Next, I'd like to make three comments.

First, fully affirm the achievements made in water control according to law during the Tenth Five-Year Plan period.

The tenth five-year plan is a period of all-round economic and social development in China, and it is also a period of all-round promotion and remarkable results in the sustainable development of water conservancy. Over the past five years, the CPC Central Committee and the State Council attached great importance to solving the water resources problem and made a series of major arrangements. According to the requirements of Scientific Outlook on Development, the water conservancy department has conscientiously implemented the central water conservancy policy in the new period, and the idea of water conservancy has undergone profound changes, and the sustainable development of water conservancy has been deepened. Taking the harmony between man and nature as the core concept of water conservancy work, taking the sustainable utilization of water resources as the breakthrough point, taking solving the drinking water difficulty and drinking water safety as the primary task of water conservancy work, making overall plans to solve the problems of drought and water shortage, flood disaster, water pollution and soil erosion, making overall plans for water conservancy development in river basins and regions, making overall plans for life, production and ecological water use, paying more attention to the saving, allocation and protection of water resources, and paying more attention to social management and public services. The scale of water conservancy construction in China is unprecedented, a large number of water conservancy infrastructure related to the national economy and people's livelihood and the overall development have been put into practice, and the water conservancy infrastructure construction has reached a new level. The construction of a water-saving society has been steadily advanced, and the national water use efficiency has been significantly improved. Water conservancy reform deepened and capacity building was strengthened. Effectively respond to disasters such as floods and droughts, and the water demand for economic and social development is basically guaranteed. During the Tenth Five-Year Plan period, water conservancy work provided a strong guarantee for the construction of ecological environment, and laid a solid foundation for the reform and development of water conservancy in the Eleventh Five-Year Plan period and even longer, and laid a solid foundation for promoting the stable development of the national economy, ensuring the safety of people's lives and property, and promoting grain production and farmers' income.

Insisting on managing water according to law and promoting administration according to law are the basic requirements and important contents of sustainable development of water conservancy. During the "Tenth Five-Year Plan" period, through the unremitting efforts of water administrative departments at all levels, especially the vast number of water administration workers, the water conservancy department has made important progress in administration according to law:

First, more than 30 laws, regulations and rules, such as the Water Law, the Measures for the Implementation of the Water Permit System and the Regulations on the Management of Sand Mining in the Yangtze River, were revised, formulated or studied in the early stage, and 1 16 local regulations and government regulations were promulgated. Significant progress has been made in water conservancy legislation, and the water conservancy laws and regulations system has been improved. Fourth, strengthen law enforcement, carry out various special law enforcement activities, and investigate and deal with more than 200,000 cases of water violations, effectively cracking down on various water violations and maintaining normal water order. Fifth, in-depth investigation, multi-party coordination, grasping the key points, comprehensive management, mediation of more than 40,000 water disputes, breakthroughs in mediation of major inter-provincial water disputes such as the upper reaches of the Shanxi-Hebei-Danhe River, Dayankeng in Zhejiang and Fujian, and Jingziguan in the Hubei-Henan-Danjiang River, thus maintaining social stability and harmony. Sixth, adhere to the combination of centralized publicity and regular publicity, the combination of learning and using the law, and the combination of popularizing law and governing according to law, extensively and deeply carry out the publicity of popularizing law and water legal system in the Fourth Five-Year Plan, strengthen the awareness and concept of water legal system in the whole society, and improve the ability and level of water administrative departments at all levels to administer according to law.

The continuous promotion of water control according to law has provided important support and guarantee for the reform and development of water conservancy, and effectively promoted the construction of a government ruled by law and the sustainable development of water conservancy. Summing up the "Tenth Five-Year Plan" to control water according to law has the following four outstanding characteristics.

1. By modifying the basic water law, the water resources management system has been straightened out, the unified management of water resources has been realized, and the water resources management system has been strengthened, which has played a fundamental, overall and long-term role in ensuring and promoting the development of water conservancy.

