For applicants in most other parts of the world: at present, professional immigration is the first and second priority, and there is no need to schedule; The third priority is about four and a half. The immigration schedule is calculated from the applicant's priority date. For labor card applicants, the priority date is the date when the labor card application is submitted. The priority date for applicants with outstanding talents and national interest exemption is the time to submit I- 140. The applicant's priority date will appear on the I- 140 approval document. Before the immigration schedule, the applicant's I-485 application will not be approved and the green card will not be obtained immediately. Immigration scheduling and immigration approval time are different. The examination and approval time of the Immigration Bureau refers to the time required for each immigration center to hear a case. Usually, the four major immigration centers (TSC, VSC, NSC, CSC) will regularly announce the processing time; The immigration schedule of the United States is issued by the State Council, and the immigration bureau has no right to decide the immigration schedule. According to the usage of immigration quota, the State Council (DOS) publishes the immigration schedule every month, which is the visa bulletin you see every month. How does the State Council work out the immigration schedule? The State Council, the US Immigration Service and the US Department of Labor hold regular monthly meetings to discuss the use of immigration quotas. According to the usage at that time, the State Council adjusted the immigration schedule. If the number of places required by the Immigration Bureau is very large in that month, the State Council will suspend the immigration scheduling progress. If necessary, the State Council will even reverse the immigration schedule. Due to various reasons, the Immigration Bureau has a large backlog of cases, some of which have early priority dates. These cases will not be given immigration quotas until the immigration department completes the examination and approval. If the Immigration Bureau adopts a new policy, so that a large number of backlog applications are approved, the Immigration Bureau will ask the State Council for a large number of immigrant places at the monthly meeting, which will lead to the retrogression of immigration schedule. At present, the phenomenon that the second and third priority of professional immigrants takes a long time is a very significant factor. Since 2008, the US Immigration Service and the US Federal Bureau of Investigation have accelerated the pace of background investigation. The number of applicants who have been waiting for background checks for more than six months has decreased from 300,000 to 30,000. Many applications that have been shelved due to background checks have been approved by the Immigration Bureau. This batch of applications with earlier scheduling time used a large number of immigrant places, so the scheduling progress of immigrants was greatly affected. In order to formulate the immigration schedule policy more accurately, the State Council and the Immigration Bureau adopted a new set of approval procedures after May 2007. This procedure allows the Immigration Bureau to complete all the approval steps, including the FBI background check, without immigration quota. The approved application will be directly registered in the database in the State Council. In this way, the State Council will directly know how many applications in the database meet the conditions for obtaining a green card in the monthly immigration dispatch plan. Of course, the final determinant of the immigration schedule is the annual immigration ceiling passed by Congress. What the State Council and Immigration Bureau can provide is more effective approval of green card applications on the basis of this upper limit. Only by raising the upper limit of the number of immigrants each year, especially in China, Indian and other countries with long immigration teams and large numbers, can the problem of immigration scheduling be finally solved.
