These Provisions shall apply to the compensation and resettlement of rural collective land house demolition in Cangshan District, Jin 'an District and Mawei District. Demolition projects that have been implemented in accordance with the "Detailed Rules for the Implementation of Compensation and Resettlement for the Demolition of the Eastern New Town" may be implemented with reference to these Provisions.

There are two types of compensation for residential houses:

Monetary compensation or housing placement

There are two ways of compensation and resettlement for house demolition on collective land: monetary compensation or house resettlement. For non-residential houses, due to the complexity of various types involving industry, commerce and office buildings, monetary compensation is mainly adopted.

Monetary compensation, the legal area of the house to be demolished will be converted into currency according to the market evaluation price, and the person to be demolished will purchase and resettle himself. The market evaluation price consists of the unit price of housing location compensation and the unit price of old housing compensation.

Housing placement refers to the placement based on the legal construction area, combined with the situation of family members, according to the nearest standard room type. Where housing placement is implemented, the compensation amount of the house to be demolished shall be calculated in accordance with the provisions of monetary compensation, and the difference between the settlement and the market evaluation of the resettlement house shall be settled.

Basic regional protection policy

The "Regulations" clarify that any house with legal property rights within the scope of demolition or without property rights built before June 26, 2004, which conforms to the basic area protection policy, will be relocated during the negotiation period, and there are no other houses within the city. If the per capita construction area is less than 45 square meters, make up 45 square meters for resettlement. The resettlement part of 45 square meters is given housing location compensation fee, relocation reward and resettlement population subsidy. The standard of population subsidy for demolition and resettlement is determined by the demolition person according to the actual situation of the demolition project.

Only the relocated households who meet the following conditions can enjoy the basic area protection policy:

1. Members of rural economic cooperatives (hereinafter referred to as members of rural economic cooperatives) registered in their own villages and qualified to contract their own land in 1984 first round of land contracting or 1998 second round of land contracting;

Compensation and resettlement in four cases.

For houses without property rights, compensation and resettlement will be carried out in four situations according to the housing conditions and construction time recorded by Fuzhou Survey Institute over the years:

1. This property-free building was built before 19841October 5, when the Urban Planning Ordinance of the State Council came into effect. If the building user can provide valid original certification materials such as deed certificate, construction land certificate, building tax payment record or satellite aerial image, it shall be confirmed and compensated according to the original construction area.

2. The houses without property rights built before the promulgation of "Implementation Opinions on Strengthening the Investigation and Responsibility Investigation of Illegal Land Occupation Construction (Trial)" in the State Council from June 5438+1October 5, 2004 to June 5438+1October 26, 2004 shall be compensated according to the replacement price of houses with different structures;

In addition, newly compensated houses without property rights built between 1984 1.5 and 2004 1.26 are calculated at the replacement price. After deducting the resettlement population area, 200 yuan relocation reward will be increased per square meter; For the houses without property rights built from June 26th, 2004 to August 26th, 2006, an extra self-relocation reward of RMB 0/00 per square meter will be given; The maximum negotiation period for enjoying the above relocation reward is 2 months. Refuse to move after the expiration of the negotiation period, and do not enjoy the above relocation reward.

Compensation for changing houses into storefronts

Property rights and no property rights.