It is of great practical and long-term historical significance to promote water management and administration according to law, realize the sustainable utilization of water resources and promote the development of water conservancy, which is an important milestone in the process of water management according to law.

2. Prioritize priorities, timely legislate and formulate policies and regulations urgently needed for water conservancy development and reform, and issue a number of administrative regulations, rules and policies to ensure the healthy development of water conservancy.

Around the "Water Law" supporting laws and regulations system construction, in view of the urgent needs of water resources management, planning management, construction management, water intake permit management, flood storage and detention area management, resettlement, sand mining management, water price management, etc., carry out the revision, formulation or preliminary investigation of laws, regulations and rules. Four administrative regulations, such as Interim Measures for Compensation of Flood Storage and Detention Areas, Regulations on Resettlement for Construction of Three Gorges Project, Regulations on Sand Mining Management in the Yangtze River, Regulations on Flood Control (Revised), and a number of ministerial regulations, such as Measures for the Administration of Water Supply Price of Water Conservancy Projects and Measures for the Administration of Sewage Discharge into Rivers, were promulgated. The long-awaited Regulations on the Administration of Water Permit and Water Resources Fee Collection has been deliberated and passed in the State Council, and will be implemented on April 15. Around the supporting laws and regulations of the Water Law, local water conservancy legislation has been accelerated, covering all aspects of water resources management and water activities, providing a basis for the water administrative department to administer according to law.

3. The system and mechanism of administration according to law have been continuously improved, ensuring the quality and efficiency of legal work.

The Ministry of Water Resources has strengthened legislative planning and planning, established and improved an expert consultation and demonstration system in accordance with the requirements of combining legislators, actual managers and experts and scholars, extensively absorbed opinions from all parties, and promoted democratic participation in the legislative process. The Technical Specification for Water Conservancy Legislation was formulated, and the Administrative Measures for the Examination and Filing of Normative Documents of the Ministry of Water Resources was promulgated to ensure the quality of legislation. In the legislative practice, all localities have also correctly handled the relationship between local characteristics and the unity of the legal system, and promoted the scientific and democratic legislation. In the concept of law enforcement, we have realized the transformation from the main use to the management of the administrative counterpart to the equal emphasis on managing and regulating our own law enforcement behavior according to law, strengthened the standardization of water administrative supervision, established full-time law enforcement teams in local and river basin institutions, and basically formed a three-level law enforcement network at the provincial, municipal and county levels. Actively straighten out the internal law enforcement relations, and some places have also set up water policy supervision teams to explore the relatively centralized administrative punishment rights, administrative charging rights and administrative licensing rights, and the comprehensive law enforcement of water conservancy has achieved initial results. In accordance with the working ideas of putting prevention first, combining prevention with mediation, and combining engineering measures with non-engineering measures, we will actively explore new mechanisms for preventing and resolving water disputes. The theory of water right has been initially tried and applied in mediating water disputes, and the relevant departments have defined the initial water right according to law, which provides a scientific and reasonable basis for mediation and finds an effective way to solve water conflicts.

4. Water administrative behavior has been effectively regulated, which has promoted the transformation of government functions and the construction of service-oriented government.

We will deepen the reform of the water conservancy administrative examination and approval system, carry out the construction of the administrative licensing system by concentrating on cleaning up the water conservancy administrative examination and approval items, implementing subjects and basis, and initially form a new mechanism to standardize the administrative licensing behavior. Improve the administrative supervision mechanism, actively explore the accountability mechanism of water conservancy administrative law enforcement, promote the establishment of an administrative law enforcement system with clear rights and responsibilities, standardized behavior, effective supervision and strong guarantee, and emerge a number of spiritual civilization service window units and civilized law enforcement units. Strengthen the supervision and restriction of administrative power and administrative behavior, and establish a power operation mechanism with reasonable structure, scientific allocation, strict procedures, clear rewards and punishments and effective restriction. Actively promote the openness of government affairs in the water conservancy system, continuously improve the transparency of water conservancy work, smooth communication channels with the public, and effectively protect the people's democratic rights such as the right to know, the right to participate, and the right to supervise. Conscientiously implementing the administrative reconsideration system has improved the self-correcting ability of water administrative organs.

