1. Application conditions
Mainland residents who meet any of the following circumstances may apply to settle in Hong Kong or Macao.
(1) If one of the spouses has settled in Hong Kong or Macau, they can apply for accompanying children under the age of 18 at the same time.
(2) Over 18 years old but under 60 years old, whose parents who have settled in Hong Kong or Macao are both over 60 years old and have no children in Hong Kong or Macao and need to be taken care of by them.
(3) Those who are over 60 years old and have no children in the Mainland and need to settle in Hong Kong or Macao with children over 18 years old.
(4) Those who are under the age of 18 and need to seek refuge with their parents who have settled in Hong Kong or Macao.
(5) Children of permanent residents of Hong Kong or Macao.
(6) There are other special circumstances that require you to settle in Hong Kong or Macao.
In the above item (2), "no children in Hong Kong or Macao" refers to children who do not have permanent resident status in Hong Kong or Macao or who have been approved by the exit-entry administration department of the public security organ to settle in Hong Kong or Macao. .
2. Procedures that applicants must complete
Mainland residents who apply to settle in Hong Kong or Macau must apply in person to the exit and entry administration department of the public security bureau at or above the county level where they are registered. , accept interviews and inquiries, and perform the following procedures:
(1) Submit a completed and affixed recent full-face, bareheaded color photo of the applicant and the Hong Kong or Macao relatives to be reunited (hereinafter referred to as the Hong Kong and Macao related persons) (48×33mm) "Application Form for Mainland Residents to Settl in Hong Kong or Macao" (hereinafter referred to as the application form).
(2) Submit the applicant’s original household registration book and resident ID card for inspection, and submit a copy; those under the age of 16 must also be accompanied by their guardian and submit the guardian’s household registration book for inspection , resident identity card, and submit a copy, as well as a guardian's opinion agreeing to settle in Hong Kong or Macao.
(3) Submit a copy of the Hong Kong or Macao resident identity card and the Mainland Travel Permit for Hong Kong and Macao residents of the Hong Kong and Macao related person. If the person related to Hong Kong and Macao is of foreign nationality, he must submit a copy of his Hong Kong or Macao permanent resident identity card and foreign passport for inspection.
(4) Submit the opinion of the applicant’s work unit or the public security station where the applicant is registered as to the applicant’s intention to settle in Hong Kong or Macao.
1. For national staff, opinions shall be issued after approval by the affiliated work unit or superior supervisory unit in accordance with the personnel management authority.
2. Employees of state-owned enterprises and public institutions shall have their opinions issued by the personnel department of their workplace.
3. For students over the age of 16, opinions shall be issued by their school.
4. Those who are under the age of 16 are exempted from submitting opinions to the public security police station of their school or their place of residence.
5. For other personnel, opinions shall be issued by the public security police station at the place of residence.
(5) Submit proof corresponding to the reason for application.
1. If it falls under the circumstances specified in item (1) of the application conditions, it refers to the marriage certificate; if accompanying children, it refers to the birth and medical certificate and other proof of parent-child relationship.
2. If it falls under the circumstances specified in items (2), (3), (4), and (5) of the application conditions, it refers to the birth and medical certificate and other proof of parent-child relationship, and the parents’ marriage certificate, of which the first Item (2) also includes proof that the parents have no children in Hong Kong or Macao, and item (3) also includes proof that the parents have no children in the Mainland.
3. If it falls under the circumstances specified in item (6) of the application conditions, it refers to the certificate corresponding to the specific special circumstances.
For the certificates specified in items 1 and 2 above, the originals and copies must be submitted for inspection.
(6) If the relationship between children and parents falls into the following circumstances, the following materials must also be submitted:
1. The applicant is under 18 years old, is a child born out of wedlock or his parents are divorced , if the father (mother) who raises him or her is about to go or has already settled in Hong Kong or Macau, he can apply to settle in Hong Kong or Macau as a companion child under the category of husband and wife reunion or as a minor to go to live with his parents. Applicants need to provide legally valid proof that they are being raised by their father (mother) who is about to settle or has settled in Hong Kong or Macau.
2. The applicant or the person related to Hong Kong and Macao is an adopted child and must provide a legally binding proof of adoption relationship: if the adoption relationship was established before March 31, 1992, it means that the notary department at or above the county level established the adoption relationship. The notarized adoption certificate issued at the time of the relationship; if the adoption relationship was established from April 1, 1992 to July 31, 1999, it refers to the "Adoption Certificate" issued by the civil affairs department of the people's government at or above the county level when the adoption relationship was established or notarized at or above the county level. 3. If the applicant is an illegitimate child or has doubts about the parent-child relationship, he or she must undergo a paternity test at a hospital or institution designated by the exit-entry administration department of the public security organ; children of Hong Kong or Macao permanent residents are If a child is born out of wedlock or if there is any doubt about the parent-child relationship, a paternity test must be conducted at an institution designated by the Exit-Entry Administration Bureau of the Ministry of Public Security.
(7) Submit other certificates deemed necessary by the exit and entry administration department of the public security organ.
3. Publicity
If the applicant meets the application conditions and reaches the approval score, the exit and entry management department of the public security organ will publicize the applicant's application status and accept public supervision. The publicity content includes the applicant’s name, gender, date of birth, reason for application, score, etc. The publicity time is 10 working days.
4. Procedures for obtaining a permit to travel to Hong Kong and Macao
After the exit and entry administration department of the public security organ makes a decision to approve the applicant to settle in Hong Kong or Macao, it will issue a "Notice of Approval of Settlement" to the applicant. 》. The applicant shall go through the procedures of canceling the household registration and canceling the resident ID card with the "Notice of Approval of Settlement". The exit and entry administration department of the public security organ will issue the applicant a "Pass to Hong Kong and Macau" based on the proof of household registration cancellation and resident identity card cancellation submitted by the applicant.
The "Pass to Hong Kong and Macau" is uniformly printed by the Exit-Entry Administration Bureau of the Ministry of Public Security. It is valid for 3 months and is valid for one use.
5. Renewal and re-issuance of certificates
If the applicant applies for a replacement or re-issuance of the certificate within the validity period due to the loss, theft or damage of the "Pass to Hong Kong and Macau", Applications for renewal or reissue of documents should be made to the exit-entry administration department of the public security organ in the place of original application. If the certificate is lost or stolen, a written statement must be submitted. If the certificate is damaged, the original certificate must be returned.
If the applicant fails to settle in Hong Kong or Macao without valid reasons within the validity period of the certificate, he or she must reapply to settle in Hong Kong or Macao.
If children of Hong Kong permanent residents apply for renewal or reissue of the "Permit to Hong Kong and Macau", the exit and entry management department of the public security organ shall notify the Hong Kong Immigration Department, and the Hong Kong Immigration Department will re-issue the "Permit to Hong Kong and Macau" for the applicant. "Certificate of Right of Residence" is renewed or reissued.
