Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality in order to strengthen the protection of the mountain around the city in Sanyuan District, optimize the living environment and promote the harmonious development between man and nature. Article 2 These Regulations shall apply to mountain protection activities in Sanyuan District and their supervision and management. The scope of mountain protection is determined by the mountain protection plan approved and published by the Municipal People's Government.

The term "mountain protection" as mentioned in these Regulations refers to the activities of taking comprehensive measures to avoid or reduce the damage caused by man-made and natural factors to the mountain, effectively prevent geological disasters and soil erosion, and maintain and restore the natural ecology of the mountain.

Within the scope of mountain protection, it belongs to nature reserves, scenic spots, forest parks, wetland parks, drinking water source protection areas, ecological public welfare forests, etc. , and strictly protected in accordance with the provisions of relevant laws and regulations. Third mountain protection should adhere to the principles of protection priority, ecological priority, scientific planning, comprehensive management, public participation and responsibility for damage. Article 4 The people's governments of the city and Sanyuan District shall strengthen their leadership in mountain protection, incorporate mountain protection into the national economic and social development plan, establish the target responsibility system and assessment system for mountain protection, and do a good job in mountain protection.

The town people's government and sub-district offices shall, in accordance with their duties, do a good job in mountain protection within their respective jurisdictions.

Village (neighborhood) committees shall assist in the related work of mountain protection. Article 5 The competent department of natural resources shall exercise unified supervision and management over mountain protection, coordinate and urge other relevant departments to perform their duties of mountain protection, organize the prevention and control of geological disasters, and be responsible for the planning and management of construction projects and mountain protection for the development and utilization of land and mineral resources.

Housing and urban and rural construction departments are responsible for mountain protection houses and municipal infrastructure construction.

The urban management department is responsible for the mountain protection of urban parks, greenways, urban road slopes and construction waste disposal sites.

Departments in charge of development and reform, religious affairs, civil affairs, finance, ecological environment, transportation, agriculture and rural areas, forestry, water administration, cultural tourism and emergency management shall do a good job in mountain protection within their respective functions and duties. Article 6 The people's governments of the city and Sanyuan District shall establish a joint meeting system for mountain protection, organize research and coordinate to solve major problems in mountain protection.

City, Sanyuan District People's Government shall establish and improve the mountain protection information exchange, joint inspection and law enforcement mechanisms, and promptly investigate and deal with illegal acts of destroying mountains. Article 7 The people's governments of the city and Sanyuan District shall increase their investment in mountain protection work such as mountain condition investigation, protection planning, ecological restoration and emergency treatment, and incorporate them into the annual fiscal budget.

Encourage social capital to participate in mountain protection. Eighth city, Sanyuan District People's government and relevant departments shall organize the publicity and education of mountain protection related laws and regulations and popular science knowledge, and enhance the awareness of the whole society to protect mountains.

The news media should strengthen the public welfare propaganda of mountain protection, and supervise the behavior in violation of mountain protection regulations by public opinion. Article 9 Any organization or individual has the right to dissuade, complain and report acts of destroying mountains. The people's government of the city and Sanyuan District shall announce the way of reporting complaints, and the relevant departments shall deal with them in a timely manner according to law.

An organ prescribed by the state or an organization prescribed by law may, according to law, require the infringer who destroys the ecological environment of the mountain to bear the liability for compensation for the ecological environment damage. Chapter II Protective Measures Article 10 The municipal competent department of natural resources shall organize the preparation of mountain protection plans, which shall be promulgated and implemented after being approved by the Municipal People's Government and reported to the Standing Committee of the Municipal People's Congress for the record. Mountain protection planning shall be completed within six months after the promulgation of these regulations.

Mountain protection planning shall specify the following contents: protection scope, protection measures, protection planning, control requirements, restoration and management and other related matters.

Mountain protection planning shall conform to the overall planning of national territory and space, and be connected with other plans such as ecological environment protection, soil and water conservation, prevention and control of geological disasters, protection and utilization of forest land, and mineral resources. , its main contents should be included in the detailed planning. Within the scope of mountain protection, classified protection shall be implemented with the urban development boundary determined by the overall land and space planning as the boundary. Those within the urban development boundary are general protected areas, and those outside the urban development boundary are key protected areas. Eleventh mountain protection planning is the basic basis for the implementation of mountain use control, mountain resources protection and overall mountain utilization activities, and shall not be modified at will.

In any of the following circumstances, if it is really necessary to modify the mountain protection plan, the municipal natural resources department shall propose a modification plan, make modifications according to the planning procedures, and announce it to the public:

(a) the overall planning of land and space is adjusted or revised;

(two) due to the national and provincial and municipal major project construction needs, it is really necessary to modify;

(3) Other circumstances that should be amended according to law. Twelfth Sanyuan District People's Government shall, according to the mountain protection plan, set up boundary markers and other protection signs, indicating the scope of mountain protection, responsible units, complaint telephone numbers and other contents.

No unit or individual may move or damage mountain boundary markers and other protection signs without authorization.
