The speed of applying for a Canadian tourist visa from China has been greatly improved. It used to take more than 400 days, but recently it has been reduced to 47 days. At this juncture, Canada's tourist visa approval has suddenly accelerated, which has also added a lot of flexibility to the vast number of immigrant applicants.

In August, 2020, the Immigration Bureau introduced a temporary policy of applying for a tourist visa online to a work visa in China, allowing domestic tourists to apply for a work permit online, stay in Canada legally, accumulate work experience in Canada, and then obtain Canadian permanent residence status (Maple Leaf Card) through provincial nomination or CEC. This temporary policy was released in August 2020. It was originally planned to expire on February 28, 2022, but now the Immigration Bureau has postponed it again until February 28, 2023. This means that a small partner with a tourist visa (including maintenance status or restoration status) can convert his tourist visa into a closed work visa in Canada before February 28, 2023.

What is a closed work permit?

Closed work permits are opposite to open work permits, so this temporary policy does not apply to open work permits (such as PGWP holders and spouse open work permit holders). Closed employer-specific work permits can be divided into two categories: one is supported by lmia, and the other is the offer of employment exempted by Lmia (the employer needs to register in the employer portal to obtain the Offer of employment number, and then the applicant applies for a work permit with the Offer of employment number. Common applications include provincial nomination and work visa). In most cases, it meets the first category, that is, the applicant needs to obtain the offer from the Canadian employer first, and then the employer can apply for a closed work visa after completing the labor approval Lmia.

Then before the implementation of the temporary policy, there are two ways for overseas applicants to apply for work permits:

1) For overseas application, it is recommended to submit a language score of at least IELTS 5 (especially for NOC 0AB position) to prove whether you are qualified for this job, so as to ensure the successful approval of the work permit;

2) Applicants who come to the border with a Canadian tourist visa for an interview to change their work visa are not well prepared, have poor English expression skills (especially in NOC 0AB post), are nervous on the spot, have difficulty in answering questions, and will face great challenges;

Now with this policy, it means that applicants with limited English ability can submit their work permit applications online in Canada, without having to submit their language scores or risk going to the border for an interview to change their work permits. After the LMIA is approved, the applicant can submit the application for online work permit supported by the New Deal, which solves the problem that most people don't understand the language.

Special instructions:

This policy only allows closed work visas, that is, designated employers. This temporary policy not only restricts the work units, workplaces and employers, but also restricts the posts. This means that you need the cooperation of your employer before you can apply. While holding this work permit, you can't change your employer and job position without authorization.

Applicants must meet the following conditions:

1) The applicant was in Canada at the time of application;

2) Have a valid visitor status in Canada at the time of application, including maintaining status or restoring status. If your visitor status has expired, you need to restore your visitor status before applying for a work permit. If the applicant held a work permit in the past 12 months, and later changed his identity to a visitor because the work permit expired, he can apply for authorization to start work within the approval period of this work permit;

3) During the period from August 2020 to February 28, 2023, submit the labor approval document (lmia) approved by ESDC or the application for work permit in Canada with lmia exemption offer (such as provincial nomination work permit);

4) Hold a valid employment letter from the employer; ;

5) Meet other entry requirements, such as physical examination and no criminal record.

Traveling to work is suitable for people:

1) Accompany your mother, you can change to work permit status to accumulate work experience in Canada, and later get a maple leaf card through provincial nomination category or CEC. If it is a NOC 0AB post, children can also go to public primary and secondary schools for free, leaving an annual tuition fee of10.5 million Canadian dollars;

2) Applicants with poor domestic language performance, poor work background, low immigration budget and low academic qualifications. Using this temporary policy, IELTS scores can be exempted from the test, and there is no high requirement for the applicant's domestic work background and academic background.

The difficulty of this temporary policy lies in:

2) Apply for labor approval LMIA

If employers in Canada need to recruit foreign workers, they must first submit an LMIA application to ESDC. With the LMIA confirmation letter, workers can apply for a work permit.

LMIA application qualification:

Applying for labor approval requires extremely strict and complicated employer qualifications, so applying for LMIA is not an easy task. Simply put, at least the following five requirements must be met:

The position to be recruited must meet the National Occupational Category of Canada (NOC) and the salary should meet the average salary in the region where the employer is located;

Employers must advertise in Canada for four consecutive weeks (at least three recruitment platforms) four weeks before the application is approved, and prove to the Ministry of Labor that they cannot find suitable employees in Canada;

In addition to advertising, employers need to consider other recruitment methods to increase the possibility of approval by the labor department;

If the employer submits a high-paying position, it also needs to submit a transition plan to the Ministry of Labor, promising to retain existing Canadian citizens or permanent employees;