The work in the past five years has safeguarded the dignity of water conservancy laws and regulations, shaped a good image of water conservancy industry, promoted the process of water conservancy according to law and promoted the sustainable development of water conservancy. The practice in the past five years has further deepened our understanding of managing water according to law and accumulated very valuable experience. Our main experience is:

First, we should organically combine the rule of law with the construction of a government ruled by law. In accordance with the requirements of governing for the people, the new central government emphasizes the three basic principles of scientific and democratic decision-making, adhering to administration according to law and strengthening administrative supervision, and clearly puts forward that "after ten years of unremitting efforts, the goal of building a government ruled by law will be basically realized". During the Tenth Five-Year Plan period, water administrative departments at all levels, in accordance with the objectives and requirements of building a government ruled by law, consciously regard administration according to law as the basic criterion of water conservancy work, gradually change the practice of mainly relying on administrative means to solve problems, strengthen system construction, and do a good job in legislative work; Earnestly perform legal duties, strengthen and improve administrative law enforcement; Perfecting the administrative supervision system and ensuring the correct exercise of administrative power have effectively promoted the administration of water conservancy industry according to law and the self-construction of water conservancy organs at all levels.

Second, we should organically combine the requirements of managing water according to law with the sustainable development of water conservancy. The sustainable development of water conservancy is the concentrated expression of Scientific Outlook on Development in water conservancy work, and it also gives a brand-new era connotation of managing water according to law. In the past five years, water administrative departments at all levels have closely focused on the sustainable development of water conservancy, strengthened their overall awareness and central awareness, studied relevant policies and regulations in advance, conscientiously summed up good practices and experiences created by various localities, and served as outposts, staff officers and backers, providing a good policy and legal environment for the sustainable development of water conservancy.

Third, we should organically combine team building with system building. To promote water conservancy administration according to law, legislation is the foundation and law enforcement is the key. The construction of water administration institutions and law enforcement teams is an important organizational guarantee for administration according to law and an important part of the construction of water administrative law enforcement system. During the Tenth Five-Year Plan period, many areas seized the favorable opportunity of institutional reform, strengthened the construction of water administration institutions, strengthened the capacity building of law enforcement teams, straightened out the water conservancy law enforcement system, and constantly promoted comprehensive water conservancy law enforcement, successfully completing the increasingly arduous water conservancy legal work.

Fourth, we should organically combine the internal resultant force with the external resultant force. Promoting water management according to law requires great attention from leaders at all levels, close cooperation within the water conservancy system, strong support from the people's congress and the legal department of the government, and a good external environment. Second, a deep understanding of the situation of water control according to law

Water resources are very important public resources, and water administration is an important part of government work. It is an important task for us to adhere to and promote water control according to law.

At present and in the future, water conservancy administration according to law is facing precious opportunities:

First, Scientific Outlook on Development has opened up new ideas and horizons for managing water according to law. Second, building a government ruled by law has pointed out the direction for managing water according to law. Government work involves almost all areas of national political, economic and cultural life. In China, 80% of laws, all administrative regulations and 90% of local regulations are implemented by the government. Some of the above problems are the reflection of the lagging legal system construction of water conservancy industry during the period of economic transition and social transformation, some are the performance of traditional water conservancy thinking inertia and work habits, and some are the performance of inadequate and in-depth work implementation. If these problems are not solved well, it will have a serious impact on the healthy development of water conservancy. We must attach great importance to it and take effective measures to overcome it gradually during the Eleventh Five-Year Plan period.

Three, do a good job in the "Eleventh Five-Year Plan" water conservancy administration according to law.

