Chapter III Regulations of Beijing Municipality on Water Source Protection and Management of Miyun Reservoir, Huairou Reservoir and Jingmi Diversion Canal

Thirteenth two reservoirs and one canal first-class protected areas are non-construction areas and non-tourist areas, and it is forbidden to build, rebuild or expand projects other than water conservancy or water supply projects. Set up protective nets in key areas within the first-class protection zone, and prohibit tourists and other irrelevant personnel from crossing the net boundary, and prohibit anyone from destroying the protective nets. It is forbidden to set up commercial, catering and service outlets within the management scope of water conservancy projects on both sides of Miyun Reservoir, Huairou Reservoir Bashang Area and Jingmi Diversion Canal.

Environmental planning, management and water quality evaluation shall be carried out for the first and second protected areas, and the second standard in the national environmental quality standard for surface water and the sanitary standard for drinking water sources in the national sanitary standard for drinking water shall be implemented.

Fourteenth the following acts are prohibited in the two reservoirs and one canal level protection zone:

(1) Directly or indirectly discharging sewage and waste liquid into water bodies and dumping garbage, muck and other solid wastes;

(2) stacking and storing garbage, muck and other solid wastes on beaches and bank slopes;

(three) swimming, water training and other water sports and entertainment activities in two reservoirs and one canal;

(four) the establishment of livestock farms, livestock directly in the water;

(five) cleaning vehicles, clothes and other appliances directly in the water;

(six) poisonous fish, fried fish, electric fish and fishing in non-designated waters;

(seven) the application of harmful fish medicine and high toxic and high residue pesticides;

(eight) camping, picnic and other tourism activities that pollute the water quality;

(nine) vehicles driving on the dam without the approval of the Municipal Water Conservancy Bureau;

(ten) launching without the approval of the Municipal Environmental Protection Bureau or changing the purpose of the approved ship;

(twelve) other acts of water pollution in violation of laws and regulations.

Fifteenth Miyun Reservoir, Huairou Reservoir two protected areas shall not be built to directly or indirectly discharge sewage into the water body construction projects.

Sixteenth Miyun Reservoir and Huairou Reservoir shall not build chemical, paper, pharmaceutical, tanning, printing and dyeing, electroplating, metallurgy and other construction projects that seriously pollute the water quality. The construction of other projects must comply with the provisions of the state and this Municipality on environmental protection management of construction projects.

Seventeenth units in the two reservoirs and one canal protection zone shall comply with the following provisions:

(a) abide by the laws and regulations on the protection and management of water sources, and accept the supervision and inspection of the administrative departments of environmental protection, water conservancy and planning;

(two) to establish and improve and organize the implementation of the responsibility system for water source protection in this unit;

(3) If the original units in the first-class protection zone and the units in the second-class protection zone discharge water pollutants, the first-class standard in Beijing Water Pollutant Discharge Standard shall be implemented;

(four) to maintain the integrity and safe operation of sewage treatment or other pollution prevention equipment and facilities, formulate emergency measures to prevent water pollution, and prohibit untreated sewage from being directly discharged into water bodies. If the sewage treatment facilities need to stop production, repair, transform or update, they must be reported to the local environmental protection administrative department for examination and approval 15 days in advance, and can only be carried out after approval and measures to prevent water pollution are taken;

(5) When an accident or other unexpected event causes or may cause water pollution, effective measures shall be taken to prevent or reduce the pollution, and immediately report to the local people's government and the competent administrative department of environmental protection.

Article 18 The Municipal Environmental Protection Bureau shall control the total amount of pollutants discharged from the pollution sources in the two reservoirs and one canal protection zone. In the case that the total amount exceeds the standard, with the approval of the Municipal People's Government, the Municipal Environmental Protection Bureau shall order the relevant units to cut or stop the discharge of pollutants.

If the pollutant discharge in the two reservoirs and one canal protection zone exceeds the discharge standard, the competent administrative department of environmental protection shall order it to be treated within a time limit.

Article 19 The municipal and relevant district and county people's governments shall vigorously plant trees in the two reservoirs and one canal protection zone, protect natural vegetation, prevent and control soil erosion, improve the ecological environment and improve the self-purification ability of water bodies.

Article 20 Units or individuals engaged in cage fish farming in Miyun Reservoir must engage in cage fish farming activities in strict accordance with the scale and location approved by the Municipal Environmental Protection Bureau, the Municipal Water Conservancy Bureau and the municipal fishery administrative department, and report the number of fish raised and the situation of feeding and dosing to the local environmental protection bureau every June.

It is forbidden to engage in cage fish farming within three kilometers of the water intakes of Miyun Reservoir, Baihe Main Dam of Huairou Reservoir and Jiusongshan Auxiliary Dam.
