Generally speaking, you can, unless the court stipulates that you are not allowed to leave the country.
At present, civil disputes generally do not restrict entry and exit, but if there is a notice from the court, it may restrict entry and exit, especially if there is a civil effective judgment of the court, and the defendant refuses to fulfill the payment obligation determined by the judgment, the court will notify the relevant authorities to restrict entry and exit.
Article 12 of the Entry-Exit Administration Law: China citizens are not allowed to leave the country under any of the following circumstances:
(1) Failing to hold a valid exit-entry certificate or refusing or evading border inspection;
(two) the punishment has not been completed or belongs to the defendant or criminal suspect in a criminal case;
(three) there are unresolved civil cases, and the people's court decides not to leave the country;
(4) Being subject to criminal punishment for obstructing the administration of the country (border) or being repatriated by other countries or regions for illegal exit, illegal residence or illegal employment, and not allowed to leave the country within the prescribed time limit;
(five) may endanger national security and interests, the relevant authorities in the State Council decided not to leave the country;
(6) Other circumstances under which exit from the country is prohibited by laws and administrative regulations.
Second, what is border control?
Border control refers to a kind of preservation measures taken at China's border ports to prevent foreigners or China citizens involved from escaping from judicial organs and causing heavy losses to our country's state, collective or individual property through legal procedures.
Thirdly, how to deal with border control.
1. Cases that need to restrict the entry of foreigners or the exit of China citizens must be handled as soon as possible in strict accordance with the law and strictly controlled.
2. With regard to the establishment of the approval authority to restrict foreigners or China citizens from leaving the country, if the criminal suspects or other illegal acts identified by the court have not been dealt with and legal responsibilities need to be investigated, and there are unresolved civil cases, the court will decide to restrict the execution of exit and notify the public security organs at the same time.
3. When the court restricts foreigners and China citizens from leaving the country, it may notify the parties orally or in writing that the parties may not leave the country before the case (or problem) is solved. According to the nature of the case and the specific circumstances of the parties, measures such as residential surveillance or bail pending trial are taken respectively, or they are allowed to leave the country after providing property guarantee or paying a certain amount of deposit. There is also the detention of the client's passport or other valid entry and exit documents, but it must be completed within the validity period of the passport or other entry and exit documents, and at the same time, a certificate of detention must be issued to me. If the court distrains the passport or other valid entry-exit documents of the parties concerned and cannot settle them within the entry-exit validity period, it shall notify the public security organ in advance.
4. Several regulations also require the court to fill in the Notice of Persons Stopped from Leaving the Country at the frontier inspection station for some foreigners and China citizens who are not allowed to leave the country. If it is necessary to stop leaving the country at the port, it should be handed over to the public security departments and bureaus of provinces, autonomous regions and municipalities directly under the central government. In case of emergency, if it is really necessary, it can also be handed over to the frontier inspection station first, and then the transfer control procedures can be handled according to the regulations. If the control port is outside the province, autonomous region or municipality directly under the Central Government, the relevant provincial public security organ shall handle the transfer control procedures.