"Eleventh Five-Year Plan" is a crucial period for water conservancy development and promoting water management according to law. In view of the weak links in social management and public service of water-related affairs, the construction of water rights and water market system, and the improvement of sustainable development capacity, we will focus on the system construction that plays a key role in all aspects of water management, highlight the formulation of laws and regulations on resource allocation, conservation and protection, and drought management, and pay close attention to the construction of core systems in the national water rights system, such as initial water rights allocation, total water consumption control and water rights transfer, so as to improve the management level of river basins. It is necessary to implement the responsibility system of administrative law enforcement, clarify the responsibility of law enforcement, improve the assessment mechanism of administrative law enforcement, establish the accountability system of administrative law enforcement, and make great efforts to solve the outstanding problems in the system, mechanism and safeguard measures of water administrative law enforcement. Third, organically combine administration according to law with the transformation of government functions and management methods. Administration according to law is an important content and necessary means for the transformation of government functions. Water administrative departments at all levels should strengthen administration according to law, sort out and standardize various management functions and behaviors, and bring all government functions into the track of rule of law. We should take safeguarding the fundamental interests of the overwhelming majority of the people as the starting point and the end result of our work, speed up the transformation of government functions and the innovation of government management, do a good job in the system construction of performing government functions, and ensure the correct performance of statutory duties. It is necessary to further deepen the reform of the administrative examination and approval system, gradually solve the problem of inconsistent and uncoordinated implementation of water administrative licensing between river basins and regions, unify administrative licensing matters, administrative licensing conditions, administrative licensing procedures and administrative licensing standards, and implement standardized management of water administrative licensing. It is necessary to further accelerate the construction of e-government, further promote the openness of government affairs, take issues that are of general concern to the people and involve vital interests as the key content of government affairs openness, and constantly expand the content of government affairs openness around the basic situation of administrative subjects and the procedures, methods and results of administrative decision-making, implementation and supervision. It is necessary to combine the promotion of administration according to law, intensify the reform of institutional mechanisms, improve working methods, methods and styles, and comprehensively improve the efficiency of administrative work.

Fourth, we should further strengthen the construction of water administration supervision team. At present, half of the listed water supervision teams have not been compiled, and half of the more than 60 thousand water supervision personnel are part-time. These two "halves" show that the construction of water administration supervision team still faces many difficulties and the task is very arduous. All localities should put the construction of institutions and teams in a prominent position, actively strive for and act positively, ask for more instructions, report more situations and reflect more difficulties, publicize the requirements of the Ministry of Water Resources and good practices in other places, and do everything possible to win the attention of leaders, the support of relevant departments and social participation. Water conservancy administrative departments at all levels should play an important role in water conservancy according to law with a high sense of responsibility and mission, strengthen professional guidance, supervision and inspection, and at the same time strengthen cooperation and cooperation with other internal departments of water conservancy, understand and support each other, further promote capacity building, straighten out internal relations, and explore comprehensive law enforcement channels. In accordance with the requirements of "strengthening the internal quality and shaping the external image", we should strengthen the political education and professional training of water administration supervisors and continuously improve the quality and ability of the team. Engaged in water administration supervision, the mission is glorious, the responsibility is great, sometimes dangerous, sometimes tempting. We should dare to face difficulties, be responsible, be willing to contribute, and establish an image of civilization, honesty, justice and diligence. Water administrative departments at all levels should create necessary working conditions for water administration supervision, solve problems such as law enforcement equipment, office conditions and funds for handling cases, and care about the work, life and study of water administration supervision personnel. Having said that, I want to emphasize that the party group of the Ministry attaches great importance to strengthening and improving water administrative law enforcement. Regarding the existing problems, Minister Wang asked the Department of Political Science and Law to seriously study the specific measures to solve them. Recently, for example, the Ministry issued a notice to purchase personal accident insurance for censors. Experience in some areas shows that the key to solving problems lies in whether leaders attach importance to it. Water law enforcement funds are a budget item, and the policy in this regard is clear. It is hoped that the leaders of water administrative departments at all levels will actively strive for the support of the financial department and earnestly implement it.

Comrades, promoting water conservancy administration according to law is a concrete action to implement the spirit of the 16th National Congress of the Communist Party of China and the 4th and 5th Plenary Sessions of the 16th National Congress, an important measure to build a government ruled by law and promote the sustainable development of water conservancy, and an important mission of water conservancy workers.
