I. Introduction

There are many definitions of transnational marriage, which are combined with the characteristics of race and region: marriage transcends national boundaries and the marriage relationship between people from different countries. The phenomenon of transnational marriage can be traced back to the slavery society at the earliest, but the real transnational marriage originated from the feudal society. The biggest feature of transnational marriage in this period is that it has a strong political color, and all European countries have marriages between royal families to achieve a certain political goal; In Asia, due to the promotion of trade and national prestige, there are marriages of China, Persia, Fusang and other countries. For example, in the Tang Dynasty, Songzan Gampo in Tibet married Princess Wencheng and Princess Nepal at the same time, and Princess Jincheng married the Western Regions. With the development of world economy, science and technology and culture, in the wave of globalization, marriage has also appeared obvious globalization, and the number of transnational marriages in China is increasing day by day. For example, overseas sons-in-law and daughters-in-law in foreign-related marriages in Shanghai cover almost the whole world, involving all continents except Antarctica. It is reported that among foreign-related marriages, Japanese people are most favored by Shanghainese, accounting for 39.6% of the total number of overseas people; Other relatively concentrated countries and regions are the United States (9. 1%), Australia (6. 1%), China, Hong Kong (5.5%) and Canada (3.9%). Therefore, the internal causes, existing problems and how to regulate this phenomenon have attracted more and more attention from all walks of life.

Second, the main reasons for transnational marriage

The phenomenon of transnational marriage has a long history in China, but it was only a few in ancient times, mainly because of underdeveloped transportation, which made it difficult for ordinary people to achieve transnational marriage. However, in modern China, due to war and foreign invasion, many China people crossed the ocean to make a living abroad, which greatly promoted the formation of transnational marriage, but this was only a few phenomena. For more than 30 years after the founding of the People's Republic of China, the development of transnational marriage has almost stagnated due to political reasons. Until the reform and opening-up, the change of the world economic and political structure, the cultural, economic and political exchanges between countries became more and more frequent, and transnational marriage got unprecedented development. Comprehensive information, the reasons for transnational marriage can be investigated from the following levels:

(1) Economic level

No matter in the past or now, economic factors are the fundamental reasons that affect transnational marriage. In ancient China, this factor was not obvious because of underdeveloped productive forces, and it was often hidden behind obvious political and cultural motives. However, with the development of productive forces, this factor stands out, especially in the present China society, which almost plays a decisive role. It is not difficult to see that the reasons for this level can be investigated from the following two points: First, the development of the world economy has promoted global integration. Driven by the tide of economic globalization, frequent exchanges between countries have promoted the development of transnational occupations. People who work abroad have a great chance to meet the opposite sex abroad, and after a certain degree of communication, they will develop into marriage. Second, the richness of material interests and the uneven distribution of wealth. The economic component in mate selection increases, and the intermediary factor of material increases. Many transnational marriages are driven by superior material living conditions abroad. Many international marriages in China now focus on women's marriages, aiming at obtaining material enjoyment and wealth benefits.

(2) Education level

Cultural factors are the main reasons that affect transnational marriage. In ancient China, cultural factors played a prominent role in marriage, and cultural exchange promoted the development of transnational marriage from all aspects. According to historical records, there are frequent contacts with Southeast Asian countries such as Fusang and Silla. At present, the level of transnational marriage in China is more prominent, which can be investigated from the following points: First, globalization has made the cultures of all countries in the world tend to merge, thus people's values and outlook on life have changed, and the racial barriers in the past have been released. Most people no longer care about their spouses' language, skin color and customs. And people around you can psychologically accept people they know to marry foreigners. Secondly, western culture has been greatly spread in China, and many western books, televisions and movies are published or shown in China. People's thoughts have been greatly influenced, and their views on marriage have also changed. Transnational marriage often appears in front of people.

(3) Ideological level

With the development of the times, people's thoughts have undergone earth-shaking changes. The wave of reform and opening-up has brought China people's current view of marriage into the torrent of world integration. It is unacceptable for China people to marry a foreign country, and it was not a burden or a crime during the Cultural Revolution. We can observe the changes of people's thoughts on transnational marriage from the following three points: First, influenced by the factors of world integration, people's thoughts are gradually changing from conservative and traditional to open, and things that were unacceptable in the past can be tolerated. In the view of marriage, it is not so conservative, and children will not deliberately oppose marrying foreigners. Second, various open western ideas entered the China market through TV and movies, which greatly influenced China people, especially the younger generation of China people. Third, in recent years, China's concept of marriage and family has changed from traditional to modern; The transition from closed to open; The transition from monism to pluralism.

