Over-age Children Protection Act (CSPA)

The Law on the Protection of Over-age Children (CSPA) came into effect on August 6th, 2002. For the purpose of issuing visas, the new bill changes the procedure for determining whether a child is over age (for example, whether it was 2 1 year before issuing a visa or before changing his status), so as to determine whether to issue a visa.

The purpose of this bill is to enable some applicants who are over-aged before the issuance of visas to retain their children's status, especially those who are over-aged due to delays in visa processing. The law applies to the following visa categories:

1) Children of American citizens/legal permanent residents (main applicants for IR-2 and F2A)

2) Family reunion visas and labor visas (F 1, F2, F3, F4 and all E visas). The bill does not apply to V, K and any other non-immigrant visas.

CSPA is only applicable to the following scope

1) The immigration application was approved after August 6, 2002 (including that day); or

2) The applicant is over age after August 6, 2002 (including the extension of 45 days allowed by the Patriotic Law, if applicable); or

3) The applicant was over age before August 6, 2002, but his application for a visa before he was over age was rejected.

CSPA is a very complicated bill, and there are not many specific standards suitable for applicants to obtain such protection in detail. Consular officials will examine each applicant's file according to the Act to determine whether he/she is suitable for the Act. If you don't receive the notice of your overage from our library within six months before your overage, please contact us as soon as possible.

Note: If the timetable hasn't arrived, the library can't review its overage problem.

In some cases, the applicant may not be protected by this Act, but may benefit from the 200 1 Patriotism Act. The bill can provide an extra 45 days' holiday for over-age applicants.
