Regulations of Yaan Municipality on the Administration of New Rural Residential Areas

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of Ya 'an City in order to consolidate and enhance the achievements of post-earthquake reconstruction, standardize the management of new village settlements, strengthen the construction of rural communities and happy and beautiful new villages, and promote social harmony. Article 2 These Regulations shall apply to the management of new village settlements built after the "4.20" Lushan strong earthquake within the administrative area of this Municipality. Article 3 The term "new village residential area" as mentioned in these Regulations refers to the concentrated residential area of rural residents with supporting infrastructure and public service facilities, which is built in accordance with the new rural construction plan.

The term "new village residential area management" as mentioned in these Regulations refers to the standardized management of houses, supporting facilities and public places in new village residential areas, and the activities of maintaining environmental sanitation, appearance order and landscaping in new village residential areas. Fourth new village settlements management should adhere to the principles of government guidance, residents as the main body, democratic management and self-service. Fifth people's governments at the county level shall strengthen the leadership of the management activities of new village settlements within their respective administrative areas.

The relevant administrative departments of the people's governments at the county level shall, in accordance with their respective duties, provide services and supervise the management activities of new village settlements according to law. Article 6 An autonomous management committee shall be set up in a new village residential area to be responsible for the daily management of the new village residential area. Smaller new village settlements can be elected by residents of new village settlements and perform the duties of self-management committees.

Township people's governments shall organize, guide and coordinate the management of new village settlements within their respective jurisdictions, urge independent management committees to perform their duties according to law, and coordinate the relationship between rural community construction and new village settlements management.

Villagers' committees assist township people's governments in the management of new village settlements and support independent management committees to carry out activities according to law. Seventh people's governments at the county level shall establish a subsidy mechanism for the management of new village settlements.

The people's governments at the city and county levels should increase capital investment and support for the construction and management of new village settlements and establish a long-term mechanism. Chapter II Autonomous Management Committee Article 8 Residents' household registration belongs to the new village inhabited areas of different administrative villages, and the township people's government where the new village inhabited areas are located is responsible for convening residents or residents' representatives in the new village inhabited areas to set up autonomous management committees, electing and replacing members of the autonomous management committees, and the relevant villagers' committees shall provide assistance.

Residents' household registration belongs to the new village settlement in the same administrative village, and the Township People's Government may entrust the villagers' committee to convene the residents or residents' representatives of the new village settlement to set up an independent management committee to elect and replace the members of the independent management committee.

Residents' representatives are determined by the residents in the new village residential area on a household basis and are produced from family members with full capacity for civil conduct. Article 9 The autonomous management committee consists of an odd number of three to seven people. The members of the autonomous management committee are elected from the residents of the new village.

Members of the autonomous management committee shall abide by the law, have good conduct, be fair and upright, be enthusiastic about public welfare undertakings and have certain working ability.

The term of office of members of the autonomous management committee is three years, and they can be re-elected. Article 10 The autonomous management committee may have a chairman and vice-chairmen. The director and deputy director are elected from the members of the independent management committee. Eleventh autonomous management committee shall, within thirty days from the date of its formation, file with the local township people's government.

The administrative committee of the autonomous region shall apply to the local public security organ for engraving the seal of the administrative committee of the autonomous region in accordance with the relevant provisions.

The autonomous management committee shall be announced within three days after the election. Twelfth autonomous management committee mainly performs the following duties:

(a) the implementation of residents' discussion and management of new village settlements;

(two) to organize the drafting of the draft convention on residents' management;

(three) to supervise the implementation of the residents' management convention;

(four) city order and environmental sanitation management;

(five) contact the relevant parties to ensure the normal operation of public facilities and equipment;

(6) Collecting, using and managing relevant fees according to the residents' management convention;

(7) Establishing and managing archives;

(eight) cooperate with the relevant departments and the villagers' committee where the new village is located to do a good job in public security, fire control, health planning, epidemic prevention, tourism and publicity. Thirteenth members of the autonomous management committee may be replaced in any of the following circumstances:

(1) resigned;

(2) Failing to perform their duties for more than three months in a row or for more than six months in total;

(3) Losing the ability to perform duties;

(four) jointly proposed by more than one third of the residents. Article 14 The autonomous management committee of the new village residential area shall organize the residents of the new village residential area or their representatives to formulate and amend the residents' management convention. Fifteenth residents management convention shall be formulated according to the actual situation of the new village settlements, and the residents management convention shall include the following items:

(a) codes of conduct before and after cleaning houses;

(2) norms for the use of houses;

(3) norms for the treatment of domestic garbage;

(4) Specification for sewage discharge and treatment;

(5) code of conduct for maintaining public health;

(six) the code of conduct for caring for public facilities and cleaning facilities;

(7) Standards for keeping pets;

(eight) the new village residential management fees;

(nine) measures to encourage compliance with the residents' management convention and measures to deal with violations of the residents' management convention;

(ten) other management matters discussed and decided by residents.

When formulating a convention on residents' management, we should respect social morality, promote the change of customs and habits, and establish a civilized rural style, and must not violate the provisions of laws and regulations and harm the public interest.

The Convention on Residents' Management is binding on all residents in the new village community.
