First, what is a birth certificate?

Birth notarization refers to the activities of a notary office with foreign notarization right to prove the legal facts of the birth of a party according to the application of the party concerned. Birth notarization is mainly used for the parties to handle immigration, study abroad, job hunting, property inheritance and naturalization procedures. It is a necessary notarial certificate for people going abroad. It is an activity that the national notary office certifies the fact that a party was born in China according to his application. If the party concerned was born in other countries or regions, and the fact that he was born abroad is recorded in the household registration file when he returns to China for settlement, the notary office may also issue a notarial certificate for him according to the household registration file. It shall be under the jurisdiction of a notary office with foreign-related jurisdiction at the domicile of the parties or the place where the facts occurred.

Second, the place to apply for a birth certificate

(1) The applicant shall apply to the notary office of his domicile or birthplace for notarization. (2) Where notarized documents are sent abroad for use, they shall be sent to the Ministry of Foreign Affairs or the foreign affairs offices of provinces, autonomous regions and municipalities directly under the Central Government, as well as the relevant countries in embassies and consulates in China for certification. However, unless it is otherwise stipulated by the country where the document is used or the consular certification is exempted by mutual agreement.

Three, the parties shall submit the following documents:

1. If the applicant is in China, provide his/her ID card and household registration book; If the applicant is abroad, his passport (date of departure and valid visa) should be provided; If the applicant is a resident of Hong Kong, Macao and Taiwan, he/she shall provide his/her ID card, pass (home visit permit) and Taiwan compatriot certificate; 2. The applicant's hospital birth certificate. If the applicant has no birth certificate but was born in our district, provide the birth certificate issued by the neighborhood office, neighborhood (village) committee, police station or unit personnel department where his household registration is located (if there is no hospital birth certificate and his place of birth is not in my place, it will not be accepted for the time being); 3. The identity card and household registration book of the applicant's parents; 4. To apply for a birth certificate for use in the United States, Thailand, France, Austria and Singapore, the applicant shall provide a recent bareheaded one-inch photo of himself; The photos shall be pasted on the notarial certificate, which shall be determined according to the number of notarial certificates required by the applicant. If the applicant requests to provide three notarial certificates, it shall provide four photos (one photo is required for notarial files).

4. Matters needing attention in handling birth notarization:

1. Use simplified Chinese characters. In foreign language translation, Chinese Pinyin should be used. In order to facilitate the parties to use the notarial certificate, if there is a previous name, it should be proved on the notarial certificate at the same time after the valid certificate.

2. The date of birth of the parties in the notarial certificate is one of the core contents of the notarial certificate, which must be accurate, true and conclusive. The date of birth is based on the identity card; If there is no identity card, the household registration certificate or birth certificate shall prevail; If there is no such certificate, refer to other certificates (such as files and passports) and adopt the Gregorian calendar. The date of birth of the lunar calendar may be indicated in brackets if the notarized parties require otherwise.

3. The birthplace of the parties in the notarial certificate shall be clear and specific, and the full name of the place name shall be written. The address of birth should be written in the city or county, and according to the requirements of the place of use (country), it can also be written in the township, village or town street. If the place name of the party concerned changes at birth, the full name of the place name shall be indicated in brackets after the current place name.

4. The parents of the parties to the birth certificate should indicate the names of their biological parents. If parents die, it should be indicated in brackets. If the party concerned has been adopted by others, the names of the adoptive parents shall be indicated. The birth certificate of a child born out of wedlock may omit the name of the biological father at the request of the parties concerned.

5. If the date of the identity documents provided by the parties is inconsistent with the date on the overseas documents (such as passports and passes), and the change is proposed, if the inconsistency is caused by the work error of the original issuing authority, the parties shall go to the issuing authority for notarization after correction. If the notary lied about his age in order to go abroad at that time, he should be notarized according to his real age after finding out.

6. If a party who has gone abroad applies for a birth certificate and the notary office finds no clues after investigation, it can issue a "no record certificate" for the party. In the United States and other countries, this notarial certificate can be used as supporting evidence.

7. The notary office can only handle birth certificates for China citizens or foreigners born in China. People born abroad should obtain birth certificates from local authorities if they need such certificates.
