What are the requirements for employers in the employer-sponsored immigration program in Ontario, Canada, which goes abroad from the Pacific?

On May 20th, 2020, Ontario nominated and published new regulations. The renewal requirements of employer-sponsored projects in Ontario tend to be tightened, which puts forward new and higher requirements for employers. The requirements are as follows:

OINP requires employers to prove that they have made reasonable efforts to recruit Canadian citizens or permanent residents before recruiting overseas workers, unless:

1. The applicant has a work visa to work in Ontario;

2. The position has been approved by the Labor Market Impact Assessment (LMIA)

Employers should first recruit in China by themselves, or turn to domestic specialized recruitment agencies or expert headhunters for help. After hard work, overseas workers will only be considered if there are no relevant talents in China.

Impact of the update on the applicant

The above updates send a signal to candidates and people who want to immigrate to Ontario: it is difficult to find a qualified employer in Ontario.

Employers in Ontario sponsor immigration projects, which fall into three main categories:

International students;

Shortage of occupational categories;

Overseas workers.

Although the requirements are slightly adjusted, the application conditions for employer-funded projects in Ontario remain unchanged.

In fact, the difficulty of employer-funded projects in Ontario mainly lies in the higher requirements for employers.

Both the federal government and the provincial government will put forward high requirements for the types of employer guarantees nominated by LMIA and PNP provinces, including the employer's operating hours, office space, employee status, number of employees and profitability.
