(2) If a road traffic accident occurs due to the fault of two or more parties, they shall bear primary responsibility, equal responsibility and secondary responsibility respectively according to the role their actions played in the accident and the severity of the fault;

(3) The parties are not at fault for causing road traffic accidents. If it is a traffic accident, neither party is responsible.

2. Legal basis: Article 44 of the Road Traffic Safety Law of the People's Republic of China.

The traffic administrative department of the public security organ shall make a traffic accident determination within 10 days from the date of investigation of the site.

In case of a hit-and-run traffic accident, a traffic accident identification shall be made within ten days after the hit-and-run person and vehicle are seized.

If inspection or appraisal is needed, a traffic accident confirmation shall be made within five days after the inspection, appraisal or re-inspection and appraisal results are determined.
