In addition to European citizens, foreigners who want to work in Germany also need work permits. However, individuals who legally represent a legal entity, such as directors of foreign companies in Germany, managers of joint-stock companies, general business partners or some members of other partnership companies, and employed directors with general representation, do not need work permits, so they only need to apply for residence permits.
German local labor bureau is responsible for examining and approving work permit applications. Usually, work permits can be obtained through future employers. There are two forms of work permit: one is limited to employment in a specific company, and the other is not restricted to employment activities or places. Even if the work permit is not limited to a specific company, it is usually only valid within the jurisdiction of the labor bureau, with a term of 3-5 years.
Work visa (2)
According to the German Work Promotion Law, German employers can only hire foreigners with work permits. In addition, a foreigner seeking temporary employment in Germany cannot obtain a residence permit without a work permit, unless the foreigner does not need to obtain a work permit clause when applying for a visa.
The local employment department issues work permits to foreign applicants according to the situation of the German labor market. According to the requirements of German law, local employment departments must give priority to the employment of German domestic labor force and citizens of European member States before considering citizens of other countries, that is, only when there are no suitable candidates in Germany and European member States can they issue work permits to foreigners from other countries.
In Germany, work permits are divided into the following three types:
(1) general work permit, issued to foreign temporary residents;
(2) Special work permit, issued to foreigners who have lived in Germany for more than 10 years and have worked in Germany continuously for 5 years;
(3) Permanent work permits are issued to foreigners who have obtained permanent residency in Germany.
