Legal analysis: According to the planning, the Yellow River floodplain in Henan Province runs from Baihe in Mengjin County, Luoyang City to Zhangzhuang in Taiqian County, Puyang City, with a river length of 464 kilometers, a floodplain area of about 2 1 16 square kilometers, 2.28 million mu of cultivated land and a population of 654,380+0.254 million, involving Zhengzhou, Kaifeng, Luoyang, Jiaozuo, Xinxiang and Xinxiang. According to the needs of flood control and local conditions, this plan will relocate 243,200 people in the Yellow River beach area of Henan Province in three years from 2065,438+07 to 2065,438+09, and the relocation task will be completed in 2020, involving Zhengzhou, Kaifeng, Xinxiang, Puyang, Changyuan, zhongmou county, Xiangfu and Xiangyang.

In the scheme, centralized resettlement is the main method, supplemented by decentralized resettlement. Those who choose centralized resettlement and have the ability to bear the cost of self-raised housing will live in the corresponding housing after payment; Unable to bear the required self-raised housing costs, after the application of the head of household, posting publicity, mass appraisal and the approval of the county and township governments, the provincial investment and financing platform will provide financing assistance to the relocated county (district) government to solve the self-raised housing costs of the people in difficulty, and the relocated county (district) government will be responsible for unified loans and repayment as the main responsible person. People who choose to buy houses in cities and towns and other scattered resettlement, upon the voluntary application of the heads of households, the county and township governments agree to sign an agreement to enjoy the same housing subsidy policy as the relocated households after the original houses are demolished.

Article 1 In order to strengthen and standardize the construction of resettlement project in the Yellow River beach area of our province, ensure the smooth implementation of the project, improve the investment benefit, and promote the early realization of a win-win situation for the safety of the Yellow River and the development of the beach area, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual and engineering characteristics of our province.

Article 2 These Measures shall apply to the relocation projects within the scope of the "Relocation Plan for Residents in the Yellow River Beach Area of Henan Province" (hereinafter referred to as the "Plan") approved by the state.

Article 3 The leading institutions of resettlement in the Yellow River beach area at all levels should conscientiously implement the working mechanism of "province taking overall responsibility, cities and counties implementing", and be responsible for the unified management of resettlement projects in the Yellow River beach area under the leadership of the government at the corresponding level.

Article 4 The main objectives of residents' relocation in the Yellow River beach area are: to relocate 243,200 low-lying and waterlogged dangerous houses in the Yellow River beach area in three years from 20 17 to 20 19, and to complete the relocation task in 2020.
