a foreign citizen at the application of his adoptive parents. 3. 15 years of age but under 18 years of age, if you want to change your nationality according to the provisions of 1 and 2 of this article, you must obtain your consent.
