Article 1: These measures are formulated in accordance with the "Organic Law of the People's Republic of China and National City Residents' Committees" and in combination with the actual conditions of the autonomous region. Article 2: Residents’ committees are grassroots mass autonomous organizations for residents to practice self-management, self-education, and self-service. Article 3 In cities without districts, municipal districts or their dispatched sub-district offices, the town people's government shall provide guidance, support and assistance to the work of residents' committees. The residents' committee assists the town people's government and sub-district offices in carrying out their work. Article 4 Relevant departments of the people's government of a city not divided into districts, municipal districts, and counties that need the assistance of the residents committee or its subordinate committees shall handle matters through the people's government of a city not divided into districts, municipal districts, counties, or town people's governments, or sub-districts. If the residents committee is asked to assist in work without consent, the residents committee has the right to refuse. Article 5: Residents' committees are generally established within the scope of 100 to 700 households based on residents' living conditions and in accordance with the principle of facilitating residents' self-governance. If there are less than 100 households or more than 700 households that need adjustment, they can be adjusted appropriately.
The residents' committee can divide the residents into several resident groups based on the actual conditions of the residential area. Article 6 The establishment, cancellation and scale adjustment of residents' committees shall be proposed by the town people's government or sub-district office and submitted to the people's government of a city without districts, municipal districts or counties for approval.
The division of residents' groups shall be decided by the residents' committee and reported to the town people's government and sub-district office for filing. Article 7 The residents' committee shall consist of 5 to 9 persons including the director, deputy directors and committee members. Specific quotas are determined by the people's governments of cities without districts, municipal districts, and counties based on the number of residents in the neighborhood committee and the opinions of the majority of residents. Residents' committees should have members from ethnic groups with a relatively small number of members, and the directors and deputy directors of residents' committees should have women members.
The residents' group shall have a leader and, if necessary, a deputy leader. The group leader and deputy group leader are elected by the residents' group, and members of the residents' committee can concurrently serve as group leaders. Article 8 Members of the residents' committee shall be elected by all the residents in the residential area who have the right to vote or by representatives from each household; based on the opinions of the residents, they may also be elected by 2 to 3 representatives selected by each residents' group. Article 9 The election of residents' committee members shall be conducted under the guidance of the town people's government and the sub-district office, and shall be presided over by the election group approved by the residents' meeting.
The number of candidates for residents’ committee members should generally be 1 to 2 more than the number of candidates to be elected, and a differential election will be implemented; if the number of candidates nominated is equal to the number of candidates to be elected, an equal number election can also be conducted.
Candidates for residents’ committee members are jointly proposed by more than 10 voters and more than 5 household representatives. Residents’ groups can also nominate, and the election group determines the official candidates based on the opinions of the majority of voters.
An election should have more than half of the voters or representatives participating in the voting, and a candidate can be elected only if he obtains more than half of the votes of the voters or representatives participating in the voting. Article 10: Each term of a residents' committee is five years, and its members may be re-elected for re-election.
Resident committee members may resign to the residents committee. The residents committee may accept the resignation of individual residents committee members. The residents' meeting has the right to remove incompetent residents' committee members. When a resident committee member becomes vacant due to resignation, replacement or other reasons, the residents committee shall hire an agent from the residents of the residential area, submit the request to the residents' meeting for a by-election according to the election procedures, and report to the town people's government and sub-district office for record. Article 11 Members of residents’ committees must abide by the constitution, laws, regulations and national policies, maintain ethnic unity, act impartially, and enthusiastically serve residents of all ethnic groups. Article 12 The residents' committee shall set up people's mediation, public security, public health, family planning and other committees as necessary, or the members of the residents' committee shall be responsible for relevant work according to their division of labor.
Members of the residents committee may concurrently serve as members of subordinate committees. Article 13: Agencies, groups, military units, enterprises and institutions shall not participate in the local residents' committee, but shall support the work of the local residents' committee. When the local residents' committee discusses issues related to these units and requires them to attend meetings, they should send representatives to participate and abide by the relevant decisions of the residents' committee and the residents' convention.
Employees and their family members of the units listed in the preceding paragraph, as well as military personnel and their family members accompanying the military, shall participate in the residents' committees in the areas where they live. In the family residential areas of these units, family members committees may be established separately with reference to the relevant provisions of these Measures, and they shall undertake the work of the residents' committees under the guidance of the town people's government, the sub-district office and the unit. The office space and working expenses of the family committee and the living allowance of the members of the family committee shall be provided by the unit where they work.
Article 14: Tasks of residents’ committees:
(1) Promote the constitution, laws, regulations and national policies, safeguard the legitimate rights and interests of residents, educate residents to perform their due obligations in accordance with the law, and protect public property ;
(2) Organize and implement the decisions, resolutions and residents' covenants of the residents' meeting;
(3) Develop the collective economy and carry out community service activities that are convenient and beneficial to the people;
(4) Handle public affairs and public welfare undertakings for residents in the area where they live;
(5) Strengthen education on ethnic unity and promote mutual trust, mutual help, mutual respect, and mutual support among all ethnic groups. , learn from each other;
(6) Mediate civil disputes and promote family harmony and neighborhood unity;
(7) Assist relevant departments to improve social security comprehensive management and implement the security contract responsibility system , do a good job in public security prevention and provide assistance and education to those released from labor reform and those released from reeducation through labor, and maintain social security;
(8) Assist the town people's government and sub-district offices to do a good job in public health , family planning, special care and relief, protection of the disabled, youth education, literacy education and protection of the legitimate rights and interests of women and children;
(9) Organize residents to carry out various forms of socialist spiritual civilization construction activities, educate and support residents to change customs, respect the elderly and care for the young, help the poor, and unite and help each other;
(10) Reflect residents’ opinions, demands and suggestions to the people’s government or sub-district offices.
