Chapter I General Provisions Article 1 In order to effectively prevent and control soil erosion, rationally utilize and protect soil and water resources, improve the ecological environment and promote economic development, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of the Autonomous Prefecture. Article 2 All units and individuals engaged in natural resources development, production and construction and other activities that may cause soil erosion within their respective administrative areas must abide by these regulations. Article 3 The water administrative departments of the people's governments of autonomous prefectures, counties and cities shall be in charge of the work of soil and water conservation within their respective administrative areas. The work of water and soil conservation in districts, townships and towns is the responsibility of the dispatched offices of the county and municipal people's governments and township and town people's governments, and the daily work is the responsibility of the local water conservancy and electric power management institutions or water and soil conservation institutions. The main responsibilities of the water administrative department of the people's governments at all levels in the fourth autonomous prefecture are:

(a) to publicize and implement the laws, regulations, principles and policies of the state on soil and water conservation;

(two) responsible for soil and water conservation survey, in conjunction with the relevant departments to prepare soil and water conservation planning;

(three) responsible for the approval and supervision of the implementation of soil and water conservation programs;

(four) in violation of laws, regulations and policies of soil and water conservation, organize investigations and make administrative punishment decisions and administrative reconsideration;

(five) responsible for the monitoring, forecasting and announcement of soil erosion dynamics;

(6) Organizing scientific research, personnel training and technology popularization of soil and water conservation;

(seven) the collection and management of soil erosion prevention and control fees. Fifth autonomous prefecture people's governments at all levels of planning, agriculture, forestry, land, transportation, finance, urban construction, geology and mineral resources, industry and commerce, finance and other relevant departments, should actively support and cooperate with the water administrative departments to do a good job in soil and water conservation. Article 6 The water and soil conservation plan prepared by the water administrative department of the people's government of an autonomous prefecture, county or city shall be approved by the people's government at the same level and reported to the water administrative department at the next higher level for the record. The modification of soil and water conservation planning must be approved by the original approving authority.

The people's governments of autonomous prefectures, counties and cities shall incorporate the water and soil conservation planning into the national economic and social development plan and organize their implementation.

The people's governments of autonomous prefectures, counties and cities shall, according to the specific conditions of soil erosion, delimit key control areas, key supervision areas and key prevention and protection areas of soil erosion. Seventh Autonomous Prefecture People's governments at all levels shall establish a target responsibility system for soil and water conservation during the term of government leadership, and regularly report the work of soil and water conservation to the Standing Committee of the people's congress at the same level. Eighth autonomous prefecture propaganda, education, culture, radio and television departments at all levels shall carry out publicity and education on soil and water conservation.

The relevant institutions of higher learning in Autonomous Prefecture may set up water and soil conservation majors according to the needs and train professionals in water and soil conservation. Ninth Autonomous Prefecture People's governments at all levels shall commend and reward the units and individuals that have made remarkable achievements in the prevention and control of soil erosion. Chapter II Prevention Article 10 The people's governments at all levels in Autonomous Prefecture shall organize the whole people to plan afforestation, closing hillsides to facilitate afforestation, planting grass, protecting vegetation and expanding vegetation coverage.

It is forbidden to destroy forests and grass, set fire to wasteland, shovel turf, and dig tree pockets on steep slopes; Prohibition of deforestation; It is forbidden to raise large livestock in key prevention and control areas; Deforestation of soil and water conservation forests and water conservation forests is prohibited. Article 11 Before the implementation of the Law on Soil and Water Conservation in People's Republic of China (PRC), if crops have been planted on steep slopes where reclamation is prohibited, in places with large population and few land, farmland should be gradually returned to forests on the basis of building basic farmland; If it is really difficult to return farmland, the people's governments at all levels shall organize the masses to gradually build terraces or take other soil and water conservation measures; In places with particularly harsh natural conditions and difficult survival, it is necessary to create conditions to gradually implement the relocation of immigrants. Twelfth units and individuals that have one of the following acts must formulate water and soil conservation plans and report them to the water administrative departments at or above the county level for approval.

(1) Reclaiming state-owned or collective wasteland below 25 degrees according to law;

(two) the nature of tending and regeneration of soil and water conservation forests and water conservation forests;

(three) the construction of railways, highways, water conservancy projects, the establishment of mines, electric power, building materials and other enterprises;

(four) in the production and construction activities, other may cause soil erosion.

In violation of the provisions of the preceding paragraph, the planning department shall not initiate the project; The land management department shall not approve the application for land use, and shall not issue a land use certificate; The forestry department shall not issue cutting licenses; Urban construction and environmental protection departments shall not approve environmental impact reports and issue construction permits; Geology and mineral resources, industrial and commercial administrative departments shall not issue certificates and photos. Thirteenth units and individuals that have built or are building production and construction projects that cause soil erosion shall submit a supplementary report on the water and soil conservation plan to the water administrative department at or above the county level within one year from the date of implementation of these regulations. Fourteenth water and soil conservation facilities in a construction project must be designed, constructed, accepted and put into use at the same time as the main project. If the acceptance of soil and water conservation facilities is unqualified, the construction project shall not be put into use. After the project is put into operation, the management unit of the construction project must be responsible for the management of soil and water conservation facilities and accept the supervision of the local water administrative department. Article 15 It is forbidden to dump solid wastes such as earth, stone, sand, slag, industrial garbage and domestic garbage into places other than rivers, ditches, reservoirs, ponds, channels and special storage places.
