What are the conditions for the approval of rural homestead?

The examination and approval of rural homestead shall meet the following conditions:

1. The applicant must be a rural hukou, live in the countryside all the year round, and have no homestead under his name.

2. Age requirement, usually 18 years old, with independent financial resources and household separation.

3. It must conform to the policy of "one household, one house", that is, a villager can only have one house under his name.

4. It must conform to the unified overall residential planning of the village.

5. You must seek the opinions of your neighbors.

6, must comply with the overall land use planning, land use annual plan and village construction planning.

7. Non-farmers and other personnel are strictly prohibited from buying homestead in the village.

8. You may not apply for the homestead again because of renting or selling the original homestead.

9, must conform to the basic rural planning.

To sum up: houses on rural homestead can be bought and sold. However, it needs to be approved by the relevant departments and can only be sold to villagers of this collective economic organization. Only members of the collective economic organization are eligible to use the homestead of the organization. Therefore, farmers outside the collective economic organizations are not legal buyers of rural houses.

Article 13

Under any of the following circumstances, you can apply for a homestead: (1) Relocation or reconstruction is needed due to national or collective construction, relocation or disaster; (two) the implementation of city, village and market town planning or the transformation of old villages, the need to adjust the demolition; (three) the existing homestead area has not yet reached the quota standard stipulated in these measures and needs to be rebuilt or expanded; (four) with household conditions and the original homestead area has not yet reached the limit standard stipulated in these measures, which needs to be rebuilt or expanded; (five) with the approval of the county people's government, the professional and technical personnel introduced or recruited by rural collective economic organizations really need to settle in rural areas; (six) retired workers, demobilized soldiers and overseas Chinese, their relatives, Hong Kong, Macao and Taiwan compatriots with legal documents to return to their original places to settle down; (seven) as otherwise provided by laws, regulations and rules.
