Regulations of Jilin Province on Wetland Protection

Chapter I General Provisions Article 1 In order to strengthen wetland protection, maintain the basic functions of wetland ecosystem and promote the sustainable utilization of wetland resources, these Regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this province. Second units and individuals engaged in activities related to wetland protection within the administrative area of this province shall abide by these regulations. Article 3 The term "wetland" as mentioned in these Regulations refers to an area with perennial or seasonal accumulated water, which is suitable for the survival of wet wild animals and plants and has the function of regulating the surrounding environment. Wetlands are divided into swamps, lakes, rivers, reservoirs and ponds.

The term "important wetlands" as mentioned in this Ordinance refers to the wetlands in this province that have been included in the list of important wetlands by the International Convention on Wetlands or the China Wetland Protection Action Plan, and the important wetlands in this province identified by the provincial expert committee. Article 4 Wetland protection shall follow the principles of scientific planning, protection priority, rational utilization and sustainable development. Article 5 The competent forestry department of the people's government at or above the county level is the competent department of wetland protection and management, and is responsible for the organization, coordination, guidance, supervision and management of wetland protection within their respective administrative areas.

Wetland protection implements a comprehensive, coordinated and departmental protection management system. The water conservancy department is responsible for the management of rivers, reservoirs and ponds; Development and reform, finance, land and resources, environmental protection, housing and urban and rural construction, agriculture and animal husbandry, meteorology and other relevant departments shall, within the scope of their respective duties, do a good job in wetland protection according to relevant laws and regulations. Sixth people's governments at or above the county level shall organize relevant departments to carry out scientific research on the protection and utilization of wetlands, and actively promote the advanced technology of wetland protection and utilization. Seventh people's governments at or above the county level shall strengthen the publicity and education of wetland protection, enhance citizens' awareness of protection, and commend and reward units and individuals that have made outstanding contributions to wetland protection. Eighth citizens, legal persons and other social organizations have the obligation to protect wetlands, and have the right to report or accuse the destruction and occupation of wetlands. Chapter II Protection and Utilization Article 9 The people's governments at or above the county level shall incorporate wetland protection into the local national economic and social development plan, and formulate wetland protection plans that are linked with the overall land use planning, urban and rural planning, water resources planning and environmental protection planning.

Provincial wetland protection planning shall be organized by the competent forestry department of the provincial people's government in conjunction with relevant departments and implemented after approval by the provincial people's government; City (state), county (city) wetland protection planning by the competent forestry department at the same level in conjunction with the relevant departments to organize the preparation, approved by the people's government at the same level, and submitted to the competent forestry department of the provincial people's government for the record before implementation.

The people's governments at or above the county level shall strictly implement the wetland protection plan, and if the plan needs to be changed, it shall be examined and approved according to the original approval procedures. Tenth people's governments at or above the county level shall formulate policies to encourage and support wetland protection, arrange capital investment reasonably, and gradually establish an important wetland ecological benefit compensation mechanism. Eleventh provincial people's government to set up a wetland expert committee, responsible for the identification of wetlands and the scope of protection, wetland resources evaluation and other activities, to provide technical advice and evaluation opinions for wetland protection and utilization. Specific measures shall be formulated by the provincial people's government.

Members of the wetland expert committee shall include experts and engineers in forestry, water conservancy, land and resources, environmental protection, housing and urban and rural construction, agriculture and animal husbandry, meteorology and fisheries. Twelfth people's governments at or above the county level shall take measures such as returning farmland, containment, water diversion and sand prevention, planting grass and ecological migration to encourage and support the restoration and transformation of degraded wetlands. Coordinate the distribution of water resources in regions or river basins, and give full consideration to ecological water use in wetlands. When there is a shortage of ecological water in wetland, measures such as engineering water supplement should be taken to restore ecological water. Thirteenth use of wetland resources to engage in production and operation or eco-tourism activities must conform to the wetland protection plan and maintain the sustainable utilization of wetland resources; It is forbidden to change the basic function of wetland ecosystem, to cause permanent damage to wildlife species beyond the renewable capacity of resources, and to destroy wildlife habitats. Article 14 If buildings, structures, dams, passages and other facilities built on wetlands are no longer used, the original units and individuals shall clean them up in time and restore their original appearance according to the requirements of the competent department of wetland protection and relevant departments. Chapter III Supervision and Management Article 15 People's governments at or above the county level shall regularly supervise and inspect the implementation of wetland protection planning and guide relevant departments to do a good job in wetland protection. Sixteenth people's governments at or above the county level shall organize relevant departments to regularly investigate and monitor the wetland resources within their respective administrative areas, and establish archives of wetland resources. The provincial people's government shall, according to the results of investigation and monitoring, timely release the bulletin on the status of wetland resources. Seventeenth people's governments at or above the county level shall set up wetland protection landmarks, and the protection landmarks shall indicate the types, protection levels and scope of wetlands.

No unit or individual may destroy or change the wetland protection signs without authorization. Eighteenth introduction of animal and plant species to important wetlands, shall go through the examination and approval procedures in accordance with the relevant provisions of the state.

The competent department of wetland protection and relevant departments shall track and monitor the introduced species, and if it is found that it may or has already caused harm to the wetland, it shall report to the people's government at the same level and the competent department at the next higher level in time, and take measures to eliminate the harm.
