What is the crime of stealing more than 40,000 people's subsistence allowances?

Qiu Guixiang, a villager, has not received a penny of subsistence allowance for seven consecutive years, and village cadres have received 1 10,000 yuan of subsistence allowance for more than seven consecutive years. In April this year, Shimou, a village cadre in San Qian, Hutun Town, Feicheng City, was investigated and punished for taking advantage of his position to illegally obtain other people's subsistence allowances. Why don't village cadres intercept subsistence allowances for seven years?

At the villagers' meeting in the early spring of this year, Qiu Guixiang, 65, found that he had never received the subsistence allowance, but he had actually "enjoyed" the subsistence allowance for seven years.

After investigation, the staff of the procuratorate found that in 2006, Shimou, the accountant and head of civil affairs in San Qian village, seized the passbook issued by the town to Qiu Guixiang after Qiu Guixiang's application for subsistence allowance was approved, and used the money for private use for seven consecutive years, with a total amount of14,000 yuan.

"Qiu's mother-in-law only has one son with mental disorder, and the old man lives with her son." Cha Jian, deputy section chief of the Investigation Department of the Anti-Defamation Bureau of Feicheng City Procuratorate, who participated in the case, said that Shimou took advantage of the illiteracy of the elderly and usually had little contact with the village and deducted the money.

Although Shimou was involved in a small amount, his behavior was bad because of the special object of crime. On July 29th, 20 13, according to Item (6) of Article 2 of Opinions on Strictly Applying Probation and Exemption from Criminal Punishment in Handling Duty Crimes, the court said that the finance involved in the crime belongs to disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, disaster relief and epidemic prevention.

"That's great, we can finally get the minimum living allowance. 200 yuan a month is nothing to others, but life-saving money to our family! " When interviewed, Qiu Guixiang shed tears. Now, the elderly can not only receive the minimum living allowance every month, but also get more than 10 thousand yuan.

It is understood that there are strict regulations on the review and issuance of rural subsistence allowances. After the individual applies, the relevant departments should conduct household surveys, and after the investigation, they should be publicized in towns and villages. After that, there are a series of dynamic management measures, such as sampling survey and review. The evaluation and distribution of subsistence allowances should be strictly supervised.

However, during Qiu Guixiang's seven years of applying for subsistence allowances, no one has ever come home to investigate. According to reports, the general investigation and visit work is carried out by the person in charge of the village government, which provides Shimou with an opportunity. In 2006, Shimou found that there was no list of people approved as low-income households in the village, so he became greedy and detained the passbook of low-income households. In the following years, the timely disclosure of the minimum living allowance list was not strictly enforced.

"Analyzing this case, the reason why village cadres are so bold lies in the lack of supervision over the distribution of subsistence allowances and the lack of real supervision over village cadres." Yu Xiangyang, director of the Rule of Law Research Center of Shandong Academy of Social Sciences, believes that Shimou is the person in charge of villagers' political work, and he is responsible for the distribution of subsistence allowances in the village. If no one supervises Shimou, it is easy to breed corruption.

Another question is, how did Shimou receive the subsistence allowance in the name of others? According to Shimou, he could get the passbook with the ID number of the low-income household because the passbook was not strictly controlled. "In fact, subsidies such as subsistence allowances should only be handled when I am present. Just because I don't need to handle it myself, some people have the opportunity to be criminals. " Zhao Wentao, deputy chief of the Public Prosecution Section of Feicheng Procuratorate, said.

"We don't usually earn much money, and we are not very clear about national policies. What measures the government has to benefit the people are conveyed through village cadres. If they are greedy for our money, what should we do! " Qin Xuefen, a villager from San Qian Village, said.

"The harm of flies is actually no less than that of tigers." Yu Xiangyang said, "At the same time, we should not underestimate the harm of flies. These' flies' directly harm the visible interests of the masses. If similar cases occur frequently, it will seriously weaken the people's trust in the party and the government. "

It is understood that in view of the problems existing in management and supervision, Feicheng City Procuratorate has stationed procuratorial offices in towns and villages to promptly investigate and deal with illegal crimes around the masses.
