Can it be built within the scope of reservoir protection?

You can't. According to relevant laws and regulations, dams and their facilities are protected by the state, and no unit or individual may occupy or destroy them. The dam management unit shall strengthen the safety and security of the dam. It is forbidden to carry out activities that endanger dam safety, such as blasting, drilling wells, quarrying, mining, dredging, borrowing soil and repairing graves, within the scope of dam management and protection.

1. Does the state stipulate how many meters around the reservoir can be inhabited?

The state stipulates that no one can live within 400 meters around the reservoir, and the specific distance needs to be decided according to the management regulations of the region.

Judge whether your house was flooded or not. The submerged area of the reservoir refers to that after the dam sluice is completed, the water level of the river will rise rapidly after the water level near the dam reaches the design level, and the backwater far from the dam will drop by several thousandths or tens of thousands (usually referring to mountainous and valley rivers).

This will cause the land and cultivated land upstream of the dam to be flooded due to the backwater of the reservoir, and the flooded area is called flooded area. Article 7 of the State Council's Opinions on Improving the Support Policies for the Resettlement of Large and Medium-sized Reservoirs (Effective) stipulates that the local people's government where the project department is located shall be responsible for the physical investigation of the project area and submerged area.

The resettlement planning shall make arrangements for rural resettlement, relocation of cities (towns), relocation of industrial and mining enterprises, relocation or restoration of special facilities, construction of protection projects, development and utilization of reservoir waters, support measures for reservoir resettlement, compensation for land acquisition and estimation of resettlement funds.

The production and living difficulties of residents in the affected areas above the flood line caused by reservoir impoundment should be included in the resettlement plan and properly handled in accordance with the principle of economy and rationality. The compensation for the flooded area of the reservoir shall be investigated by the relevant competent department of the reservoir.

In violation of the provisions of these regulations, any of the following acts shall be ordered by the dam authorities to stop the illegal act, compensate for the losses, take remedial measures and may be fined; Should be given administrative penalties for public security, the public security organs shall be punished in accordance with the provisions of the "People's Republic of China (PRC) Public Security Administration Punishment Law"; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) the destruction of the dam or its observation, communication, electricity, lighting, transportation, fire control and other management facilities;

(2) Blasting, drilling wells, quarrying, mining, earth borrowing, sand digging, grave repairing and other activities endangering dam safety within the scope of dam management and protection;

(three) unauthorized operation of the dam flood gate, sluice gate and other facilities, undermining the normal operation of the dam;

(4) Reclaiming land in the reservoir area;

(five) the construction of docks, canals or piled up debris on the dam, drying food and grass;

(six) unauthorized construction of docks and fish ponds within the scope of dam management and protection.
