Are there any restrictions on party members obtaining H visas?

No.

Legal analysis: Members of the Communist Party of China, like other Chinese citizens, can obtain a tourist visa to the United States for up to 10 years. In principle, this policy change could affect the travel of some 270 million people - China has about 92 million Communist Party members - however in practice it may be difficult to identify who is a member of the party other than senior officials .

Informed sources revealed that the new guidelines allow U.S. officials to determine party membership based on an individual’s visa application and interview status, as well as their knowledge of local Communist Party membership.

Legal basis: Article 9 of the "Exit and Entry Administration Law of the People's Republic of China" Chinese citizens entering and exiting the country shall apply for passports or other travel documents in accordance with the law. Chinese citizens traveling to other countries or regions also need to obtain a visa or other entry permit from the country of destination.

However, this is except where the Chinese government has signed mutual visa exemption agreements with other governments or the Ministry of Public Security and the Ministry of Foreign Affairs provide otherwise. Chinese citizens who enter or exit the country as seafarers or work on foreign ships must apply for a seafarer's certificate in accordance with the law.
