How to appeal after the cancellation of the study visa in Australia?

hello

After students are reported by the Immigration Bureau for failing to meet the standards, they will be asked by the Immigration Bureau to interview and make a reasonable explanation; If there is no timely reply or the reason is not accepted by the Immigration Bureau, then there is a high probability that students will be required to leave the country within 28 days while their visas are cancelled. Failing to leave the country within 28 days will become a "black citizen" without a valid visa. If students don't know that their visas have been cancelled, they will be stopped by the customs and sent back to China after 28 days of cancellation for other reasons.

If the explanation is passed, the compliance officer will let you continue to legally hold a student visa to go to school. If the explanation fails, the visa officer will cancel your visa on the spot according to s. 137J in the Immigration Act 1958. Once the visa is cancelled, students will face the restriction that they cannot re-enter Australia with certain visas for three years. At the same time, students also have several choices, either leaving the country or restoring their student visas according to the requirements of s. 137K in MigrationAct 195.

It is worth noting that if the 28-day explanation period has expired when you go to explain, that is, your visa has been automatically cancelled, then you will (possibly) be taken to the detention center immediately, and it will take only 2 working days to apply for visa restoration using s 137k, and at most you can only apply for extension of 5 working days. If you are overseas when the visa is automatically cancelled, you still have 28 days to apply.

If you apply for visa recovery using s 137k, but your application is rejected, you only have 7 days (stay in Australia and leave the country with a bridge visa E), or you decide to apply for MRT appeal according to the Immigration Act 1958s. 137L, and apply for appeal within 28 days after being rejected. Usually MRT lasts for 6 months or more.

Experience shows that it is very easy for students to go to the Immigration Bureau to explain, because they don't understand the immigration law, and the immigration officers in the Immigration Bureau are very tough in handling this situation, so unless you have enough evidence, basically 99% will be cancelled. What makes immigration lawyers more headache is that the applicant's speech may be inconsistent or illogical, leaving a handle, which is not conducive to future appeals.

hope this helps