Thirdly, the characteristics and problems of international marriage development in China.

A large number of data show that the transnational marriage in China has developed unprecedentedly, involving almost the whole world. The continuous development of transnational marriage can sum up some characteristics. While examining the development of foreign-related marriages in China, we also found many problems, which are not conducive to the development of transnational marriages to a great extent. Here, we study the characteristics of transnational marriage, summarize some existing problems, and further seek ways to standardize transnational marriage.

(A) China's transnational marriage has its unique characteristics:

1, rapid development. Since the early 1980s, the number of transnational marriages registered in China has increased almost year by year. 1982, the number of transnational marriages registered in China was 14 193 and 1997, reaching 50773.

2. Wide geographical distribution. Cross-border marriages in China involve 53 countries and regions. In the past few years, the United States, Canada and Australia were the majority, but in recent years, East Asia is the majority, and East Asia is mostly Japan.

There are many overseas Chinese. Overseas Chinese and foreign Chinese have always accounted for a large proportion of transnational marriages, usually as high as 70%.

4. There are many marriages. In China, 90% of transnational marriages are between women from China and other countries.

5. The educational level is not high. Generally speaking, the cultural level of transnational marriages registered in China is low. Married to Japan, most of the two sides have low academic qualifications. In contrast, the cultural level of marriage with Europe and America is relatively high, including doctors, managers and presidents.

(B) China's transnational marriage:

1, the foundation of marriage is not for love. Nowadays, most transnational marriages are driven by money and material benefits, and most people who marry abroad seek a better material life and get more enjoyment.

2. There are many "grandchild marriages" with great age differences. According to the data, most people who get married internationally are very different in age. Generally, young women in China in their twenties and thirties marry foreign men who are quite old, and they are in their fifties and sixties or even in their seventies and eighties.

3. There are some "lightning" marriages with short acquaintance time. With the acceleration of the times, there are more and more "love at first sight" marriages, especially between young men and women, and so are some transnational marriages. For example, it only takes ten days for some foreign tourists, investors and workers to meet the opposite sex and get married in China.

4. The phenomenon of cheating marriage by foreign men is serious. Many women in China are confused by material interests, cheated abroad by foreign men, and abused and insulted.

5. The divorce rate of transnational marriage is high. In recent years, the growth rate of divorce is even higher than the marriage rate. According to statistics, when Canadians and China people get married, the divorce rate is 60%. From 65438 to 0997, 30% of the married people were divorced by Japanese husbands and Chinese wives, and 35% by Japanese wives and China husbands. From 1990 to 1995, the number of married people increased by 2.4 times and the number of divorced people increased by 2.8 times. The ratio of divorce to marriage is 20% in 1990 and 26% in 1995.

Fourthly, the current regulation of transnational marriage in China.

In the face of these problems in transnational marriage, we can regulate them from two aspects: law and morality, which complement each other and are indispensable. Only by standardizing these two aspects can we effectively solve the problems existing in the current transnational marriage.

(A) the legal regulation of transnational marriage

1. In strict accordance with the provisions of the new marriage law, both China citizens and foreigners must have proof materials when applying for marriage registration. According to the Marriage Law of the People's Republic of China (revised in 2000), China citizens, foreign citizens and foreigners can only get married if they show corresponding certificates.

2. Improve the imperfect provisions of the Marriage Law on transnational marriage. Simple procedures, complete facts, results review, etc. Legislation should be clearly defined.

3. Combat the use of transnational marriage crimes and protect legal transnational marriages.

(B) the moral control of transnational marriage

1. Cultivate new social customs, advocate socialist spiritual civilization, resist the temptation of money, and be alert to the spread of social moral anomie.

2. To treat transnational marriage rationally, we should not abandon the excellent aspects of traditional culture, build transnational marriage on the basis of true love and advocate the sanctity of love.

3. We should consider the family, children and other factors in cross-border marriage, and realize that cross-border marriage is not a simple money transaction, it is related to social interests as traditional domestic marriage.

Verb (abbreviation of verb) abstract

People marvel at this shocking feeling, but ignore the ups and downs behind the story. Due to cultural differences and different marriage concepts, the purpose of starting a family is different. Tragedy and comedy are staged in marriage, and transnational marriage is not as romantic and sweet as we thought. Couples from different countries warn us that, like any marriage, transnational marriage is not just love. From the above analysis of the current transnational marriage in China, it reflects the motives and economic interests of some parties to go abroad, but the number of people holding these motives has decreased. With the improvement of China's openness and the rapid increase of the number of foreigners living and working in China, transnational marriage will further develop healthily.
