Regulations on the Protection of the Mausoleum of the First Qin Emperor in Shaanxi Province (revised on 20 19)
All units and individuals have the obligation to protect the cultural relics of Qin Shihuang Mausoleum, and have the right to stop and report acts that damage or destroy the cultural relics, historical features and natural environment of Qin Shihuang Mausoleum.
Units and individuals are encouraged to donate legally collected cultural relics related to the Mausoleum of the First Qin Emperor to the State. Article 5 The following cultural relics of the Mausoleum of the First Qin Emperor shall be protected according to law.
(1) Architectural sites, including land closures, underground palaces, inner and outer city walls, sleeping halls, toilets, gardens and temples, sanchuque sites, etc.
(2) Burial pits, including terracotta warriors, stone armor pits, chariots and horses pits, stables pits, acrobatic figurines pits, rare birds and animals pits, imperial storage pits, etc.
(3) Graves buried with people and cemeteries built for grave repairers.
(4) Ancillary facilities of the cemetery, including flood dikes, fish pond sites, stone processing plants and Yili sites.
(five) cultural relics buried in the site and other cultural relics with historical, artistic and scientific value. Article 6 The Mausoleum of the First Qin Emperor is divided into protected areas and construction control zones. The scope of protection refers to the area where the protected objects of Qin Shihuang Mausoleum and its surrounding areas are specially protected; Construction control zone refers to the area where construction projects are restricted to protect the safety, environment and historical features of Qin Shihuang Mausoleum outside the scope of protection.
The four boundaries of the scope of protection and the construction control zone shall be reasonably delineated and published by the provincial people's government according to the category, scale, content of the mausoleum of the First Qin Emperor and the historical and realistic situation of the surrounding environment. The provincial cultural relics administrative department shall, jointly with the provincial planning administrative department, set up protection signs and boundary markers within the scope designated by the provincial people's government. Article 7 The provincial people's government shall strengthen its leadership over the protection of the Mausoleum of the First Qin Dynasty, and coordinate and solve major problems in the protection of the Mausoleum of the First Qin Dynasty, such as planning, land acquisition, resettlement and funds for the protection of cultural relics.
Xi Municipal People's Government, Lintong District People's Government and relevant township (town) people's governments should do a good job in the protection of the Mausoleum of the First Qin Emperor. Article 8 The provincial cultural relics administrative department is in charge of the protection of the Mausoleum of the First Qin Emperor, and is responsible for the supervision and management of the protection of cultural relics within the scope of protection and the construction control zone.
The administrative law enforcement of cultural relics in the construction control zone may be entrusted by the provincial cultural relics administrative department to the cultural relics administrative department of Lintong District, Xi for implementation.
Housing and urban and rural construction, culture and tourism, public security, natural resources, ecological environment, market supervision and management, forestry and other administrative departments. We should do a good job in the protection of the mausoleum of Qin Shihuang within the scope of their respective duties. Ninth Qin Shihuang Mausoleum management agencies responsible for the exploration and investigation, archaeological excavation, display, scientific research, safety protection and other work. Article 10 The provincial people's government shall organize Xi Municipal People's Government, Lintong District People's Government and relevant provincial departments to prepare the protection plan for the Mausoleum of the First Qin Emperor, and report it to National Cultural Heritage Administration for approval before implementation.
The protection planning of the Mausoleum of the First Qin Emperor should solicit the opinions of relevant scientific research institutions and experts, and be linked with the overall land use planning, urban and rural construction planning and the planning of Lishan scenic spot. Eleventh Qin Shihuang Mausoleum protection and management funds and maintenance and construction funds should be included in the provincial budget and capital construction project plan, earmarking, and shall not be diverted or misappropriated.
Tickets and other operating income of the Mausoleum of the First Qin Emperor are all used for the protection of cultural relics, and no unit or individual may occupy or misappropriate them.
Property donated by natural persons, legal persons and other organizations shall be managed and used by the management organization of the mausoleum of the First Qin Emperor according to law, and shall not be used for other purposes. Article 12 The following acts are prohibited within the scope of protection.
(1) Digging sand for soil, building graves, discharging sewage, discarding solid wastes and other acts that may damage the safety of cultural relics.
(two) shooting activities in the area without shooting signs.
(3) storing inflammable, explosive and other dangerous goods.
(4) posting, scribbling, portraying and climbing on cultural relics and protection facilities, signs and boundary markers.
(five) new construction, renovation and expansion of construction projects unrelated to the protection of cultural relics.
(six) set up outdoor advertising, the construction of artificial attractions. Article 13 For the following construction projects or operations within the scope of protection, the project implementation unit shall report them to the provincial people's government for approval step by step in accordance with legal procedures, and take measures to ensure the safety of underground cultural relics.
(a) new construction, renovation and expansion of cultural relics protection construction projects.
(two) engaged in blasting, drilling, excavation and other operations.
(three) installation of communication, power supply, water supply, gas supply and sewage pipelines.
(four) the implementation of environmental greening projects.
Cultural relics protection and construction projects shall carry out environmental impact assessment and seismic safety assessment according to law.
