Spouse migration is a kind of family reunion migration in Australia. What should spouses pay attention to when they immigrate to Sydney, Australia?
In general, to apply for a spouse visa, you need to submit relevant certificates of cohabitation 12 months at least, except for the following three:
A. applied for a de facto marriage relationship in the district government (i.e. de facto marriage).
B the applicant and the guarantor have common children.
C in the applicant's China, the applicant is not allowed to have a de facto contact with the guarantor.
2. How to avoid a two-year waiting period?
Generally speaking, applicants are initially granted a temporary spouse visa for two years, during which they can work full-time or travel on vacation. Two years after you get a temporary visa, you need to submit conclusive evidence to prove that you are still in contact and provide the latest criminal record, so that you can get a permanent visa, which is what we often call the waiting period.
In this case, the applicant can directly obtain a permanent residence visa without a two-year waiting period. The premise is:
A when applying for a visa, the applicant and the guarantor have been married or have maintained an objective marriage relationship for more than 3 years.
B when applying for a visa, the applicant and the guarantor have been married, or have maintained an objective relationship for more than two years and have two children.
However, unless the applicant applies for a permanent visa immediately, the Immigration Bureau will approve more temporary visas.
3. If you apply for spouse immigration investment before marriage.
In order to apply for a spouse visa, the applicant must prove that there is a guarantee relationship between the applicant and the guarantor, generally referring to the marriage relationship. But this is not a prerequisite. The most common force majeure event is in the state of de facto marriage, that is, cohabitation.
Prospective spouse 300 visa, this visa should be customized for foreign spouse applicants who are about to get married in Australia. Once the visa is approved, the applicant can get a temporary work visa for 9 months, but the applicant must marry the sponsor in Australia within 9 months before applying for a spouse visa.
If the spouse applies abroad, there is no mandatory requirement to get married before the application date. You only need to get married during the trial and meet the conditions. Those who submit 300 kinds of visa applications and get married during the trial of visa cases may apply to the Immigration Bureau for a spouse visa.
Note: The above exception does not apply if it is a regional spouse application. If the applicant cannot prove that he is married before the application date, the application will be rejected.
4. de facto marriage relationship
A de facto marriage means that the applicant and the guarantor have lived together for at least 12 months. Relevant evidence needs to be submitted:
A. Cohabitation relationship: communication records at the same address, common rental contract or common purchase contract.
B. Economic relations: joint accounts, joint asset ownership and pension beneficiaries.
C. interpersonal relationship: social affirmation of this matter, such as taking photos with friends or relatives.
Note: if you are married, you should also submit the above information, but you don't have to meet the requirement of' living together for at least 12 months'.
5. If the application includes the non-biological children of the guarantor.
If the applicant has children with his predecessor and the children are not the biological children of the guarantor, it will complicate the whole trial process.
If the child is under 18, it is generally called dependent and must rely on parents. In this way, children can be included in the application for spouse visa, but they need the permission of another biological parent.
If the applicant does not want to include the children under 18 in the spouse visa application, the children must still pass the physical examination and have no criminal record. But if the applicant does not have custody of the children, the situation will become more and more difficult.
The relevant time limit for meeting the eligibility for spouse visa application is to declare married life. There is no minimum time required by laws and regulations for applicants and guarantors to maintain their marriage relationship before submitting visa applications. However, for applicants who apply as cohabiting lovers, they will be required to submit visa applications in most cases, and the cohabitation relationship between the applicant and the guarantor needs at least 12 months. There are few cases where the requirement of 12 months can be waived. For example, the applicant and the guarantor have applied for registration of the association according to the laws of the designated country or region.
Temporary visa and permanent visa
After submitting a visa application, eligible applicants will first get a temporary visa. The visa corresponding to foreign applicants is subclass 309, and the visa corresponding to regional applicants is subclass 820. During the temporary visa period, the applicant can live and work in Australia and get medical insurance.
2-year waiting period or long-term spouse relationship
Most temporary visa holders cannot obtain a permanent visa until two years after submitting their visa applications. In the second stage, the visa officer will listen to whether the relationship between the applicant and the guarantor has remained stable in the past few years. If the applicant still meets the requirements of the spouse visa after 2 years, the applicant will be eligible to apply for and obtain a permanent visa. Subclass820 visa holders can get Subclass80 1 visa, and Subclass309 visa holders can get Subclass 100 visa.
