Measures for the administration of foreign contracted projects and construction labor cooperation in Xinjiang Uygur Autonomous Region
These Measures shall apply to all units engaged in the above contracting activities. Article 3 The duties of the Office of the Leading Group for Foreign Contracted Projects and Labor Cooperation of the Autonomous Region (located in the Construction Department of the Autonomous Region) are: under the direct leadership of the Leading Group for Foreign Contracted Projects and Labor Cooperation of the Autonomous Region and under the operational guidance of the Foreign Economic and Trade Commission of the Autonomous Region, to implement the principles and policies of the state and the autonomous region on foreign contracted projects and labor cooperation, to promote exchanges and cooperation with the international construction industry, and to be responsible for the management and services of foreign contracted projects and construction labor services; Balance and organize the design, construction and installation forces; Coordinate the relationship between foreign project contracting and construction services and relevant departments; Review the technical qualifications of the survey, design and construction units of foreign contracted projects; Participate in organizing the training of overseas personnel to ensure their professional quality; Do a good job of guidance, coordination and service during the construction period, and examine and approve measures and methods to improve the quality of the project; Timely exchange information on foreign project contracting and construction labor cooperation, and promote the development of foreign project contracting in the autonomous region. Local, state and municipal construction administrative departments are responsible for the daily management of foreign project contracting and labor cooperation in this region. Chapter II Management of Foreign Contracting Qualification Article 4 Design and construction units that have obtained the right to operate abroad in the autonomous region may independently contract foreign projects. Construction enterprises with one or two qualifications without the right to operate abroad and survey and design units with one or two qualifications may cooperate with units with the right to operate abroad to contract foreign projects. Enterprises of Grade III and below may subcontract or provide labor services to overseas implementing units. Key enterprises or special professional design and construction units in various regions, prefectures and cities may be appropriately relaxed after approval by the autonomous region. Article 5 Construction enterprises going abroad must hold the Qualification Certificate for Foreign Contracted Projects of Construction Enterprises, the person in charge of overseas projects must have the corresponding certificate of project manager, and the technical person in charge must meet the requirements of qualification management regulations. Article 6 After an overseas project is approved (or signed) by the Foreign Trade and Economic Cooperation Office of the Autonomous Region or its authorized unit, the overseas implementing unit shall report the relevant information to the Office of the Leading Group for Cooperation in Foreign Contracted Projects and Construction Services of the Autonomous Region, and after reviewing the technical qualifications for going abroad, issue the Task Book for Foreign Contracted Projects or the Task List for Foreign Subcontracted Projects (Construction Services) as the technical text of the overseas contracting activities of the overseas implementing unit.
"Foreign contracted projects" and "foreign subcontracted projects (construction services) task list" are uniformly printed by the office of the leading group for foreign contracted projects and construction services cooperation in the autonomous region. Article 7 The office of the Leading Group for Cooperation in Foreign Contracted Projects and Construction Services of the Autonomous Region shall be responsible for handling the task book of foreign contracted projects and the task list of foreign subcontracted projects (construction services), and the overseas implementation unit that needs to handle the task book or task list shall submit the following materials:
A copy of the approved foreign project contract (or agreement) and a mutually beneficial foreign economic cooperation project contract filing form (copy).
Two, the "construction enterprise foreign contracted project qualification certificate" (original).
Three, the legal person to go abroad to entrust the agent (project manager), the technical person in charge of the entrustment documents, technical title certificate, project manager certificate.
Four, the list of overseas management personnel, engineering and technical personnel, professional title certificate (copy), and the roster of overseas personnel.
5. The unit that subcontracts the project or provides labor services shall also submit the contract signed with the general contractor of construction (or the labor contract signed with the labor export unit). Article 8 The Task Book for Foreign Contracted Projects and the Task List for Foreign Subcontracted Projects (Construction Services) are both in quintuplicate, which are submitted to the Office of the Leading Group for Foreign Contracted Projects and Construction Services Cooperation of the Autonomous Region, the Foreign Affairs Department of the Autonomous Region, the Foreign Trade and Economic Cooperation Department of the Autonomous Region and the foreign contractor respectively, and each overseas implementing unit holds one copy. Chapter III Contracting, Supervision and Administration of Foreign Projects Article 9 Only after obtaining the task book of foreign contracted projects or the task list of foreign subcontracted projects (construction services) can the implementing unit go through the formalities of going abroad at the examination and approval department of the autonomous region. Any department that has not obtained the task book or task list shall not go through the formalities of going abroad. Article 10 An overseas implementing entity must contract overseas projects in strict accordance with its qualification level and approved business scope. The Office of the Leading Group for Cooperation in Foreign Contracted Projects and Construction Services of the Autonomous Region will inspect, supervise and manage the progress, quality, safety, foreign affairs discipline and existing problems of foreign projects in conjunction with relevant departments from time to time.
